Staff received a comment from a rear yard neighbor with concerns about privacy impacts caused by the rear yard addition. The neighbor requested that the addition be added towards the front of the house, or that the shared fence be extended in height for enhanced privacy. The applicant noted an existing gas meter in the front, and that the cost to relocate the gas meter and pipeline would bring the project over budget. The applicant also informed the neighbor that the owner would be willing to work with him to build a taller fence. Staff noted to the neighbor that the addition has only a single bathroom window (with a sill height above five feet) along the wall plane facing the neighbor's property. Additionally, single story extensions into the rear yard setback do not trigger privacy planting requirements. The applicant has met all other development standards applicable to the single story rear yard extension and no further action is required. Staff has made all the findings that are required for approval a Minor Residential Permit as required by the of Cupertino's Municipal Code, Chapter 19.28.140 (A). 1.
