The meeting was called to order by Mayor Meyers at 7:35 p.m. in the
Council Chamber of City Hall.

36. Review of Reøolution 79-86 of the Santa Clara Valley Water District
urging inclusion of flood control works in redevelopment plans and
proj ects.
It was moved by Counc. Sparks, seconded by Counc. Jackson and passed
unanimously to accept for filing a resolution from the Santa Clara Vall
Water District.
WRITTEN CO~ICATIONS
38. Correspond~nce regarding industrial coal burning in the Cupertino
area.
Correspondence regarding Industrial Coal Burning in the Cupertino area
was reviewed and accepted. This matter will be discussed at a future
mecting.

the American Civil Liberties Union. She expressed the organization's
concerns regarding violation of rights to due process.
It was moved by Counc. Sparks, seconded by Counc. O'Keefe and passed
unanimously to read Ordinance No. 961 by title only and the ~ayor's
reading to constitute the second reading.

unanimously to enact Ordinance No. 961.
42. Urgency Ordinance No. 964: "An Ordinance of the City of Cupertino
Providing for Special Regulations Regarding Use Permits for Certain
Lands Annexed to the City of Cupertino and Detached from the City
of San Jose Effective July I, 1979, and Declaring the Urgency Thereof."
It was moved by Counc. Rogers, seconded by Counc. Jackson and passed
unanimously to read Ordinance No. 964 by title only.

43. First reading of Ordinance No. 965: "An Ordinance of the City Council

It was moved by Counc. Jackson, seconded by Counc. Sps"ks and puaed
unanimously to read Ordinance No. 965 by title only and the Mayor'e
reading to constitute the first reading.
STAFF REPORTS
City Manager's Report was reviewed by Council.
City Clerk's Report
It was moved by Counc. Jackson, seconded by Counc. Rogers and passed
unanimously to authorize Mayor Meyers to transmit a letter to the
Governor requesting completion of a Master Plan on property utilization
and a total program for the Developmentally Disabled prior to considera-
tion of declaring Agnews as State Surplus Property.
The Mayor will transmit the City's appreciation to BAS for their agree-
ment to erect a sound wall b~twcen Greenieaf Drive and Bandley Drive.
It was moved by Counc. O'Keefe, seconded by Counc. Sparks and passed
unanimously that if the old Senior Center building has not been moved by
November 26 or 27, the Director of Public Works may have it demolished.
The City will donate up to $2,500 to assist someone to have it relocated.
Anything that might be usable in the newly a~quired building in the
Honta Vista site will be saved.
It was moved by Counc. Sparks, second~d by Counc. Jackson snd passed
unanimously to approve waiver of Business License fee for the Northwest
Valley y's Men's Club ChristmAs Tree Sale.
It was moved by Counc. Sparks, seconded by Counc. Jackson and psssed
unanimously to adopt Resolution No. 5155, "A Resolution of the City
Council of the City of Cupertino Regarding Annexation of Property within
the City's Urban Service Area Where City Water Service Exists."
Acting City Attorney Kilian left the meeting at 8:50 p.m.

It was moved by Counc. Sparks, seconded by Counc. Rogers and passed S.D.A.F.
unanimously to reaffirm the division between fire districts and library
as proposed in concept and withheld any further position regarding
S.D.A.F. until staff is able to provide them with additional information.
Counc. O'Keefe moved that all new construc~ion be plumbed for solar
energy for the heating of hot water. The motion died for lack of a
second.
It was moved by Counc. ~parka seconded by Counc. Jackson and passed wit
Counc. O'Keefe dissenti<g that staff draft an ordinance for Council re-
view that would require new construction (including commercial if
feasible) have the building plumbed and equipment installed to provide
solar energy for the heating of water.

Council&ember O'Keefe went on record in support of the concept of solar
water heating but felt the building's OWDer should install the panp.1s of
his/her r.hoice.
It was moved by Counc. O'Keefe, seconded by Counc. Jackson and passed
unanimously that in all new construction, hot water heaters and storage
units be required to have jackets and that hot water pipes be wrapped.
Counc. O'Keefe moved that upon transfer or sale of buildings, jackets be
required on hot water heaters. The motion died for lack of a second.
It was m~ved by Counc. Jackson, seconded by Counc. Rogers and passed
unanimously that staff submit a report to Council regarding a prcposed
program on energy audits. The report is to include a cost benefit ratio.
It was moved by Counc. O'Keefe, second~ by Counc. Sp6rks and passed
unanimously that staff also submit a list evaluating suggested changes,
particularly (1) orientation of buildings to utilize passive solar concepts,
and (2) overhang of buildings.
It was moved by Counc. Jackson, seconded by Counc. Sparks and passed
unanimously that staff inves~igate the possibility of an ordinance pro-
hibiting gas heaters in future swimming pools. They als~ requested the
report include heating via natural gas, fossil f,.el and solar energy.
It was moved by Counc. Jackson, seconded by Counc. Sparks snd passed
with Counc. O'Keefe dissenting that staff investigate and evaluete the
possibility of making available to the public a packet of energy information.
It was moved by Counc. Rogers, seconded by Counc. Sparks and passed
unanimously to give support to the EIS, West Valley Transportstion Corridor
and particularly to the protection of right of way. The Mayor will make
a presentation at the November 29 public hearing. The public, via the
Cupertino Scene, will he asked for input.
At 9:50 p.m., the me2ting was adjourned to December 3, 1979.
