City Manager's Report
Jobs/Housing Issues - By consensus, Council requested that Plann1ng staff
prepare a report showing what has occurred in Cupertino to help alleviate
the housing/job imbalance in the Santa Clara Valley. A letter will be
sent to the Industry and Housing Management Taok Force regarding this
issue.
Air Quality Planning Lead Agency for Bay Area - It was moved by Counc.
Jackson, seconded by Counc. Rogers and passed with Counc. O'Keefe dis-
senting to adopt Resolution No. 5250, "A Resolution of the City Council
of the City of Cupertino Regarding Air Quality Planning Re-Designation."
Annexation Under MORGA - It was moved by Counc. Rogers, seconded by Counc.
Jackson and passed unanimously for staff to prepare a letter for the
Mayor's signature asking for clarification of the Board of Supervisors'
position on requirements for annexation under MORGA.
Agins vs. City of Tiburon - Staff will contact the League of California
Cities for more information regarding the City of Tiburon's request
for financial assistance in the appeal of Agius vs. City of Tiburon
case. A report will be brought back to Cou~ci] at their March 17 meeting.

Barbara Humphries, an adjoining property owner, stated her concerns as to
whether or not the parcel was large enough for two homes.
Jim Brown, Lot 21, wished to see the native trees along the creek preserved.
Jeff Brown, Lot 21, also questioned how two houses could be fit in the
area and requested that the creek be kept as is.
Council recommended that adjoining property owners meet with Mr. Childress
to work out areas of concern.

use permit. Section 5.21 will allow for flexibility in the orientation!
definition of front y~rd if Planning Commission finds other labeling
more reasonable. New permits issued prior to the effective date of the
new ordinance would come under the ordinance presently in effect.

Mrs. Yvette Lasserre reviewed her plans for the proposed addition to her
home.
Mr. Dick Childress pointed out that he believed the denial of her applica-
tion shows lack of flexibility in the City's regulations.
Alf Modine stated that if the neighbors do not object to this addition, he
felt the Council should grant the variance.
Others speaking in favor of granting a variance were John P1ungy, 1182
Crestline Drive; and George Davis, 10620 Merriman Road.
It was moved by Counc. Jackson, seconded by Counc. Rogers and passed
unanimously to close the public hearing.
Because of the minimUDI difference in side yard setback which would t'eBult
from this addition and the financial hardship that would occur should this
variance not be granted, it was moved by Ccunc. Rogers, seconded by Counc.
O'Keefe and passed with Counc. Jackson dissenting to approve the variance
with the condition that neighbors along the side yard submit their approval
in writing. Resolution No. 5237 was adopted.

MINUTES OF THL MARCH 3, 1980 CITY COUNCIL MEETING
35. Report regarding concerns expressed by a residen'; of the Inspiration
Heights area.
It was moved by Counc. Jackson, seconded by Counc. Rogers and passed
unanimously to request that staff prepare a tentative ordinance restricting
certain developments from occurring on the hillside during the winter
months. Exceptions would be developed to allow some construction to
occur under strict guidelines. This tentative ordinance will be pre-
sented to the Planning Commission and then Council.
36. Resolution No. 5243: "A Resolution of the City Council of the City
of Cupertino Authorizing Execution of Agreement between the City of
Cupertino and Mohle, Perry & Associates for Traffic Engineering
Consulting Services, Stevens Creek Boulevard."
It was moved by Counc. Jackson, seconded by Counc. Rogers and passed
unanimously to adopt Resolution No. 5243.
WRITTEN COMMUNICATIONS
37. Request from Gardenview Terrace for waiver of fees for Below Market
Rate units, Tract 6767.
It was moved by Counc. Jackson, seconded by Counc. Rogers and passed
with Counc. O'Keefe dissenting to confirm the City's policy regarding
waiver of certain fees for Below Market Rate units and to grant a waiver
of these fees to Gardenview Terrace on their four BMR units.

38. Second reading of Ordinance No. 982: "An Ordinance of the City
of Cupertino Amending Section 1 of Ordinance No. 2 by Rezoning
and Prezoning Approximately 138.8 Acres from Various City and County
Zoning Districts to Zoning Districts \~ich are Consistent with
the City of Cupertino's General Plan; Bounded by Foothill Boule-
vard, Alcalde Road and the Westerly and Southerly Boundaries of
Inspiration Heights Subdivision and Including Properties Served
by Miramonte and Ricardo Roads."

Spring Trash Pickup - By conaensus, Council agreed that empnasis for the
spring trash pickup will be placed on comp1iance to the rules, which will
be publicized. Los Altos Garbage Co. will be requested to leave a flier
on any refuse not picked up. The flier will state why pickup was not
made.
Request of Cupertino Jaycees for Waiver of Business License Fees in Re-
gard to "Big Bunny Run" - It was moved by Counc. Jackson, seconded by
Counc. Rogers and passed unanimously by those present to approve waiver
of business license fee for the Cupertino Jaycees "Big B'mny Run" on
Saturday, April 5, 1980.
