City Clerk's Report - By consensus, Council rescheduled the regular meet-
ing of October 19, 1981 to Tuesday, October 20, 1981.
2. Report regarding tank cars on railroad track along Peninsula Avenue.
By consensus, Council directed staff to request a letter from Cal Trans
regarding the tank csrs along the Peninsula Avenue railroad trscks.
3. Oral report by City Attorney regarding liability for Comm~nity De-
velopment Block Grant Funds.

Council received an oral report from the City Attorney informing them
that their legal liability would be the amount spent by the City and
their share of any legal costs of any litigation.
4. Status report regarding sanitary sewer capacity.
It was moved by Counc, Plungy, seconded by Counc. Johnson and passed

Council was informed that upon inspection by the City Traffic Engineer,
the site obstruction had been removed. Therefore, no further action
was necessary.

Fain.

31. Discussion of the plall for expenditure of COIIIIIIun::'ty Development
Block Grant Funds in the City of Cupertino and its sphere "f influence
for 1962-85 program years.
CDBG Coordinat~r Hendee reviewed use of Community Development Block
Grant funds in the City or Cupertino, showing projects and the accumulative
amounts that the City vas entitled to receive.
Hr. Bob Childs, 10152 Bsrbara Lane, stated thst main programs and expendi-
tures and specific items bhould be avsilsble to the general public in
order thst citizens might participate in any discussion of the experdi-
tures. He stated that at the public hear1:tg held st the Monta Vista
Scho~l there had been a ratio of 5-1 speakers against accepti~g Block
Grant funds. He felt that Council should consider what items vere of
federal concern. He expressed the opinion that only items pertaining
to senior citizens fell into this category and that the rest vere local
issues and should be locally funded. He felt the issue of loans VB.
grants should be considered and expressed the opinion that S 20% o~·erhead
was excessive for the housing rehabilitation program. In regard to
land cost underwriting for BHR Programs, he hsd questi~ns regarding
the density bonus. He expressed doubts regarding ~ need for a community
awar~ness program for housing and questioned the just~fication of any
expenditures for land acqui.'ition for aSE. ~ed housing.
Ann Anger, 10185 Empire Avenue, ~tated her opinion that responsibility
to provide I"" income housing lies vith the entire county and not just
Cupertino. She is against the housing rehabilitation program as it
is presentl~ handled.

AIf Modine, 10385 Prune Tree Lane, inquired as to the definition of low in
($19,050, faaily of four). Be dtated that Article 34 of the Constitution
requires a "ote of the people on any public housing.
Wes Phillips, 20739 Scofield Drive, inquired as to the source of federal
funds and stated that the funds auat be r-.quested, they are DOt auto-
matically given. Be suggested that the City not participate in the Block
Grant PrC'.;raa a. he felt the City had enough local funds to complete any
necessary projects.
Dorothy Sasich, Cupertino, also stated her opinion that Cupertino does
not need BUD and Bloc'" Grant Funds. She further submitted that it vss not
the function of City government to provide housing.
Margaret Barton, 10255 Mira Vista, oPPOsed land acquisition for assisted
housing, and also stated that she felt the wording describing a proposed
cOllllUnity ava\·eness program sbovø bias. She felt that people would go
vhere they cC'.ùd afford to live.
Lou Sasich, Cupertino, commended the group regard..,}! their awareness re-
garding the problea of housing. lie stated t1tat many people worked in
Cupertino vb... don't live here or want to.
Kathy Ebright, C~ity Bousing Developers, ststed that CIID has applied
for Section 202 funds for physically disabled housing. Their proposal is
currently in Washington, D. C. and the:r expect to hear within thirty
days.
Steve Barton, 10255 Mira Vista Avenue, opposed the Block Grant Program.
He stated that he and his vife had a.me from England and seen vbat govern-
ment subsidies can do.
Maurice O'Shea, Clay Street, stated that he felt the Block Grant funds and
the issue of Section 202 Funds vere sepsrate issues. He stated thst if a
person is trying and is handicapped they should be helped. He felt that
this would be a comaunity issue.

out to Council that the City was not in the housing businesr. He ques-
tioned vhy the City needed a redevelopment agency and why it was being
considered at a special meeting.
