DRC 01-19-05 Design Review Committee January 19,2005 Cupertino, CA 95014 (408) 777-3308 APPROVED MINUTES OF THE REGULAR MEETING OF THE DESIGN REVIEW COMMITTEE HELD ON JANUARY 19, 2005 ROLL CALL Committee Members present: Marty Miller, Acting Chairperson Taghi Saadati, Commissioner Committee Members absent: Gilbert Wong, Chairperson Staff present: Gary Chao, Colin Jung Staff absent: None APPROVAL OF MINUTES: January 5,2005 Minutes of the January 5, 2005 Design Review Committee were approved. A memo was received stating that Chairperson Wong had reviewed the minutes and had approved them. WRITTEN COMMUNICATIONS: POSTPONEMENTSjREMOV AL FROM CALENDAR: 4. R-2004-42; Eddy Shen (Qi residence), 10690 Merriman Road Request postponement to the next meeting. ORAL COMMUNICATION: None CONSENT CALENDAR: None 3 Design Review Committee January 19, 2005 open to other types of trees. The only window looking to the back of the property is the bedroom window and there is an option to change that to face the left elevation on a voluntary basis of the applicant. Mr. Jacobs state that he doesn't mind the Camphor trees; he would just like to see additional trees planted more 'robustly' along the back fence line. More discussion continued regarding the privacy trees and the rear window. Acting Chairperson Miller suggested that the discussion of the trees continue outside of the meeting on a one on one basis. Mr. Jacobs strongly wants to come to an agreement on the matter of the trees during the meeting for documentation purposes. Mr. Miller stated that that this out of the scope of the meeting and that the applicant is required to meet the ordinance. Mr. Jacobs asked the applicant if he was willing to plant Italian Cypress along the fence line. Frank Ho, Architect, stated that he was the designer of the project. Mr. Miller stated that there is no argument to compel the applicant to plant a certain type of tree. Mr. Jacobs explained that he was trying to make a good neighbor effort in front everyone. Mr. Chao stated that the applicant did not have to make a decision at the meeting. Acting Chairperson Miller closed public hearing. Commissioner Saadati stated the frosted window is easy to provide in the case of the trees not growing fast enough to provide privacy. He stated that additional trees seem possible and that shrubs are another option. Mr. Miller stated that he too was concerned with adequate screening for the neighbors. However, a frosted bedroom window is difficult thing to do and unprecedented in Cupertino. Due to the considerable distance between that window and the structures on the neighboring property, he thinks the appropriate way to deal with the window is proper screening. MOTION: Commissioner Saadati moved to approve R-2004-35 with the requirement to work with the neighbors and staff regarding additional trees. Application: Applicant: Location: R-2004-41 Mike Chen (Wang residence) San Leandro Avenue Residential Design Review of a new, two-story 4,507 square foot residence with an exception for a 1,287 square foot second-story exceeding 35% of the first story. Design Review Committee decision final unless appealed. Staff Presentation: Gary Chao, Assistant Planner, briefly described the project. The project conforms to the ordinance with the exception of the second floor to ground floor ratio. The way the project is designed and the ample setbacks given on all sides, staff is supportive of the project and recommends approval. Mr. Wang, applicant, stated that the project was well designed. Mike Amini, neighbor, stated that it was a nice building. He was a little concerned about a couple of windows and would like to see them frosted. Mr. Chao stated that they were high sill windows. Mr. Amini was concerned about privacy. Discussion continued regarding privacy protection. MOTION: SECOND: ABSENT: ABSTAIN: YOTE: Commissioner Saadati moved to approve R-2004-41. Acting Chairperson Miller Chairperson Wong None 2-0 3. Application: Applicant: Location: EXC-2004-16 Conor Malone 10584 Santa Lucia Road Fence Exception for an electronic gate. Design Review Committee decision final unless appealed. Postponed from December 1, 2004. Staff Presentation: Colin Jung, Senior Planner, briefly described the fence exception. Mr. Jung stated that the fence was built without a building permit and constructed in 5 Design Review Committee January 19, 2005 He also stated that Mr. Malone would like to request another the front setback. postponement Discussion continued regarding the location of the fence. Conor Malone, applicant, had originally asked for a postponement but had changed his mind after thinking it over. In regards to the issues highlighted, Mr. Malone stated that he feels that his property is secluded. He was also concerned about security. He said that the fence was built in the front setback three years ago and didn't know the proper rules and permits. He did not agree that the emergency personnel could not get in to the property in case of an emergency. Mr. Saadati asked if the gate company was a licensed contractor. Mr. Malone answered yes and his next step if the exception was not resolved was to contact the gate company. Discussion continued regarding the location of the fence.
