NEW BUSINESS 1. Application No: 10-U-89 (Mod.) and 19-EA-95 Applicant: P.G. & E. Property Owner: P.G. & E. Location: 10900 North Blaney Avenue USE PERMIT: Modification to install a soils recycle powerscreen. In the previous meeting the committee had requested the applicant to provide some alternate sites for the powerscreen. The applicant provided plans showing the unit can be approximately 300 feet from the property line along Homestead Road. The applicant feels this will minimize any impact's for the surrounding neighborhoods. A sound study was done by a P.G. & E. employee. The study showed the noise level was well below the standards for the General Plan. The staff is recommending a Negative Declaration. Bob Cowan moved for a Negative Declaration. Application No: 2 I-EA-95 Application: City of Cupertino Property Owner: Various Location: Various BUILDING CODE AMENDMENT: Modification of uniform code to allow above ground fuel tank in a BQ zone. The purpose of this application is to look at the building code ordinance to possibly allow above ground fuel tanks. The Staff feels this is a safe way to store these fuel tanks. If there is any leaks in the tank it is more easily detected. Staffis recommending a Negative Declaration. Steve Dowling moved for a Negative Declaration. Bob Cowan seconded the motion. Vote 3-0. 3. Application No. I-DA-95 and 20-EA-95 Applicant: Hewlett Packard. Property Owner: Hewlett Packard. Location : The Hewlett Packard site contains approximately 95 acres and is bounded by Homestead Road, Tantau Avenue, Pruneridge Avenue and Wolfe Road. DEVELOPMENT AGREEMENT: To permit Hewlett Packard or successor in interest to construct new buildings and develop a master site plan based upon the entitlements contained in the City of Cupertino General Plan. This is an agreement between the City and the applicant, wherein the applicant is locked into the General Plan the City has adopted for the site. If the project progresses into the next year the City Council can not change the rules for this development. These agreements are typically used in large scale developments which may take a long time to develop. The applicant does not currently have a Use Permit, so they are still required to go the Planning Commission and City Council for development approval. The Staffdoes not foresee any environmental impacts which have not been addressed by the 1993, General Plan EIR, and is recommending a Negative Declaration.
