ROLL CALL Counc. Present: Jack~on, O'Keefe, Rogers, Sparks, Mayor Meyers Staff Present: Director of Public Works Viskovich Director of Plannins and Development Sisk City Clerk Cornelius City Attorney Kilian 1. Discussion on possible election for sp~cial tax imposed on new de- velopment for road and traffic related improvements. (a) "An Ordinance of the City of Cupertino Relating to the Appli- cation of an Interim Study Zon~ Orðinan~e Prohibiting Building or Development within the City and Providing for Exem~tions and Removal from Said Zone and Declaring the Urgency Thereof, to Take Effect Immediately." (b) "A Resolution of the City Council of the City of Cupertino Establishing Deposits Reflecting the Estimated Cost of Roadway and Other Traffic Improvements to be Paid by Applicants for Proposed New Land Developments Which are Remove~ from the Interim Study Zone." Director of Public WorksViskovich and Director of Planning and Developmen Sisk reviewed the proposed ordinance and resolution and pointed out the undeveloped areas that would be eligible for fees within the City of Cuperti!10. It was stated that a¡>plications already processed or "in the pipeline" would be exempted from the proposed ordinance. The following persons spoke in opposition to the ordinance as proposed: Jason Chartier, 21060 Homestead Road; Mr. Speno, Executive Vice President of the Building Industry Association of Santa Clara County; G. D. Gibson, Palo Alto, representative of Koll Company; Barry Scott, Cupertino; Dirk Reed, Hathaway Construction, Santa Clara; Kathy Sprinkles, representing the Cali 'aMily; Nancy Binneweg-:lark, Cupertino; Walter I<ard, General Manager or Vallco; Dr. Joseph Brown, Cupertino; Arthur Rauser, 21065 Rain bow Drive; Jim Walker, Regnart Canyon; Mark Mariani; AI Chappell; and Richard Childress. Concerns expressed were lack of opportunity for input from the public, the opinion that the ordinance is discriminatory, how the levy would be determined, lack of recognition for contributions already being made, insufficient research done to develop alternatives and City funds b~ing spent to improve a stat2 highway.
