PROTEST LETTERAugust 23, 1.974 City of Cupertino 10300 Torres Avenue Cupertino, California 95014 Attention: Mr. John Busto Dear Mr. Busto: For the past several years a large Christmas tree lot has been set up on the vacant lot located between Sunnyvale-saratoga Road and Terry Way. Presumably a permit will be issued for the same purpose each year until a permanent structure is erected there. The undersigned residents of Cupertino hereby lodge a formal protest against the issuance of such a permit this year and every year unless certain conditions are corrected. These conditions, listed, below, directly affect the health and safety of the undersigned residents and their families, in addition to presenting a most unsightly appearance. 1. The temporary occupant has piled his trash and refuse (i.e., tin cans, soft drink bottles, papers, boxes, and even extra corrugated roofing material) against his temporary wire fence adjacent to Terry Way. s Suggested Remedy: A temporary plywood fence would hide this unsightly nuisance. 2. When the property was finally vacated and cleared, deep post -holes were left unfilled, a hazardous circumstance in which anyone could step in one of the holes and break a leg, especially after dark. m Suggested Remedy: Required that the occupant fill the holes when the lot is vacated. 3. The temporary occupant has buried his garbage in a very shallow pit. Last year the kids and dogs had much of it dug up within a few days. This obviously constitutes a health hazard. • Suggested Remedy: Require that the occupant make provision for regular municipal or commercial removal of garbage and trash. Large trucks serving the temporary occupant have used Terry Way to enter and leave the lot, creating a noise nuisance for nearby residents and a hazard for pedestrians. • Suggested Remedy: Require that such trucks enter and leave the lot via Sunnyvale -Saratoga Road, the same as is done by the ad- joining supermarket and other merchants. We respectfully request that you give this matter your immediate attention. Your cooperation and support in correcting the above conditions will be greatly appreciated.
