He felt that this should be considered when Council is making its decision. He stated that there haà been several meetinqs held with Director of Public Works ~iskovich and others to work for a solution. However. it a?peared that few people were willing to do so. Stuart ~adas, lli7 Campbell Avenue, San Jose, stated that each lot has protlems that are very different. He felt that everyone getting together and agreeing was almost an ixpcssible task. If it could be proved to the court that it was beyond the owner's ability to do so, tbe City could get a court order. Because of possible future damage casued by rain, the courts would probably give some consideration in placing the matter on the calendar, but it would not be in time to avoid the start of the rain. ;lartin Kasik, 11496 Lindy Place, informed the Council that he would not be willing to sign a waiver of liability. He stated that the Epsteins and the Kasiks are being sued by the Jameses and the Cunninghams. He stated that he thought the Jameses had fenced the property; however, the fence had been taken down. He informed Council that the house has become a tour site. Young people come down the ~ountain and look at the house. Te~bnical analyses all state that it is a grave situation and that something needs to be done.
