A letter received from Gill Cable pertaining to rate increases was re-
ferred to tbe City Attorney.
The formal extension and rate pertaining to our agreement with United
Cable Television will be reviewed by the City Manager and City Attorney,
and staff will submit a report to Council.
COUNCIL REPORTS
Counc. Rogers: A report was given regarding the proposed work fur!ough
program.
By consensus, staff will revi~ the criteria established for a work fur-
lough program site and report to Councilmember Rogers prior to Wednesday,
January 6, 1982.

14. Application 2-GPA-8l of City of Cupertino: Public Hear~g to con-
sider a General Plan Amendment to permit public storage uses in
addition to residen~ial uses on a 7.4 acre site located 600 ft. soot
of IloIIestead Road and 360 ft. west of North De Anza Boulevard. The
Cupertino General Plan currently designates the property for .edium/
high density residential uses at 10-20 dwelling units per acre. En-
vironmental Review: Th~ Planning Commission recommended the grant-
ing a Negative Declaration. Recommended for approval.

Director of Planning and Development Sisk reviewed Application 2-GPA-8l
with Council.
Mr. John Vidovich of De Anza Properties was available for any questions
from <:t-uncil.
It was moved by Counc. Rogers, seconded by Ccunc. Plungy and passed unan-
imously to close the public hearing regarding Application 2-GPA-8l.
It was moved by Counc. Rogers, seconded by Counc. Gatto and passed un&11-
imously to grant a Negative Declaration for Application 2-GPA-8l per
Planning Commission Resolution No. 2264, with EXhibit A amended to state
that the mini storage area will be located so it may be used as a buffer
to mitigate environmental impacts such as traffic noise.
It was moved by Counc. Rogers, seconded by Counc. Plungy and passed unan-
imously to adopt Resolution No. 5790.
It was moved by Counc. Rogers, seconded by Counc. Gatto and passed unan-
imously to refer Applications 19-Z-8l and 18-U-8l of De Anza Forge (Cuper
tino Village) to the Planning Commission.
It was moved by Counc. Gatto, seconded by Counc. Johnson and passed unan-
imously to close the public hearing regarding the consideration of can-
cellation of land conserv2t10n contrar.t with Otis and Muriel Forge.
It was moved by Counc. Gattot seccnded by Counc. Rogers and passed unan-
imously to adopt Resolution No. 5783.
It was moved by Counc. Gatto, seconded by Counc. Rogers and passed unan-
imously t~ adept Resolution No. 5784 with the inclusion of the cancella-
tion fees when receivpd from the County Assessor's Office, such adoption
based on payment of cancellation fees and receipt of a letter stating tha
the applicant wishes the cancellation to be considered under legislation
which was effective January 1, 1982. Council found that cancellation of
this contract and deveJopœent was not discontiguous with development ~n
the area and was consistent with the General Plan.

13. Application HC-51,310.l - Marius Nelaen appuling ~he denial
of a proposed modification to an existing sign program. Modifica-
tion would allow a second ground sign. The subject property is
located at the northwest corner of Mann Drive and Stevens Creek
Boulevard. (Marius Nelsen, applicant).
Dir~ctor of Planning and Development Sisk reviewed the appeal with
Council.
Mr. Marius E. Nelsen, appellant, stated that the proposed siSt, was very
important to tenants in the building. He stated his opinion that
signs could be put up that would satisfy the City of Cupertino.
Ann Anger, 10185 Empire Avenue, stated th3t the area was in great
need of foot traffic. &he Felt that the business (Neli's Deli) was
a start in this direction and would encourage others.
It was moved by Counc. Gatto, seconded by Counc. Rogers and passed
unanimoualy to close the public bearing.

The majority of Council members stated the feeling that adequate signing
coald be accomplished within the present sign ordinance.

quested that the City forwud to the County their position regarding
CHD's application for land acquisition on whi~h they hope to ~onstru~t
housing for the physically disabled.
It was moved by CoUD~. Plungy, seconded by Counc. Gatto and passed unan-
imously to authorize the Mayor to s.nd a letter to the County in support
of Coawuity Houains Developer¡,' proposal and their Co-.unity Development
Block Grant application. The City Attorney will review the letter prior
to i~s being sent.
It was moved by Counc. Rogers, se~onded by Counc. Plungy and passed with
Counc. Gatto dissenting to issue a policy statement that at the appropria
time the City would conduct an Article 34 election pertaining to whether
or not the community wishes a 100% handicapped proje~t.
28. Enforcement of agreement requiring certain street improvements be made
(Sang Ik Hahn).
Council received the report.
29. Claim for daasges to motorcycle and lock; filed by Eric B. Decker.
It was moved by Counc. Rogers, seconded by Counc. Gatto and passed unan-
imously to reject the ~laim for daaages filed DY Mr. Decker and authorize
the City Clerk t so notify him.
30. Discussion concerning po~sible legal a~tion for sign violation -
Photo Drive-Up located ~t 1375 South Saratoga-Sunnyvale Road.
The City Attorney requested that this be discussed in closed session be-
cause of possible litigation.
31. Request for authorization to purchase one street sweeper.
It was moved by Counc. Rogers, seconded by Counc. Plungy and passed unan-
imously to authorize purchase of a street sweeper fro~ Nixon-Egli in the
amount of $58,606.49.
By consensus, Council requested that the City Manager contact the Foothill
Community College District regarding :he District agendizing the petition
submitted by residents regarding parking on city streets resulting from
colleges' charging of parking fees.
32. Consideration of hearing for granting a nonexclusive franchise for
~he conveyance of nitrogen gas.
(a) Resolution No. 5792: "Resolution of Intention to Grant Franchis
Notice of Hearing: Publication of Notice."

Mrs. Gloria E. Item expressed concerns of residents regarding the water
pressure in the San Juan Road area.
By consensus, Council directed that the Department of Public Works
send letters to signators on the petition addressing the issues of
fire safety, water preasure and quality of water.
ORDINANCES
34. Second reading of Ordinance No. 1154: "An Ordinance of the City
of Cupertino Amending Section 1 of Ordinance No. 2 by Rezoning
Approximately 20 Gross Acres from Various San Jose Zoning Dis-
tricts to the City of Cupertino P Zone: Generally Located on the
West Side of Saratoga-Sunnyvale Road between Rainbow Drive and
Prospect Road."
Clyde Berg of Berg & Berg asked questions of Council regarding the
possibility of some minor assembly type businesses being allowed
along the west side of Saratoga-Sunnyvale Road between Rainbow Drive
and Prospect Road. Council requested that he talk with staff.
It was moved by Counc. Plungy, seconded by Counc. Rogers and passed
unanimously to read Ordinance No. 1154 by title only and the Ctty
Clerk's reading to constitute the second reading.
It was moved by Counc. Rosers, seconded by Counc. Johnson and passed
unanimously to enact ~dinance No. 1154.
It was moved by Counc. Gatto, seconded by Counc. Johnson and passed
unanimously that staff review the conceptual plan of the area to
confirm that the ordinance is consistent with the approved plan.
35. Second reading of Ordinance No. 1155: "An Ordinance of the
City of Cupertino Amending Section ll.24.l50 of the Cupertino
Municipal Code, Relating to Stopping, Standing or Parking on
Bandley Drive."
It was moved by Counc. Plungy, seconded by Counc. Gatto and passed
unanimously to read Ord~nance No. 1155 by title cnly and the City
Clerk's reading to constitute the second reading.

'manimously to enact Ordinance No. 11-55.

imously to read Ordinance No. llS6 by title only and the City Clerk's
reading to constitute the second reading.

38. Recognition by Mayor of special requests.

(a) General Audience - Ann Anger, 10185 Empire Avenue, announced
that there would be a meeting of the West Valley Legislative
Collllllittee on January 15 and invited Council alld City Manager
and Director of Public Works to attend.
Mr. Wes Phillips, Scofield Drive, stated that in some cities,
signs are posted along streets saying no psrking on certain
hours and street sweeping is done during those hours. There
is strict enforcement of these signs.
At 9:17 p.m., the meeting was adjourned to a closed session.
At 9:30 p.., Council reconvened in open session. Those present were
Councilmembers Gatto, Johnson, Plungy, Rogers and Sparks, City Manager
Quinlan, City Clerk Cornelius, Director of Planning and Development Sisk
and City Attorney Kilian.
In regard to action regarding the sign violation at the Photo Drive-up,
Council unanimously authorized staff to proceed w1th the enforcement pro-
cess of issuin~ citations on a weekly basis and further äirected the City
Attorney to proceed with legal action in civil court with all deliberate
speed.
The meeting was adjourned at 9:35 p.m.
