Dear Cupertino Mayor Vaidhyanathan, Vice Mayor Paul, Councilmember
Chang, Councilmember Sinks, and Councilmember Scharf,
A new air quality regulation Regulation 11, rule 18 will come to a vote before the Bay Area Air
Quality Management District (BAAQMD) in San Francisco next month. This new regulation will
significantly lower all stationary sources of toxins exhausted into our air by industry, including;
Lehigh Cement Plant (close to Cupertino, Los Altos, Los Altos Hills, Mountain View and other
Silicon Valley Cities) and the oil refineries in the East Bay. This regulation's goal is to reduce
health impacts from all major stationary hazardous, toxic air pollution sources in the Bay
Area. A health risk threshold level requiring mitigation would see a 10 times reduction when
regulation 11, rule 18 is fully implemented. An example of mitigation could be the use of
feasible/effective/best available technology pollution control equipment and running that
pollution equipment continuously.
I am writing to ask you to join the Town Council of Los Altos Hills and the Los Altos City Council
which have authorized their respective Mayors to write a letter on behalf of their councils and
their cities to Bay Area Air Quality Management District in support of Regulation 11, Rule 18. In
addition, Congressman Ro Khanna's Office has sent a letter to Bay Area Air Quality
Management District in support of Regulation 11, Rule 18.
The Lehigh Cement Plant is a major source of air pollution and it warrants increased regulation.
The Lehigh Cement Plant west of Cupertino is the only cement plant of the top polluting plants
in the U.S. that is directly adjacent to a major population center. " ... The Lehigh Southwest
Cement Plant (Lehigh) located in unincorporated Santa Clara County, west of Cupertino is the
only Portland cement manufacturing facility located in the District. One of the few cement plants
in the country located in an urbanized area ... "1
In previous years, the towns and cities of Cupertino, Portola Valley, Atherton, Los Altos, Los
Altos Hills, and Sunnyvale, and Midpeninsula Regional Open Space District joined in support of
some of Bay Area for Clean Environment's legal efforts to win back rights to regulate the
expansion of the mine. Those efforts did not succeed; however, it did send a message to other
agencies such as the county that these communities were united with other cities and towns in
the region to protect their residents. Now the Cupertino City Council can join other cities and
towns in the region to support the Bay Area Air Quality Management District's effort to improve
and protect the Bay Area's air quality.

Our Mayor could sign and Cupertino City Staff could email Bay Area Air Quality Management District a
letter of support for this proposed air quality Regulation 11, Rule 18 . The letter could be sent before the
hearing on Regulation 11, Rule 18 which will be on November 15th, 2017 in San Francisco . As an
example, the Town of Los Altos Hills's letter, the Los Altos's letter, and Congressman Khanna's letter in
support of this proposed air quality Regulation 11, Rule 18 is attached. Please address public the letter
to: Victor Douglas
vdouglas@baaqmd.gov.
Lehigh Southwest Cement Company in Cupertino is listed by the California Air Resources Board as
releasing 993,827metric tons of C02e --greenhouse gases in the year 2015. That year it was also listed
as the fourth highest emitter of greenhouse gases of the 8 cement plants in California.2 The physicians
of the Santa Clara County Medical Association in a letter to the region air district " ... recognize the
potential negative impact on the public health due to the cement plant operations, which contribute to
global warming and emit a variety of toxic pollutants into the air with direct exposure to the population
and the environment of our county ... "3 The cost of illness from the Lehigh cement plant pollution locally
estimated from BAAQMD and EPA publications, is estimated in the tens of millions of dollars per
year.4
In 2013, Midpeninsula Regional Open Space District Director asked the other cities to join them in the
amicus brief so that there can be
" ... effective and coordinated public oversight and control, assuming that the operation is going to
continue and even more importantly, if there is contemplation of expansion in the future; this vested
rights issue is central to us having that leverage to protect the public health ... " 5

Dear Mr. Douglas:
Thank you for the opportunity to comment on this important Regulation.
The City Council of the Town of Los Altos Hills strongly encourages the District to swiftly adopt
and implement Regulation 11, Rule 18.
While the rule stipulates more stringent requirements on assessing health 1isk than the previous rule,
this improvement in public health will be meaningless without scientifically accurate and
comprehensive enforcement.
Because of the technical difficulty in calculating air pollution emission and dispersal, we believe that
the Dish·ict should substantially increase the number of air monitors surTOunding the plant.
Fortunately, there are now a variety of options in establishing community-level air quality with smaller
and dramatically less expensive monitors.
Finally, we request that Lehigh be at the top of the list of the industiies that come into compliance
with this rule very quickly.

improve the health of residents of the San Francisco Bay Area.

As you know, the air quality regulation known as Regulation 11, Rule 18 is scheduled to come
before the Board of Directors of the Bay A rea Air Quality Management District (BAAQMD) in
the coming month. I am writing to pass on my constituents ' support for this proposed regulation.
As the congressman for California's seventeenth district, I take my responsibility to the people
and ideals I represent seriously. Part of my district covers the densely-populated areas adjacent to
the Lehigh Southwest cement plant, the area that would be subject to these new regulations. My
constituents living in these areas have reported odor and dust being present in the air. They have
also raised concerns to me about potential adverse effects to their health and well-being caused
by emissions from the plant.
These new regulations will strengthen environmental protections for the region, and potentially
result in significantly lowered levels of toxins in our atmosphere. I echo the sentiments of my
constituents that stricter regulation and monitoring will promote the community's public health
and we11 -being, and contribute to making the Bay Area a cleaner and better place.
I applaud the BAAQMD for the steps you are taking to protect the environment of the Bay Area
and the health of its residents. I encourage you to give full and fair consideration to my
constituents' position, consistent with all applicable laws and regulations. Thank you for your

With great expectation from all the Cupertino residence , we voted you guys as Cupertino council member. We
do ho e you can do something good to improve the living conditions of our community. I remember when
Council Chang asked us to vote for you , you romised us to reduce the air 2 ollution in Cupertino , that is
he reason I voted for you .
I have been living in Cupertino for more than 10 years along the foothill BLVD. Every week day, many large
trucks are running on the street, dumping lots of dusk. Some nights, the Lehigh cement plan releases the
polluted airs . I can see the dark particles on the deck of my yard . Sometimes I make the international travel for
about one week, and I park m ark outside. After I come back, the car are alwa s covered b dust which is
ver difficult to remove.

A multi-year study conducted by the University of Texas Health Science Center in San Antonio that showed a correlation
of increasing rates of autism diagnosis in children who lived the closer to mercury emitting facilities . The study was
conducted by Dr. Palmer and they found that for every 1000 pounds of industrial release, there was a corresponding 2.6%
increase in autism rates and a 3.7% increase associated with power plant emissions.
Enclosed is the study and the data which included 1,040 school districts in 254 counties in the state of Texas. Also enclosed is the EPA
Mercury Measurement that Dr . Palmer released of Santa Clara County taken in 2002 of school districts in the county with the highest
rates of autism. Cupertino schools are in the >3 standard deviation category . Also enclosed is a study regarding mercury concentration
in ambient air and the risk of autism. Also enclosed is another study Dr. Palmer conducted about the mercury concentration in ambient
air and the risk of autism. Several years ago I proposed to the City of Cupertino and the Santa Clara County Supervisors that a similar
study be conducted in our region to vastly expand the number of air quality measurement locations be installed. There was no action to
review the University of Texas study and contact Dr . Palmer to discuss conducting a similar study in Cupertino . He is available.
I urge that the BAAQMD be requested to significantly increase the number of continuous air monitors surrounding the plant to improve
scientific accuracy and comprehensive enforcement of the new rule . The Lehigh Cement Plant is a major source of air pollution and it
warrants increased regulation. It is close to many highly populated cities of Silicon Valley and the Bay Area and Lehigh must be
required to come into compliance with the BAAQMD Regulation 11 , Rule 18.

Lehigh Cement Plant west of Cupertino, I applaud the BAAQMD's work in this area . I urge the
Cupertino City Council to write a letter supporting the swift adoption and implementation of Regulation
11, Rule 18. I further urge that the letter asks BAAQMD to significantly increase the number of
continuous air monitors surrounding the plant to improve scientific accuracy and comprehensive
enforcement of the new rule. The Lehigh Cement Plant is a major source of air pollution and it
warrants increased regulation. It is close to many highly populated cities of Silicon Valley and the
Bay Area so the letter to BAAQMD should also request that Lehigh be among the first required to
come into compliance with the BAAQMD Regulation 11, Rule 18.
I can see the plumes from my home every single day, and the noise pollution -day, night , weekend, weekday is
incessant and intolerable. Please take this seriously and provide your support.

I live near the Lehigh Cement Plant, and I am well aware or the toxic pollutants in the atmosphere around me,
and the unhealthy paiiiculate matter dust that falls on my property and the others around me. I am asking you to
write a letter to the Bay Area Air Quality Management District, in support of Regulation 11, Rule 18, in the
upcoming vote of the BAAQMD. In the letter, please ask the BAAQMD to significantly increase the
continuous air monitors in areas smTounding the plant and in nearby schools and neighborhoods. Because it is
so close to bay area cities, schools, and homes , please also request that Lehigh be among the first required to
come into compliance with the BAAQMD Regulation 11 , Rule 18.

I live very close to the Lehigh Cement Plant and have been concerned about their emissions for years. I feel they
should be monitored more closely since I live in the area and my children have been exposed to their output products
for their entire lives. We don't have a clear idea what the future will hold but I hope that our exposure doesn't create
health issues for us. My concerns arise because we don't know what is in their emissions and for many years Lehigh
claimed that their emissions could not be monitored (because oflack of technology and their operations). The
addition of the single stack makes that possible. Now, we can see clearly when there is a change in the quality of the
smoke/emissions. For years, Lehigh denied there were no emissions. In fact, many years ago I went on a tour of the
facility and was told that they didn't have any emissions into the air. What I was seeing was just a trick of the light.
That doesn't allow me to have a high level of confidence in their ability to self monitor. I suppo1i the adoption of
regulations that will help protect myself and my children.

and the unhealthy particulate matter dust that falls on my property and the others around me. I am asking you to
write a letter to the Bay Area Air Quality Management District, in support of Regulation 11, Rule 18, in the
upcoming vote of the BAAQMD. In the letter, please ask the BAAQMD to significantly increase the
continuous are monitors in areas surrounding the plant and in nearby schools and neighborhoods. Because it is
so close to bay area cities, schools, and homes, please also request that Lehigh be among the first required to
