CALL TO ORDER
The meeting was called to order at 7:00 p.m. in Conference Room A, Cupertino City Hall, 10300
Torre Avenue, Cupertino.
ROLL CALL
Present: Chairperson Nancy Canter and Commissioners, Herna Kundargi, Shirley Lin-Kinoshita
Janet Mohr, and Carl Orr. Staff present: City Clerk Kimberly Smith.
APPROVAL OF MINUTES
I. Minutes of the regular meeting of October 26, 2004.
The commissioners voted unanimously to approve the minutes as presented.

COMMISSIONER REPORTS
2. Report regarding the November meeting with Mayor James.
The commission received the report. The new Mayor, Patrick Kwok, will be setting up a
different meeting schedule beginning in February, 2005.
3. Arts-related news updates from Commissioners
UNFINISHED BUSINESS
4. Status on plans for a public hearing at the Quinlan Community Center regarding a location
for the donated statue of Cyrus the Great.
The City Clerk reported that a letter of agreement had been sent to the donors which
specified the requirements associated with engineering, installation, etc.
NEW BUSINESS
5. Consider creating a subcommittee to identify potential art locations in the Cupertino
Library and present those suggestions to Cupertino Librarian.
Commissioners Janet Mohr and Hema Kundargi were selected. They will visit the library
and report back to the full commission before arranging a meeting with the Librarian.

6. Reminder that December 28 meeting will be cancelled.
7. Reminder that the next regular meeting will be January 25, 2005, and held in conjunction
with the Planning Commission to discuss the General Plan, including the Percent for Art
component.
8. Reminder that this is the final meeting for Commissioner Carl Orr. Interested applicants
may apply until December 28, and interviews will be held January 10 or II.
The commissioners brought in refreshments to share and offered their thanks and farewells
to Commissioner Orr for his years of service on this commission.

At 7:05 p.m. the meeting was called to order at 10300 Torre Avenue, Cupertino, CA, Conference
Roorn C.
ROLL CALL
Present: Chairperson Nancy Canter and Commissioners Janet Mohr, Shirley Lin-Kinoshita, Hema

1. Minutes of the regular meeting of November 23,2004.

COMMISSIONER REPORTS
2. Arts-related news updates from Commissioners
City Clerk Kimberly Smith announced that Mayor Patrick Kwok will be meeting with the
commissions on a quarterly basis. The first meeting will be held on February 8 at 5:30
p.m. Commissioner Janet Mohr will attend.
3. Election of chairperson and vice chairperson
Chairperson Nancy Canter opened the tloor for nominations. Commissioner Shirley Lin-
Kinoshita nominated Commissioner Janet Mohr. Commissioner Mohr nominated
Chairperson Canter; Cantcr refused. Nomination to elect Commissioner Mohr as
chairperson passed unanimously with Mohr abstaining. The floor was opened for
nominations of vice chairperson. Commissioner Canter nominated Commissioner Hema
Kundargi. Nomination to elect Commissioner Kundargi as vice chairperson passed
unanimously.

UNFINISHED BUSINESS
4. Status of plans for a public hearing at the Quinlan Community Center regarding a location
for the donated statue of Cyrus the Great.
City Clerk Kimberly Smith updated the commission on the current status. She indicated
that according to Fariba Nejat, the art can be ready as early as six weeks and that it had
been requested that the art be placed by May 12. City Clerk also indicated that the letter of
agreement had not been signed. The commission discussed whether to hold the public
hearing before the letter of agreement has been received. City Clerk will get the status of
the agreement and report back to the commission at the next meeting. The commission
will begin preparing its vision for art in the city and provide an update at the next meeting.
NEW BUSINESS
5. Update rrom subcommittee to identify potential art locations in the Cupertino Library
Vice chair Herna Kundargi reviewed the Santa Clara County Library policy regarding art.
She indicated that the policy is quite restrictive and that it may be difficult to place art at
the library. City Clerk suggested that the subcommittee approach the head librarian to
discuss the possibility of installing art in the library and offer possible art locations that
might be suitable. Kundargi and Mohr agreed to continue to work as a subcommittee on
this item.
STAFF REPORTS
6. Preparation for joint meeting with the Cupertino Planning Commission on January 25,
2005,7:00 p.m., to discuss the General Plan, including the Percent for Art component.
Ciddy Wordell, City Planner, reviewed the status of the General Plan process. She
indicated that staff had created a document called "hot topics" and that it was created to
focus on the major issues as they go through the public hearings. She stated that the
Percent for Art item was added to the hot topics document because it hadn't been discussed
during any prior General Plan task force meetings and staff felt that something such as this
shouldn't go all the way through and get approved without some notice that it was being
proposed. Ciddy stated that some options were added to the art component: consider it,
adopt the previous ordinance language or revise the proposed text to make it less onerous.
It was suggested that the commission send one person and one staff member to the
Planning Commission to state the proposal and answer questions. It was also noted that
the Planning Commission would rot be making any decisions for several months and that
they were only receiving intorrnation at this time. Vice chair Hema Kundargi will take the
lead and will direct the Planning Commission to City Clerk whenever necessary.

City Clerk suggested that the commission provide the Planning Commission with
information about what a Percent for Art program is, site successes in other cities, and
provide information regarding the benefits and risks. City Clerk cautioned the commission
that developers would probably be opposed to this change unless they understand and
believe that it doesn't have to be additional dollar amount over the total project costs. The
commissioners will meet briefly at 6:00 p.m. at the Coffee Society on January 25 to discuss
final details before presenting the proposal.

quorum and the meeting was adjourned.

MACIA features exhibit of artists
It sounds like one of the latest Sims
gariles, but Bustin' Out is an upcoming
exhibit at MACLA/Movimiento de Arte
y CuJtura Latino, introducing the work of
four Latino artists working in San Jose.
The show features new photography,
paintings and mixed-media work by
Angelica Muro, Alejandro Oliva, Mitsy
Á vila Ovalles and Abraham Ortega
that is curated by Anjee Helstrup.
Mitsy Á vila Ovalles, a recent Bachelor
of Fine Art's graduate from San José
State University, uses mixed media, paint
and found objects to address issues per-
taining to women, such as body image
and societal expectations.
Alejandro Oliva, studying at De
Anza College, uses digital photography
and an acute sense of composition to
focus attention on things that could eas-
ily be overlooked.
A reception for the show is on Jan. 14
from 6 to 8 p. rn. The exhibit runs
through March 5.
