Application No: l-GPA-93, and 6-F.~-93 Applicant: Diocese of San Jose Property Owner: Diocese of San Jose Location: Assessor Parcel Nnmbers 342-52-3,342-5-43, 56-59, 60 located south of I-$0, west of Foothill Boulevard and north of Rancho San Antonio County Park and Stevens Creek Boulevard. ENVIRONMENTAL DETERMINATION: Recommendation to re-circulate a portion of the General Plan Environmental Impact Report regard/nS traffic and the Harvey report resardin$ the red leF~ed frog. Page Minutes of ERC meeting January 12, 1995 Ciddy Wordell explained that although Saint Joseph Avenue is under appeal, the court has ruled it to remain open; this is a proposal recommending a traffic analysis be done for that possibility. The City Council will approve a scope of work. Once agreed upon then the work will be done. When it is published there will be a forty-five day review period, which leaves an estimate of June before the planning commission could hold a public hearing on the new information. There is a state law requiring re-circulation and the planning staff feels that this proposal falls under this law. Ms. Wordell read the law out loud for thc members present in thc meeting. The Initial Study indicated that the impacts are not going to be significant, but the study will show definitely whether or not, after which a final decision will be made. The city of Los Altos will be working with the city of Cupertino in the scope of work so that both cities will have input into the study. Ms. Wordell also proposed an amendment m the Notice of Preparation. The changes are brought about because the City Attorney wants Harvey's Study on the frog and new Irees information to be re-circulated with the traffic information. The Harvey study did not have any new information, but is more precautionary. Ms. Wordell then asked Bert Viskovich to explain the scope of the traffic study. Mr. Viskovich began by statin~ the existing traffic condition on Saint Joseph in the area of 280; where the court ruling is, there's an irrevocable offer of dedication to the city; with the assumption that city will make that area a public roadway. The council does have the right not to accept the offer once the road is opened. If so, then a private roadway through the Forum could act as a gateway for public thoroughfare. The alternatives that are going to be studied are, the connection with the seminary property to the public roadway and whether the mad will be public or private. If private than it acts similar to the Forum where only the Forum traffic could utilize the Saint Joseph's road. If the seminary becomes private then in essence it's unly'the two projects that may have an impact on Saint Joseph's Avenue. If this does become a public roadway a complete loop is created for both in going and out going traffic. The county park then could create a real impact on the Saint Joseph's roadway if a public connection was made. The study will evab~*t~ twelve of the project alternatives for both public and private odways. So, in essence there are twenty alternative views of the traffic situation. It is assumed that gates will go up at the Forum as soon as Saint Joseph's opens; if not then everyone 11 drive through the project. Don Brown asked about the Cristo Roy parcel area being impacted. Mr. Viskovich explained that if it were a public road then the Cristo Rey impact will then be dealt with. The base has to be projected because we can't predict how many cars will uso the and the impacts on Saint Joseph. The study will calculate if Saint Joseph's roadway is open, as well as calculate the Forum traffic, on Cristo Rey road, and Saint Joseph. Mr. Dean asked about the Forum's original access agreement on Saint Joseph. Mr. Viskovich explained that itwas originally agreed upon being a private roadway as it is today. Paul Roberts stated page -3- Minutes of ERC meeting January 12, 1995 if the roadway were private then it would alleviate the local residents using it as a scenic drive. Mr. Roberts suggested adding new alternatives to tho teuvironm~lteJ impact report. Specifically, the list of project alternatives on page 4, such as alternative "C" and "D". The traffic study provides the opportunity to study alternatives that were not looked at earlier. Ms. Wordell clarified that the information on the studies would be close enough to extrapolate from. Mr. Cowan explained the idea was to try to bracket a number of options so that the commission could decide which one was preferred. Then the planning staff could focus on that one and begin working. Mr. Roberts stated what was missing is the alternative that corresponds to the applicant's application as it applies to the seminary parcel of how many units would be located on the seminary parcel under the very low density residential modified haft acre slope density formula. Mr. Cowan explained that these alternatives would be covered again with the bracketed options issued with the council and as long as the general parameters arc met. Mr. Brown stated as long as you bracketed the data driven items everything is covered. Mr. Brown moved to recommend to re-circulate a portion of the general plan analysis to traffic as well as the Harvey report for the red f~og and tree information. Mr. Dean seconded the motion. Vote 6-0. 2. Application No: 3-Z-83(amended),l 0-U-94,(amended)34-EA.-94, and 29-EA-94 Applicant: City of Cupertino Property Owner: First Development Corporation Location: Stevens Creek Boulevard, between Stelling Road and the easterly city boundary. ENVIRONMENTAL DETERMINA~ON:. Negative Declaration Recommended Tom Robillard explained that City Council had just approved a project at tho comer of Tantau and Stevens Creek Boulevard, for forty affordable housing units and 4,000 square feet of commercial building. The city staff first thought that it would originally coincide with the Stevens Creek Boulevard specific plan, but the City needs to emend this plan, regarding building setback and heights on Stevens Creek Boulevard,because this particular project did not meet these guidelines. The project approved development plan includes a 35 feet front yard setback, a 36 feet building height, and a 20 foot rear yard setback. The existing Conceptual Plan requires a front yard set back orS0 feet, the set back ratio was 1.5 to 1 and the rear setback ratio of 4 to 1. Mr. Viksovich moved for a Negative Declaration, and Mr. Brown seconded the motion. Vote 6-0. page -4- Minutes of ERC meeting January 12, 1995 3. Application No: 13-U-94, and 35-EA-94 Applicant: Imwalle Stegner Property Owner: Union Oil Company of California Location: N.W. Comer of De Anza Boulevard and Bollinger Road ENVIRO~AL DETERMINATION: Negative Declaration Recommended Michele Bjurman explained this is a proposed six thousan.d square foot ~,~neral . commercial building at the North West comer of De AnT~ Boulevard and Bollinger Road. The previous use was a Union gas station. The proposal is for either a multi-tenant or a single=tenant _ general commercial user. Two issues were analyzed, the f~st being traffic and the second was h=7~ntous materials. According to our traffic en~neer no traffic analysis is required because the project is not estima~i to change the levels of service at the intersection. As far as hRT*rdous m_n_t_~ri_'als, Union Oil did have a leaky ~ tank, and there was soil contamination, but the staff'has received a release letter from Santa Clara Water Di~hlct who is the oveiseer of HRT*~dous Materials. The soil contamination has been cleared of any further investigation as the site is clean. Bert Viskovich motioned for a Negative Declaration and Paul Roberts seconded the motion.
