Distribution of Special District Augmentation Funds - It was moved by
Counc. Sparks, seconded by Counc. Plungy and pasced unanimously to go
on record as opposing the San Jose recommendation for distribution of
special district augmentation funds.
By consensus, Council approved the idea of a committee consisting of city
attorneys and the County Counsel being formed to prepare a model ordinance
for regulating fireworks sales.

It was moved by Counc. O'Keefe, seconded by Counc. Rogers and passed unan-
imously to appoint Counc. Sparks as representative to the North Santa Clar
County Municipal Solid Waste Management Program. It was moved by Counc.
Sparks, seconded by Counc. Plungy and passed unanimously to appoint Counc.
O'Keefe as alternate to this committee.
Association of Bay Area Governments - It was moved by Counc. Sparks, sec-
onded by Counc. Plungy and passed unanimously to appoint Counc. Rogers
with Counc. Gatto as alternate.
Traffic Reduction Subcommittee - It was moved by Counc. Sparks, seconded
by Counc. Gatto and passed unanimously to appoint Counc. O'Keefe with

By consensus, Council voted to interview applicants for commission and
committee openings at 9:00 a.m., Saturday, May 3, in the City Hall Con-
ference Room.
City Clerk's Note: City Attorney Kilian arrived at 7:15 p.m.
It was moved by Counc Sparks seconded by Counc. Gatto and passed unan-
imously to adopt Resolutions No. 5276 and 5277 annexing areas designated
"Foothill 80-1" and "San Juan 79-S".
3. "Living Within Our Limits".
By consensus, Council continued ''Living Within Our Limits" to the adjourned
meeting of April 28, 1980.
4. Status report on Community Development Block Grant Program.
It was moved by Counc. Sparks, seconded by Counc. Plungy and passed
unanimously to adopt Resolution No. 5278 authorizing the Mayor to execute
an agreement with Lommunity housing developers with the portion of the
agreement pertaining to monetary advances amended. Council also approved
the Housing Assistance Plan.

26. Mr. Merritt Sher regarding interpretation of use permit relating to
trip count conditions for Orchard Valley Marketplace.
It was moved by Counc. Sparks and seconded by Counc. O'Keefe to remove the
proposed Baskin-Robbins store from the trip constraints. Counc. Sparks
withdrew his motion.
It was moved by Counc. Sparks that the applicant hire a consultant and gat
documentation regarding trips generated by a Bask!n-Rotbins in a shopping
center. Tbe motion died for lack of a second.

that the proposal would preclude future possible road improvements.

By consensus, Council approved 7:00 p.m., Monday, April 28, 1980 for the
Council/staff study session to develop policy guidelines for service level
of activities and programs for Fiscal Year 1980-81. They also approved
Friday, May 23 for distribution of proposed budget to Council.
38. Report on bid opening, Stevens Creek widening at Railroad, Project
80-42, award of contract and granting ~f negative declaration.
It was moved by COlfnc. Sparks, seconded by Counc. Rogers and passed unan-
imously to approve granting of a Negative Declaration for Stevens Creek
at Railroad Widening, Project 80-42 and sward the co~tract to O'Grady Paving
Company for their bid of $172,781. Council also appropriated $58,166 for
construction funds and $17,834 in contingency f',r a total of $76,000 from
the General Fund, $83,000 from HCD Funds and $35,000 from the StOrTIl Drain
Fund.

limitation of promotion of the event to local media.

It was moved by Counc. Gatto, seconded by Counc. Sparks and passed
unanimously to oppose AS 2698, the Manufactured Housing Production
Act of 1980.
NEW BUSINESS
41. Discussion regarding Senate Bill No. 1827 amending the state laws
relating to pornography and the abatement of pornographic matter.
It was moved by Counc. O'Keefe, seconded by Counc. Rogers and passed
unanimously to support SB 1827.
42. Summons and Complaint for refund of property tax for various fiscal
yp.ars filed by Southern Pacific Transportation Company, et al
It was moved by Counc. Sparks, seconded by Counc. Plungy and passed
unanimously to approve County Counsel handling CUDertino's deCense
in the Summons and Complaint for refund of property tax filed by Southern
PacifIc Transportatiùn Co., et aI.
43. Request for appropriation transfer.
It was moved by Counc. Sparks seconded by Counc. Rogers and passed
unanimously to approve continued expenditures in Account No. 810-449
for this Fiscal Year.

of Portel Avenue and Stevens Creek Boulevard."
It was moved by Counc. Sparks and seconded by Counc. Plungy to continue
second reading of Ordinance Mo. 998 to the regular meeting of May 5,
1980. The IIOtion was defeated with Count.:ilmembers !lDgers, O'Keefe and
Gatto dissenting.
It was moved by Counc. Gatto, seconded by Counc. Sparks and passed unan-
~usly to continue the second reading until June 16.
It was moved by Counc. Rogers, seconded by Counc. Sparks and passed unan-
imously to form a citizens goals committee and to agendize this matter
for May 5, 1980.

Councilmembers Sparks and Plungy dissenting that the Director of Planning
anoi Developaent inform the Planning CoUlllission that quality Development
retaining neighborhood characteristics should be top priority.

Cupertino Amending Section 11.20.020 of the Cupertino Municipal Code
Relating to Vehicular Stop Required at Certain Intersections."
It was moved by Counc. Rogers, seconded by Counc. Plungy and passed unan-
imously to read Ordinance No. 1000 by title only and the Mayor's reading
to constitute the second reading.

imously to enact Ordinance No. 1000.
48. Second reading of Ordinance No. 1001: "An Ordinance of the City of
Cupertino Amending Section 11.24.150 of the Cupertino Municipal Code,

viding for Signs Notifying the Public Thereof."
