regarding start-up pollution
First, not pertaining to your email, what is being done to prevent excessive pollution on
start-up of the cement plant at Lehigh Southwest / Heidelberg Cement in Cupertino? It
appears that these unexpected releases of pollutants are not included in the allowable
cumulative pollution. There have been many pollution events and I understand that
these are happening because there are multiple start-ups caused by unplanned
shutdowns due to unscheduled repairs. If the plant were in better condition, then there
wouldn’t be as many start-up pollution conditions.
A) what can be done to reduce pollution during start up?
B) what can be done to reduce the number of startups?
Second, in response to our email discussion below, I am dismayed to learn that BAAQMD
intends to exempt Lehigh Southwest from blasting dust. Previously, BAAQMD
erroneously assumed that there would be no dust from blasting because the blasting
would occur within the pit and consequently, set no limits. Now we know that this simply
isn’t true, dust is created during blasting. Unfortunately, the results are the same – do
nothing.
Consider that should Lehigh Southwest start a new surface mining operation, blasting
would commence entirely at the surface. Without any regulation in effect, thanks to
BAAQMD, the citizens of Cupertino will be victims of the dire effects of PM10 and PM2.5 -
reduced quality of life and longevity. Health effects include respiratory and
cardiovascular morbidity, such as aggravation of asthma, respiratory symptoms and an
increase in hospital admissions; and mortality from cardiovascular and respiratory

diseases and from lung cancer (see report from World Health Organization:

PM 2.5 is also associated with diabetes.

And, BAAQMD had a speaker that linked PMs to autism as well (I attended several years
ago).
I am proposing that BAAQMD put the health of its constituents ahead of corporate
greed. The staging of blasting to reduce blasting magnitude that you mentioned is
intriguing, perhaps more work could be done there. See the first attachment for
Permanente quarry blasts obtained from a USGS query (there could be events not at the
quarry, but most of them should be correct).
Please consider that the blasting at the Permanente Quarry is unprecedented in the
State of California in quantity, intensity, proximity to faults, and population (see second
document that I wrote a long time ago to the State Mining and Geology Board). I also
ran some data this morning in the Southern California region and focused only on those
in the Mojave and Tehachapi region as these would be more comparable (for example, I
eliminated Boron from the list because their blasts are of lower intensity due to the type
of material). You will see that about 34% of Permanente blasts are greater or equal to
1.5 magnitude, whereas 11% of southern region blasts are greater or equal to 1.5
magnitude. I think that we should consider reducing the magnitude of blasts in order to
reduce the quantity of fugitive dust.
Finally, while unrelated to air quality, I have made repeated requests to the State Mining
and Geology Board to re-map the area for geo-hazards. In a phone call with the State
Geologist, John Parrish (with myself and the late Bill Almon), he would not guarantee
that the blasting in the Sargent-Berrocal fault zone would not increase the likelihood of
earthquakes. This is in the last attachment and I hope that the City of Cupertino looks at
this as more homes in the area have been planned.

Hello – my name is Guy Gimlen. I am an Air Quality Engineer working in our Rule Development section at the Air
District. I have developed draft amendments to our existing Regulation 6, Particulate Matter; Rule 1: General

Requirements. I am responding to your questions from Ed Giacometti and Gary Lipari regarding the dust from blasting
at Lehigh Cement.
Dust from blasting is a difficult problem to solve. I participated in a Lehigh experiment to reduce dust from
blasting. They set up sprinklers at a blast site, and watered for approximately 8 hours before the scheduled blast. The
pre‐watering appeared to have almost no impact on the generation of dust, primarily because the watering only wetted
the top 1‐2 feet on the surface of the blast zone (approximately 10 – 15 feet deep). Lehigh does what is known as
“staged” blasting, where they stagger the blast by very small time increments (fractions of a second?). They rig each
row of blasting holes to detonate slightly after the previous row, so it creates a cascade effect rather than one big blast.
Regulation 9‐13‐304 requires specific fugitive dust control practices, including a requirement to develop a Fugitive Dust
Control Plan to use in training their people to recognize and control dust. The Air District is currently reviewing Lehigh’s
Fugitive Dust Control Plan, and will propose a control method to spray water mist on the dust as it is generated during a
blast. Water mist is the only practical approach available to reduce the dust, but it does not prevent the dust cloud. The
behavior of the dust cloud is very dependent on wind speed and wind direction. If the wind is still, the dust cloud can
linger above the blast zone for 10 – 15 minutes. If the wind is blowing, the dust will dissipate fairly quickly (within 1 – 2
minutes) but in these situations the dust can be carried directly into your local neighborhoods.
As an engineer amending existing regulations and writing new regulations, I must propose solutions that are technically
and economically feasible. I have not found a technically feasible method to control dust from blasting. As a result, I am
proposing to exempt blasting from the general requirements on fugitive dust that we are recommending in the
amendments to Regulation 6, Rule 1.
I recognize that my proposal does not satisfy your concerns, and does not solve your problem of dust from
blasting. Unfortunately, I can find no solution that is feasible.

I hope that I’m writing the right person.
I was at the Lehigh Southwest meeting tonight in Cupertino.
I’m not sure whether I’m writing about Regulation 2 Rule 6 or a different rule, but I was
dismayed to hear that dust from blasting doesn’t seem to be included in any of the new
rules.
We get quite a bit of dust from blasting at Lehigh Southwest.
I have gotten some photos over the years, however it is self-evident from the quantity
and seismicity of the blasts that there would be significant dust.
I had taken this up years ago at BAAQMD and had been assured by staff that this would
be addressed and they’d even consider water blasting.
Then people moved on and now I learned tonight that nothing happened.
I sincerely hope that you can do something.
Attached you will find a report generated from the USGS that closely represents the
quantity of quarry blasts over the past 5 years.

The coordinates used are: N: 37.351 S: 37.274 W: -122.158 E: -122.067
In the past 5 years, there have been approximately 375 quarry blasts at the Permanente
Quarry in Santa Clara County.
This averages out to more than 1 blast a week.
Between now and a year ago there were about 60 blasts.
There were a dozen events over a magnitude of 2, there was one event at a magnitude
of 2.9.
126 of these blasts, over a third of them, registered 1.5 in magnitude and above

Dear Director Testa, OMR, and DOC:
I am writing you once again regarding my concerns about the Lehigh Southwest Permanente Quarry, Santa Clara County.
I live about two and a quarter miles away from the quarry and many residents live closer. On October 2, 2013, I heard a
loud sound at home, there was a cracking sound in my home, and I felt many moving waves. My door casing was
cracked. I knew this was an earthquake and I was frightened. Was this the beginning of another earthquake? Was this
earthquake bigger elsewhere? Was my family safe? I went online and my fright turned to anger when I learned this was
a 2.4 magnitude quarry blast. I went onto USGS and learned that surface quakes are felt more strongly than deeper
quakes. Santa Clara County has no interest in this issue.
The quarry is adjacent to a highly populated area in an active fault zone.
The Berrocal Fault runs through the quarry, the Altamont Fault is adjacent to the quarry, the Monta Vista Fault is
nearby, and of course the San Andreas Fault is in the vicinity.
EIR’s pertaining to the Quarry falsely indicate that the Berrocal fault is “potentially active,” while EIRs for
other projects list the fault as active.
In 1973 there was an earthquake between 4.2 and 4.7 near Los Gatos High School on the Sargent‐Berrocal fault,
and there have been numerous earthquakes near the Stevens Creek Reservoir adjacent to the quarry. Source:

There are structures in the quarry area that are in a liquefaction zone and in a landslide zone.
In the past 9 months (looking back from October 2) there have been sixty‐two blasts, nineteen 1.8M or greater
and nine 2.0M or greater. This is unprecedented in the State of California in quantity, intensity, proximity to
faults and population. In the past 9 months, there has been blasting 1.8M or greater in the following areas: 19
Cupertino, 19 Boron, 9 Greenville, 9 Oroville, 8 Lake Almanor, and 5 Shasta. This data was obtained from
http://earthquake.usgs.gov/ (0 depth “earthquakes” are assumed to be blasts – quantity is approximate as it
was visually obtained).
1. Please explain how Lehigh is justified in downgrading the Berrocal Fault in EIRs.
2. What can the State do to protect the workers on site and the nearby population?
3. Can you guarantee that these blasts will not cause a slope failure into our adjacent park land (note there has
been a slope failure in the past into our County Park)?
4. Can you guarantee that these blasts will not cause an earthquake?
5. How does this reconcile with the Alquist‐Priolo Act?

Dear Mr. Testa,
I am writing you because I am concerned about human safety. I hope that you can engage the interest of your
colleagues at the Department of Conservation. The Alquist-Priolo maps* for the Sargent-Berrocal fault zone
pre-date the 1989 Loma Prieta earthquake and should be considered for revision. 18 new homes** and a large
structure at the Lehigh Southwest Cement Plant are planned in the highly populated area between Los Altos
Hills through Los Gatos. Please investigate natural and unnatural activity in this fault zone as it pertains to
human safety. As you know, I am very concerned about the unprecedented quantity and intensity of blasting at
the local quarry, which I have written to you about since last year.
The Loma Prieta Earthquake severely damaged nearby St. Joseph's
College, and a person was killed***. Ultimately, the entire college
was demolished. Since then, this fault area, adjacent to the San
Andreas Fault, has garnered new interest by geologists. The
Sargent-Berrocal fault zone extends through to Los Gatos where
there was a 4.2 to 4.7 earthquake near Los Gatos High School
between 1969 and 1973. And there have been earthquakes adjacent
to the Stevens Creek Reservoir. Sadly, fish caught there must be
released due to high concentrations of mercury in the water.
Residents believe that this is due to the adjacent quarrying activity.
Bad things happen when the State of California does not take action. Below is a farm house adjacent to the old
Permanente Metals headquarters, later Kaiser Aluminum. The quarry next door bought the land. Buildings with
a toxic history were demolished without the required inspections by the county. Now the area is covered by a
mountain of mining waste, in what was outside of Lehigh Southwest’s reclamation plan area. Following years of
public outcry, Santa Clara County legitimized it retroactively. Now, the home is uninhabitable and our water
quality is at risk. This could have and should have been prevented. Who will clean up our water???
Let’s not let history repeat itself. Please investigate the Sargent-Berrocal fault zone to protect human safety.
