AGENDA ITEM
q
AGENDA DATE September 20.2005
Consider a fee waiver request rrom the Cupertino Tournament of Bands in the amount of
$1090.00 to conduct their annual marching tournament on Saturday, October 8, 2005.
BACKGROUND
With the adoption of the 2004/05 budget, the City Council established a fee of$1090.00 for
special events. The fee was established and approved by Council to cover staff processing and
administrative costs associated with special events conducted in City right of way.
Attached is a communication requesting waiving of the fee rrom the vice president of the
Cupertino Tournament of Bands because they are a non-profit organization.
FISCAL IMPACT
Waiving of the fee will add $1090.00 in unrecovered costs to the General Fund for services
performed by City forces without charge.
ST AFF RECOMMENDATION
Staff recommends that the fee waiver not be granted solely because the Cupertino Tournament of
Bands is a non-profit organization. Many of the organizations that use City facilities are non-
profits, and Public Works has normally not engaged in the practice of waiving fees. In order to
apply the fees consistently, if a waiver is granted in this case, it would presumably have to be
granted in similar instances.
