The term "Oiwner-Builder" can mean three different things: "Owner as Worker", "Owner as Contractor" or "Owner as Employer" Understand each has Benefits or Risk, and it is possible to combine them! Hiring a California Licensed Contractor means you do not personally perform any of the construction work, the pen -nit is not taken out in your name, you are not personally responsible for the construction and you are not an Owner -Builder. Instead, you become a "Customer" and California law provides you the benefit of protection from poor workmanship, failure to finish the job and financial risk due to worker injury. Benefit/Risk: Highest Benefits and the Least amount of Risk Owner -as -Worker is a type of Owner -Builder where you personally perform the construction work, the permit is taken out in your name and you are personally responsible for the construction management, knowledge, workmanship, and completion of the job. You benefit by not paying others to perform this work for you and your risk depends on your own ability to complete the job successfully. Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant, Scott Zazueta, representing Satish and Alpana Prabhu, is requesting approval to convert approximately 769 square feet of existing high-volume attic space to habitable living space, as well as add a 325 square foot addition to the rear of the existing residence. The existing high-volume single -story homes on Miner, Parlett, and Virginia Swan Place were originally approved by the City in 1976 as part of a planned development rezoning (Z-1976- 09), tentative map (TM -1976-10), and use permit (U-1976-06). There have been a few applications over the years in this planned development neighborhood to convert high volume attic space into habitable space. Floor Area The project proposes to infill an existing attic area to accommodate additional habitable space for a new bedroom and game room. The height and bulk of the residence will remain the same. Several exterior window modifications are proposed, including new windows at the rear of the residence and new skylights on either side of the existing attic roof. The applicant has obtained privacy planting waivers from the affected neighboring property owners to the north, south, and east. In addition, the applicant proposes to plant a new 24 -inch privacy DIR-2012-42 10204 Miner Place Page 2 screening tree in the rear yard. The final privacy planting details will be reviewed by staff at the building permit stage. The site is located in a Planned Development zone with R1 intent. Since 2005, first floor interior areas higher than 16 feet (measured from finish floor to top of roof rafters, regardless whether there is a ceiling between) are counted twice towards floor area in the R1 zoning district. The converted attic area is not double -counted given that the property is in a Planned Development zoning district, the overall height and bulk is not being increased, and the homes in this area were built prior to this particular regulation taking effect. The total proposed floor area ratio with the 325 square foot first floor addition is 45 percent of the net lot area. The site and elevation plans were circulated to the adjacent property owners for a two-week review period. No comments were received by the City. This neighborhood does not have a homeowner's association. ACTION The Director of Community Development deems the modification minor and approves the project with the following conditions of approval: 1.
