The minutes of March 24, 1994 were approved as submitted.
CONTINUED ITEM
1. Application No(s): 2-TM-94 and 6 -EA-94
Applicant: Emily Cben
Property Owner: Emily Chert, Frank Chang and Jennifer Chang
Location: 19340 Phil Lane
TENTATIVE MAP: To subdivide a 1.08 acre parcel into 5 lots.
This item was continued from the March 10 meeting so that an arborist report could be
submitted. This has been done. The Santa Clara Valley Water District responded that
the well on the property must be registered or abandoned. The pond has been dry for
some time so there will be no further action required. The historical structure should be
retained on the site. The home will be moved to.the end of the cul de sac, rehabed and
sold. It should be added to our General Plan historical list. The arborist identified 2
significant trees on the parcel. One of the significant trees will need to be removed to
build on lot 1. Ms. Chen is asking for the removal of 19 trees. Michele recommends
requiring a certified arborist to review the final construction plans and that it be
consistent with the arborists recommendation for long term health of existing trees and
that the arborist be present during grading and construction on lots 1, 4 and 5 and when
fencing is put in place.

Emily Chen spoke that she has been working closely with Michele and is trying her best
to maintain all the trees. Don suggested setbacks be changed to save trees on pertinent
lots.
Nancy Bumett spoke on behalf of the Fairgrove Homeowners Association on this parcel.
Their concerns are privacy, trees, sunlight obstruction and wildlife protection. Also
when the barn is demolished and the house moved it may cause flight of termites and
rats. Will there be any danger to their homes when these tall trees are felled? Mr.
Schwartz, another neighbor, spoke of his concern for privacy. Marilyn Phillips spoke
about the birds that may be affected by the removal of trees. Ms. Chen will meet with
the neighbors regarding the ERC issues.
Bob Cowan brought up the possibility ofrezoning to PD which would provide design
control for each house. This would work to preserve trees without worrying about
setbacks. There would be individual review of each home. Planning Commission
would have to make this decision.
Bert moved for a negativ~ declaration with comments to maximize tree preservation and
pest control during demolition. The historical building will be relocated as
recommended. Existing trees and shrubs will be retained as much as possible for beauty
and screening. Don seconded the motion and the vote was 5-0 in favor.
NEW BUSINESS
2. Application No(s): 5-U-94 and 11-EA-94
Applicant: Landmark Development
Property Owner: Landmark Properties
Location: Gardenside and Rainbow
USE PERMIT to construct 6 townhomes on an 11,761 sq. ft. parcel in a Planned
Development residential zoning district.
This is the third phase of Gardenside. Concerns are noise from Highway 85 and
parking. A sound study has been done by Landmark and presented to Michele.
She will come up with her own decision on the sound based on this existing data.
Each unit will have 2 parking spaces plus 2 guest spaces. This leaves the development
short by I0 parking spaces but there will be additional parking on Rainbow Drive.
Parking is not an environmental issue. Don moved for a negative declaration, Bert
seconded. Vote approved 5-0.

Location: Ci.tywide
Amending various sections of Title 17, Signs, of the Cupertino Municipal Code,
including regulations for political signs and sign sizes.
Don moved for a negative declaration, Bert seconded. Vote 5-0 in favor.
4. Application No(s): 81,156 and 9-EA-94
Applicant: City of Cupertino
Location: Citywide
Amending various sections of Chapter 19.40, Residential Hillside Zones, of the
Cupertino Municipal Code, including regulations for fiat yard area and second story off-
sets.
Bert moved for a negative declaration, Paul seconded. Vote 5-0 in favor.
5. Application No(s): 1-Z-94 and 2-EA-94
Applicant: City of Cupertino
Location: Citywide
REZONING various hillside properties encompassing 185 net acres in the Regnart
Canyon Area.
Bob introduced Jeanette, an intern from San Jose State, who reviewed this application.
This is phase I for hillside rezoning. A, A-1 and R-I designations would be changed to
open space and RHS to Iow density residential. This is consistent with the hillside
protection policy allowing no further subdivisions. Rezoning would be mainly R-I to
RI-IS lot sizes would remain the same. Bert moved for a negative declaration, Don
seconded. All in favor 5-0.

Amending Title 19, Zoning and the Cupertino Municipal Code, including prescriptive
