The minutes of the meeting of August 24, 1995 were continued to the next meeting. NEW BUSINESS 1. Application No: 12-U-95, and 25-EA-95 Applicant: Rosalind Cardia Property Owner: Alex Byer, By~r Properties Location: 10594 South DeAnza Boulevard USE PERMIT: For a plumbing business in an c-,dsting shopping canter. The applicant is currently in this proposed shopping center, but due to the new commereial zone, they are applying for a conditional Use Permit. The applicant is also proposing to conslruct a wall that ranges from twelve to fourteen feet to help eliminate noise for the residents located behind the shopping center. The noise is caused by employee parking and deliveries that occur in this back area. Staff is not requiring a sound study as the residents have agreed to the sound wall. The applicant understands that pickup and delivery is 8 a.m. to p.m. Mr. Cowan suggested that after six months if the residents are not happy with the soundwall, there should be a gate constructed to ensure that no deliveries are being made after the allowed times. Mike Horton, architect for the applicant, explained that the residents have chosen what height they would like their section of the wall to be, and they will also being agreeing upon the type of texture they would like. Staff do~s not foresee any environmental impacts. Paul Roberts moved for a Negative Declaration. Don Brown seconded the motion. Vote: 5-0 -ERG- September 14, 1995 2.
