BACKGROUND: The project area was subdivided in 1940 under the County's jurisdiction. The subdivision map and the property deed call for a 25-foot front yard setback. In cases where the subdivision map and the deed clearly call for larger setbacks, the City respects the larger setback. DISCUSSION: There are 10 homes in Tract No. 139 and seven were rebuilt between the years of 1997- 2002 with front yard setbacks less than 25 feet. Thus the neighborhood pattern is no longer 25 and staff does not support requiring 25 feet for this project. The exception process allows neighbors to be aware of the City's intention to allow lesser setback. De Anza Blvd. Date: March 3, 2005 Proiect Description: Sign exception to allow 36-inch sign letters when 18-inches is allowed. RECOMMENDATION: Staff recommends approval of EXC-2005-04, based on the model resolution. BACKGROUND: The applicant (Midway Signs) is proposing new signs for Key Point Credit Union located at an existing commercial building at the corner of De Anza Boulevard and McClellan Road. The property currently has an approved sign program that allows for wall signs up to 18 inches in height. The applicant is proposing to locate: · A wall sign on the building along De Anza Boulevard and a second wall sign on the building along the interior parking lot. · Reface of an existing ground sign in front of the building along De Anza Boulevard. The Sign Ordinance allows a maximum 18-inch wall sign height for this property. The project proposes 36-inch tall wall signs. Due to the unusual architectural design of the building, staff recommends approval of the sign exception because of the ability to make the exception findings. The sign exception will modify the existing sign program and will also apply to other tenants of the commercial building. DISCUSSION: Findings for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this tit/e. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business ..." The existing c2-¡ March 3, 2005 EXC-2005-04 building has an unusually large sign band along De Anza (6 feet tall) and the interior parking lot (12 feet tall). Eighteen-inch tall wall signs along these two elevations would appear awkward and not harmonious with the building design. The taller wall signs are better proportioned with the existing sign band of the building. BACKGROUND: The applicant, Peers Coffee, will occupy approximately 1,830 square feet of a 7,100 square foot new commercial building, currently under conStruction. The building was approved by the City Council in June, 2004. The exceptions requested are for: Two blade signs Two blade signs are proposed, on the north and south elevations, respectively. These result in more signs than the ordinance allows, and projecting signs are not specifically allowed in the sign ordinance. Therefore, an exception is needed. Wall sign height Two walls signs are proposed, one on the south elevation facing Stevens Creek Boulevard and one on the north elevation facing the parking lot. The sign ordinance allows two walls signs if one of them is directed to the interior of the project and is not visible from a public right-of-way. Therefore, the exception is only for the height of the proposed wall signs. The sign ordinance allows a maximum wall height of 18 inches, and 26 inches is proposed. (Signs are measured to the exterior limits of a border or background.) Illuminated window lo~o sign An illuminated window logo sign, totaling approximately 5.75 square feet, is proposed. Logo signs are exempt if they do not exceed four square feet and are not internally illuminated. Staff recommends that this sign be reduced to two square feet and not be internally illuminated, so that no sign exception is needed for it. The wall and blade sign are sufficient to identify the business. 3- J March 3, 2005 EXC-200S-03 DISCUSSION: Findin~s for Exception Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant an exception based upon the following findings: A. Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the spirit and intent of this title. The intent of the Sign Ordinance is to "provide architectural and aesthetic harmony of signs as they relate to building design" and to "provide [sign regulations] that will allow for good visibility for the public and the needs of the business...." The wall sign height is exceeded by eight inches due to the sign background. Staff believes the sign is attractive and is enhanced by the background. If the whole sign area were reduced to 18 inches, the letters would be too small. Blade signs have been approved in other projects, like Travigne, because they add to the pedestrian character of the development, in that they are strictly directed to pedestrians, not to auto traffic as typical wall signs are. The blade height (nine feet from grade) is adequate to allow pedestrian passage. B. The granting of the exception will not result in a condition that is materially detrimental to the public health, safety, or welfare. The signs do not create any health or safety problems. C. Least modification of the prescribed regulations and the minimum variance that will accomplish the purpose. The height of the wall sign provides adequate visibility for the lettering; a smaller size could result in letters too small to easily read. The length of the wall sign (8' 4") is less than that allowed by the ordinance (21 feet).
