unanimously that Councilwoman Rogers be appointed representative to
the County Parrtr211Sit Coordinating Council with Jlarbara Brown to
serve as alternate.

By consensus, staff was requested to prepare an ordinance similar ,0
the County ordinance regarding gasoline price signs.

It was moved by Counc. Sparks, seconded by Counc. Rogers aod passed
unanimously that the sum of $5,000 be appropriated for the July 4,
1979 fireworks display.

By consensus, Council requested that a citizens committee be formed,
with the Parks and Recreation Commission suggesting names, to help
provide support for the two park measures scheduled to appear on the
ballot in the November election.

At the request of Director of Parks and Recreation Butler, Council clari-
fied their action regarding the Parrish House. Council would consider use Parri~h House
of the house by another group since the Cupertino Historical Society is no
longer interested. However, it would be necessary to move the house from
its present location in Memorial Park. Staff will continue to work with
the Historical Society regarding 10~ating facilities.

imously to oppose the manda~ on cities in conjunction with amendments
to the budget of the State Department of Housing and Community Develop-
ment. Council requested that ~luded in transmittal of opposition should
be the statement that the CI~ gf Cupertino is currently following many
of the proposed mandates.
It was moved by Counc. Rogers. seconded by Counc. Sparks and passed
unanimously to support SB 612 and ask for clarification regarding page 2,
paragraph 2, stating that anøesation may be made "when the consent of the
legislative body of such other city is first obtained"; support sa 180.
At 7:17 p.m., the me~ting was adjourned to an Executive Session. At 7:25

Staff was directed to inform pro?erty owners and residents or the area
regarding the consideration of a resolution to initiate annexation pro-
cedures for this area which will be considered at the June 18 City Council
meeting.
23. Discussion of Amelia Court access to Varian Park.
Director of Public Works Viskovich reviewed future plans for Varian Park
and showed the new activity area plan which was" result of community
meetings.
The Mayor addressed those present regarding the type of input being sought
by the City.
Diane Koenitzcr, 10050 Phar Lap Drive, submitted a petition requesting
access to Varian Park.
Art Robertson, 21979 Oakde1l Place, requested that the City go back
to the original plan regarding accesS.
Dr. Bayard, 10120 Crescent Road, spoke in behalf of a group of residents
objecting to vehicle access through Amelia Court. The concern is that
once Amelia Court is open a future r~unci1 may wish to connect to it
Ainsworth. He stated that according to his calculation the cost of Qpening
Amelia Court would be approximately $500,000. He inquired as to the source
for these funds.
Mrs. Beulah Graves, 10170 Amelia Court, was concerned about the d1.sruption
of the environment as well as a safety problem.
Mr. Virgil Bourassa, 10076 Crescent Road, also expressed concerns re-
garding safety problems. He stated that they already have some
commuter traffic. However, he does favor pedestrian access.
George Fernandes, 22104 Orchard Court, re-emphasized the fa~t that Varian
Park was meant to be a neighborhood park and he too was concern~d re-
garding safety and potential traffic accidents.
Dorothy Varian, 10114 Crescent Road, submitted a letter from Glen Shields
to Council which expressed concern regarding traffic, excess number of
cars parked near his home and probable litter.
Ms. Varian was concerned regarding noisy cars, vandalism, fires that
have occurred in the area and mot0rcycles. She also questioned her
liability for any accidents that may occur on property she leases in the
area. She requested that a traffic study be done and an EIR prepared
prior to any opening of Amelia Court.
R. D. Koenitzer, 10060 Phar Lap Drive, stated that Oakdell has not asked
that Amelia Court be connected with Ainsworth. The residents just want
safe pedestrIan and vehicle access to their park with a 4-6 ~ar parking
lot.

Robert Dexter, 10299 Ainsworth Drive, pointed out that when people leave
the park and turn l.ft, there was a blind spot that could be dangeroua.
Wm. Staiger, 10317 Vista Knoll, felt that any park 1ß an attractive
nuisance. If there would only be a few parking places, cars would park
in front of homes in the area. He stated he felt the park does nut need

Brenda Bourassa. 10076 Crescent Road, addressed Council stating she felt

Henry Fasterly, 22321 Cupertino Road, stated that the proposed access
::.rough Amelia Court conflicts with commitments made when building Sunny-
view Manor.
Elsie Holwerda, Sunnyview West, stated that traffic is very hazardous
for seniors walking to the park using the present access available.
L. Dean McCu~, 10448 Vista Knoll, expressed displeasure regarding the
traffic on Foothill Boulevard and stated that he had informed the City of
his complaint previously.
Jean Bourassa, 10076 Crescent Road, requested tbat Council not open
Amelia Court.

Varian Park as parking lots would merely encourage more car traffic.

unanimously that legal pedestrian and bik~ access be provided along Ameli
Cuurt prior to completion of the park.

ufi3nimously to deny vehicle access through Amelia Court at this time.

neighborhood access and expressed concern that the proposed abandonment
would increase traffic on Orange.
Gail Hugger, 10163 Byrne Avenue, asked for a vote of those present who
are in favor of the proposed abandonment.
James Hugger, 10163 Byrne Avenue, stated that development was already
going on in that area which leads him to believe that the abandonment
has already been decided.

of an extended program for closures which Monta Vista people opposed.

City Manager Quinlan pointed out that after occupation of the new buildin

29. Report regarding excessive number of operable parked cars.
City Attorney Adams expressed the desire to discuss this matter further
with the City Manager, the Code Enforcement Office and Lt. Thomas of the
Santa Clara County Sheriff's Office.
Hr. R. Said, 2014~, Appletree Lane, addressed Council stating that the ca
parked in the area .ire in poor repair. He f e1 t the leaking oil was a
fire hazard. The City Mar.aóer, the City Attorney, Mr. Salci and other
staff members will meet in the City Manager's office, Thursday, June 7 at
9:00 a.m. to discuss the matter and will then report back to Council.

Vista's access to MCClellan Road.
Hr. James Klug, 22467 Santa Paula Avenue, expressed his desire to impress
Council that people in the Sa"ta Paula area are concerned regarding the
plan line for McClellan Roa~ and the time frame involved in completion
of that plan line. Mayor ~eyers informed him that the General Plan which
will have a public hearing July 19, 1979 will set the policy for traffic
circulation. The Director of Planning and Development stated that the
General Plan will say that further in depth neighborhood studies are needed.
Debbie Hunvig who reF-ides near the corner of Santa Paula and McClellan
expressed concern regarding commuter traffic.
John Wallach, Santa Paula Avenue, requested to be not1fieJ when this item
reappears on an a~enda.
Staff will present plan line information for McClellan Road to the City
Council at eitoer the first meeting in July or the first meeting in August.
NEW BUSINESS
33. Report on bid opening, Corporation Yard Driveway Installation, Project
79-19, and award of contract.
It was moved by Counc. Jackson. seconded by Counc. Sparks and passed unan-
imously to award the project to Piazza Construction in the amount of
$19,395 based on the lowest bid and to set aside a contingency of $1,605.
34. Protest of posting of $1.5,50 for asphalt overlay on Pacifica Drive.

The Cupertino Scene, Inc. board adjourned at 11: 55 p.m. and rec:O'4Yened
as the Cupertino City Council.
It was moved by Counc. Jackson, seconded by Counc. Rogers and pu.ed
unanimoù81y to appropriate an additional $2,000 for the July issue of
the Cupertino Scene to be mailed to residents in the boundary reorganiza-
tion area.
It was moved by Counc. Jackson, seconded by Connc. Rogers and passed
unanimously to adopt Resolutions 5024 and 5025.
Resolution No. 5024: "A Resolution of the City Council of the City of
Cupertino Exercising Option to Purchase Lot 61 of Real Property from
Herman Christeneen, Jr., and Raymond P. Christer>sen; Northwest Corner of
Stelling Road and A1 ves Drive."
Resolution No. 5025: "A Resolution of the City Council of the City of
Cupertino Accepting a Grant Deed of Real Property from Herman Christensen,
Jr., and Raymond P. Christensen; Northwest Corner of Stelling Road and
Alves Drive."
The net appropriation including necessary street repairs will be given
to the Council at their meeting of June 18.
