Staff indicated that the General Plan Amendment request had been previously reviewed by ERC
on July 13, 1995, and would not be discussed at this meeting. Staff indicated that the project
environmental impacts would be considered from the standpoint of the difference in environmental
impacts from the previously approved project (1989) as compared to the proposed project for this site.
Staffdescribed both the 1989 approved project and the 1995 proposed project. The 1989 project was a
195 unit apartment complex. The design was podium style with access through to Blue Jay. The
proposed project is a 140 unit apa~i-,,ent complex with at-grade con~huction without access to Blue Jay.
Staffreviewed the 1989 environmental impacts. The primary 1989 environmental impacts considered
included traffic, air quality, and noise. The traffic report stated there would be a significant increase of
traffic generated from the site to the adjoining roads. There were required roadway improvements at
Blue Say, Homestead & De An~ Blvd. These improvements have been completed to meet City
standards. The noise study identified decibel level impacts from surrounding roadway vehicle noise to
the site and required building design mitigations. The air quality report concluded no significant
impacts.
· Staffthen discussed the potential environmental impacts of the proposed project and
recommended additional studies or acfious to be taken. Last year a potentially protected burrowing owl
was discovered on Phase IH. According to biological standards the animal was passively relocated and
the burrow was excavated. A new burrowing owl survey was conducted on this portion of the site and no
burrows were found. Regarding traffic, staff recommended an amended traffic report be conducted
because the through drive to Blue lay is proposed for closure. The report would focus on turning
movement changes to both the intersection of Homestead and De Anza Blvd and the new entrance on
Homestead. Staff recommended an amended air quality report because the traffic on Homestead, De
Anza & 280 has significantly, increased since 1989. Staff recommended an amended noise study because
the building types, their locations and minimum setback distances to the sm-rounding roadway have
changed. Staff suggests that this item not come back to ERC if the reports identify no significant impact
and that the mitigations identified by the respective experts be inte~ated into the project conditions of
approval, if the project is approved. Bert Viskovich moved for a Negative Declaration with the condition
that the environmental studies be completed prior to the Planning Commission meeting. Bob Cowan
seconded the motion.

The new 8 foot wider tnnk replacing the current redwood tank, will double the water
capacity. One of the environmental issues is the aesthetics. The proposed tank is in one of the
view sheds which has been identified in the RHS zoning district. The applicant has proposed to
do some grading to set the tank into the ground to offset the 8 foot width increase. The applicant
has also proposed to paint the steel tank a dark grin color, as well as landscaping the area. Staff
does not believe that the aesthetic effects will be significant. The last possible environmental
impact is geological. The applicant has provided a geologic study which stated that the closes
fault line is the Borequal which is a thousand feet away. Staff feels because of the distance and
the design standards of the tank, the fault should not cause impacts. The staffdocs not foresee
any environmental impact and is recommending a Negative Declaration. Bert Viskovich moved
for a Negative Declaration. Don Brown seconded the motion.

3. Application No. 8-Z-95, and 16-EA-95
Applicant: Cupertino City Center
Property Owner: Cupertino City Center ·
Location : East side of Torre Avenue between Stevens Creek Boulevard
and Rodriguos
ZONING: To allow low to medium residantial density
The current zoning for this area is Planned I~velopment Residential. The City Center
Conceptual Zoning Plan limited development on the triangle parcel. The Plan stated that the
triangle parcel had no development potential and must remain as an open space. This application
is to amend the City Center Conceptual Zoning Plan to allow low to medium density for
residential. The Staff feels the proposed zoning is consistent with the General Plan as well as the
Zoning Map. The staffdoes not foresee any enviroumantal impacts and is recommending a
Negative Declaration. Don Brown moved for a Negative Declaration. Bert Viskovich seconded
the motion.
