Mbyor Meyers called the meeting to order at 6:37 p.m. in the Conference
Room of City Hall.

By consensus, Council approved the design of the City medallion. The
inscription "Incorporated 1955" will be deleted and the engraving

b. By consensus, Barbara Rogers was nominated to serve on the Paratransi Paratransit
Coordinating Committee for IGC and Barbara Brown will be suggested committee
as an alternate.
2. Report pertaining to communication received from Barbara McGuigan re-
garding Lazaneo Drive and Director of Public Works.
By consensus, the Director of Public Works was authorized to transmit a
letter to Barbara HcGuigan stating that the crossing guard referred to in
her letter has been budgeted for 1979-1980. The crosswalk and shculder
striping she has suggested will not ce considered until such time as
Lazaneo is opened to through traffic.
Assis~ant City Attorney Kilian informed Council that the Order of Immediat
Possession in the matter of Regnart Road had beer. received. He also in-
formed Council that July 30 has been set as the trial date in the Burger
King matter.
Council directed the Director of Public Works to contact Rev. Rudd of
Sun</view Haner reKarding his concerns of Cupertino Road and Stevens Creek
Boulevard.

By consensus, staff was directed to examine aa appropriate the use of
gasohol for City vehicles.
Council directed staff to investiage the poaaibilir.y of consolidating our
subsidized taxi program with that of Sunnyvale.
CITY CLERK'S NOTE: Director of Parks and Recreation Butler arrived at
7:20 p.m.
3. Report regarding concessions in City parks.
It was moved by Counc. Sparks, seconded by Counc. Jackson and paased unan-
imously to approve installation of electricity and wa'er in the ..al1
storage building at Memorial Park and that this facility be operated
by staff members for special events, certain athletic tournaments and on
Sundays. Costs and revenues will ~e charged and deposited to a specialist
account. Any proceeå~ will be upel for other recreational program suppliea.
Service groups, at the discretion of the Director of Parks and Recreation,
shall be allowed to have tempor3ry booths at Memorial Park for special
events to assist in raising funds for community projects.
At 7:30 the meeting was adjourned and reconvened in the Council Chamber.

31. Mr. Fred Kurtz regarding abatement notices for parked vehicles.
Assistant City Attorney Kilian pointed out that this appeal constituted
a quasi judicial hearing. A copy of the abatement notices sent to hr.
Kurtz was submitted for the record. Code Enforcement Officer Ross Smith
informed Council that he had been to ¡0150 Apple Tree Lane in response
co complaints regarding inoperable vehicles. He had sent a letter to
Hr. Kurtz suggesting the vehicles be stored in the rear yard. He stated
that for the last two or three years, there had been three cars in the
driveway. H£, submitted two photographs showing three cars in the driveway.

Cherry Tree Lane informed Council that there were several cars kept in
the areA. Ms. Esther Fields, 22437 St. Andrews, came forward to speak,
but 8ß she did not live in the area, Assi:Jtant City Attorney Jtllián
informed her that in this type of hearing only testimony of personal
knowledge was acceptable.

Mr. Kurtz submitted a newspaper picture and article regardl~ the vehicles
parked in front of his house. He asked how it was decided that certain
vehicles were inoperable. Code Enforcement Office Ross Smith ,tated that
he and a Deputy had observed parts apparently missing from two vehicles
and no battery in a third. They also noted other safety factor, 1. e.
broken lights. Mr. Kurtz stated that Mr. Smith's testimony was in error
and that the vehicles were complete. He st&ted that the vehicle 1icenae
number 159EUJ does have some parts missing but he is willing to put it in
running condition. He informed Council that he had driven one of these
vehicles to the Council meeting. He presently does have some parts and
tools in his garage. He stated that he had come prepared only to answer
~ouncil regarding the abatement not.ices and not answer questions regarding
his activities being a pub1.ic nuisance. He r2luested that this be con-
tinued to another time. He requested that action against the three
vehicles be dismissed.
Assistant City Attorney Kilian agreed that the general nuisance issue
should be continued as Mr. Kurtz was not prepared and stated that all
evidence produced to this time would be considered.

public hearing for August 6 to coaø1der closure of Mira Vista at McCle1la
Road.
Gordon Neal, 10490 S. Foothill Boal_ard, addressed Council reiárding
closing off the most southerly ead of Mira Vista's acces~ to McClellan
Road, establishing existing roa~ ~s the maximum road widths, exclusiv of
road improvement dedications and deeding back all pertinent road improve-
ment dedicated lands to their rightful owners.
Bill Stevenson, 22350 Santa Paula, questioned the methodology used to
gather the traffic count on which ~ staff report was based.
Deborah Jungvig, 22490 Santa Paula, questioned the trafUc data used in
the General Plan as compared with the traffic dAta in the staff report.
Jerry Grogan, 22334 Santa Paula, iDqaired as to the dates of the count.
By consensus, Council revised the .ution setting the public h~ring date
for September 4, 1979. Additional data requested was regarding potential
accidents at a possible hairpin.

The City Manager, the Director of Parks and Recreation, Mayor Meyers
and Counc. Sparks will meet July 9, 1979, 7:30 p.m., in the Conference
Room, to discuss the arguments to be submitted for the two park land
measures.

By consensus, staff was directed toput together a package of information
and pictures regarding the history of Cupertino to be sent for display to
CJpertino, Italy. This will also be referred to the Cupertino Historical
Society and to the History Center. The Director of Parks and Recreation
will also inform Copertino that the Cupertino Art Club will have an exhiLit
the same time as their art and cultural display.
