STAFF REPORTS
1. Presentation by Honorable Norman Y. Mineta, 13th Congressional Distric
.
Congressman Mineta answered quesions pertaining to the post office loca-
tion, Federal SB 898 pertaining to cable TV, snd the medfly program.
Council expressed their appreciation for his assistance regarding Highway
85 and its use as a helicopter fueling point. They also expressed appre-
ciation for his assistsnce in regard to the 1980 census.

City Manager's Report
Redevelopment Agency - By consensus, Council set 7:00 p.m., Tuesday, Sep-
tember 29, Council Chamber, as time and place for a study session reðard-
ing the possible c~eation of s redevelopment agency for the City of Cuper-
tino. The Planning Commission is invited to attend.
Hortgage Revenue Bond Advisory Committee - Mayor Sparks will attend the
August 19, 1981 meeting at the County for the Mortgage Revenue Bond
Advisory Committee. If the City becomes involved in the program, Counc.
Johnson will be representative. The City Clerk's office will notify the
County.
Appointment of Coun"Umembers to Selection COlIDDittee - Council appoiuted
Councilmembers Plungy and Gatto to the eelection committee for the Police/
Fire Study consultsnt.

Letter from Mayor of Palo Alto to Hayor Sparks - It was moved by Counc.
Rogers, seconded by Counc. Plungy and passed unanimously to authorize the
~~yor to send a letter to the County opposing lack of referrals of unin-
corporated land development projects to cities. Alternative solutions
vould be that the developer forwarj plans directly to tÞe City or the
County increase charges to pay for the cost of referrals. The formatio'1
of a committee composed possibly of a staff representative of the County,
from the City of San Jose and froll one oth~r city vas discussed.

City Attorney Kilian reviewed the City's Environmental Assessment
Procedure for Council.
Hr, Ralph Martin, a representative of the MarianI Group of Companies,
from Newport Bea~h, reviewed the project with CouncIl. He stated
that he would like to come back at a later date in regard to open
space.

Ann Anger, 10185 Empire Avenue, spoke in support of the project. She felt
the higher density V88 appropriste as public transportation vas available
in that area.
Hr. Alf Kodine, 10385 Prune Tree Lane, inquired about the Bluejay and
Homestead Road signal.
Hr. Jack Hulqueeney, IIorthpoint Homeowners Associstion, spoke in favor
of the project. He felt that the design alloved for compatible uses on th
boundaries and that tbe plans were compatifìle with IIorthpoint. Be spoke
in opposition to the vacation of Bluejay Drive.
Hr. Tom Sullivan of IIot·thpoint stated tbat not all residents agreed with
the board, and his opinion was that the development was too dense.
Hr. Harry Loretz, 11000 Nortbsky Square, felt that the location of tbe
proposed develollllO!Dt was good but that it vas too dense.
Hr. Alf Modine inquired about the access for fire equipment, especially
with the underground parking.
A representative fr08 WPM Planning Team of Sausalito, the consultant vho
prepared tbe EIR, reviewed it vith Council.
Hr. Stanley Scarborough, 10571 Whitney Way, stated that the EIR should
address the issue of sewage capacity.

imously to close the public hearing pertaining to the EIR.

imously ;:0 adopt Resolution No. 5685 with tile following additions:
Noise - Hitigation Heasures - Heasures should be implemented to reduce
project construction noise. Such measures include properly tuned equip-
ment, cor~truction during daytime hours only (8:00 a.M. to 5:00 p.m.), and
the use of temporary noise bsrriers.
Urban DesiKD - Hitigation Heasures - The project has ircorporated design
considerations including modulated shapes, underground parking, berms
and staggered walls on the periphery, texture of materials to bring the
development in concert vith other projects in Cupertino.
Sewage Disposal - Hitigation Heasures - Water conservation kits viii be
included with each unit. In its current general plan land use studies,
which are considering increasing, decreasing, and retaining existing plan
densities, the City shall consider the relationship betwpen the densities
permitted on ~ndeveloped properties between Homestead Road and the freeway
and the remaining capacity of the associated sewer mains. The City shall
continue to monitor the efforts of the Water Pollution Control Plânt to
expand capacity in phase vith development. Should plant capacity not be
expanded by the stated completion date, consideration shall be given to
phasing project development in conjunction vith other areawide develop-
ment to avoid overcapacity at the treatment plant.

Council added Condition No. 26 which would allow a two-year .tpproval
period rather than a year and a half period.
Condi~ion No. 27 vas added to eliminate discrimination on the basis
of age (young or old).
Counc. Gatto stated that he was of the opinion that the proposed lake
in tbe development was of some worth in respect to open space credit.
Counc. Gatto also stated that he had voted in support of the applica-
tion because the positive parts of the overall project outveighed
certain concerns he might have. He requested that the Architectural
and Site Approval Committee give consideration to th~ placement of buildings
when they review the site design. The applicant will return to C~uncil
at a later date regarding open space.

Sharon Rohde, Chdirperson, Cupertino Library Commission, reviewed
the options for funding of Sunday service and paging with Council.

Barbara Campbell, County Librarian, addressed Council stating that .iace
it was late in the fiscal year, option 1 would be preferable and that
in future years, option 2 would be preførable.

imously to aPProve option 1 for this fiscal year and an additional ten
hours per week of paging.

imously that a letter be sent to the County regarding the County contribu-
tion for unincorporated areas for Sunday service.

40. Consideration of legal proceedings regarding illegal use of Rl lot-

imously to authorize the Code Enforcement Officer to initiate a citation
program of one citation per week in the calle of illegal use of IUI III lot
lit 10493 Mira Viatl> A\"enue. Staff will report back to Council in 60 days.
Should the problem not be alleviated, Council may authorize a civil in-
junction action at that tfae.
41. Request for authorizatun to take legal action of property owners
on Regnart Road - CWQzdz project.

42. Consideration of modification to Below ltarket Rate Program - sales
pricp ~alculations.

imously to approve that the BKR Program Guidelines be modified to allow
calculation of sales price of BHR units by using the 1980-81 HUD median
income figure increased by an amount which represents the previouH year's
increase..
43. Report of committee regarding Planning Commission Recording Secretary
It was moved by Counc. Gatto, seconded by Counc. Johnson and passed unan-
imously to approve a summary type format for Planning Commission minutes

80-20, and sward of contract.

unanimously to award the bid for Wheelchair Ramp Construction, Project
80-20, to Peninsula Concrete in the amount of $11,600. Council appro-
priated $14,200 frOlD BCD Funds to cover the contract and $2,600 to
be used to complete additional ramps.

those annexed as a result uf the San Jose/Cupertino Boundary

Boulevard and Orange Avenue to fiscal year 1981-82 and appropriate
$65,000 from the Gas Tax Fund.

with Councilmembers Rogers and Gatto dissenting to approve advancing
the installation of traffic signal at Stevens Creek and Orange to
this fiscal year and appropriate $65,000 frOM the Gas Tax Fund for
