APPROVING APPLICATION l-Di\.-90, DEVEIDl'MENT AGREEMENT
BE:IWEEN '!HE CITY OF aJPERI'INO AND WESTFIElD, INC.
'!HE CITY a:xJNCIL OF '!HE CITY OF aJPERI'INO IXJES HEREBY ORDAIN that
Application l-Di\.-90, Development 1\greeIœnt between the City of CUpertino
arxi Westfield, Inc., attached hereto arxi made part hereof by reference, be
approved per the following fi.n:li.n;s:
1)
ihe entitlerrents secured to the applicant, Westlarxi Shoppin;¡" Center
L.P., in consideration of the matters of public benefit which are
des=ibed in the subject Development 1\greeIœnt (Retention of the
existin;¡" Ice Rink arxi Child Care center, project design review,
payment of an impact fee, provision of transit facilities, arxi
reservation of a large sin;¡"le user space to facilitate recruibnent of
a major retail tenant) are consistent with the objectives defined in
the city Council's Resolution 7506.
Said Development AgreeInent is hereby found to be consistent with the
City of CUpertino General Plan

certainty of the entitlerrents secured thereuIrler.
ihe project was subject to an Initial Study as required umer the
Califomia Environmental Quality Act arxi was found to have no
significant impacts upon the environment.

compliance by the developer with its tenDs.
