City Clerk read Ordinance 120. Councilman Lazaneo left meeting at 8:JO P.M. Councilman Pelosi asked if the intention is to buffer area with R-J-H, to which Councilman Saich replied that it would depend upon master plan for area. Councilman Pelosi expressed concern about number of R-J-H develop_ ments planned in the City. City Manager was instructed to notify Planning Consultant regarding Council's desire for additional information regarding types of buffering adjacent to C_l_H zones and also an opinion regarding number of R-J-H developments proposed in relation to size of City. 6. Ordinance 121 amending Ordinance 89, Sign Ordinance, as recommended by the Planning Commission. First Reading. City ¡ttorney read Ordinance 121. 7. Mr. John Rodrigues, applicant . stated that since last meeting applicants have executed new leases on the property for a period of 25 years and have obtained signed dedications of real property from the owners of the property and the lessee. Mr. Rodrigues introduced Mr. Giskie, central California district ~~nager for Mobil Oil and Mr. Haynes, also of Mobil Oil Co. Mr. Haynes reported that new lease agreements have been processed in Los ~,eles and have b~en sent to New York office and that they expect to receive an answer from New York within two or three days. Mr. Haynes appreciates the City's position in matter and requested that they be allowed two or three days to present consent from New York. City Attorney stated that condem- nation proceedings have been prepared and suit does not include Mobil Oil or Rodrigues property. A delay of a few days would not damage suit. Motion by Councilman Pelosi that meeting be adjourned until 4 p.m., Thursday, March 24, 1960 in order to grónt applicant three additional days in which to secure consent from Mobil Oil Company. Councilman Pelosi suggested that wording of ordinance be changed to reql"ire that Commissioners by residents of the City of Cuper- tino. Councilman Wilson stated that the intention of the Council is to extend representation to non-residentis of the City who are customers of the City Water Department. V. PLA1~ING CO}~ISSION ACTIONS REQUIRING COUNCIL ACTION 1. Tentative map of Cook and Wilson: 76 lots on 25 acres east side of Mountain View_Stevens Creek Road; 10,000 sq, ft. lots approved at Special Meeting of Planning Commission. City ~a~ger reported that a special meeting of the Planning Commission had been called on March 15. but that another meeting, for which notice had been given, was called in the afternoon, March 21. At this meeting the Planning Commission approved tentative map. City Attorney asked what the vote had been. City Clerk reported that meet- ing convened at 5:30 p.m. and that a quorum was preseht. The vote was 4_1 42 to adopt motion which was made and carried at meeting of March 15. City Clerk read Planning Commission motion. r- ~ <:::: - tI: Motion by Councilman Wilson that the Cook and Wilson Tract for R-l develop- ment, west bank of Stevens Creek and adjacent to tract 1456 be approved, Councilnan Pelosi felt that maps should be acted upon separately. City Engineer stated that his recommendation was that a pedestrian walk be pro- vided on one side of the street. City Clerk reported letter recieved from developer requesting elimination of sidewalks and another letter from applicants stating that pedestrian walkway should be provided between Lots 31 and 32, rather than a second one, as indioated in Planning Commission Minutes. City ClErk read recommend2tions of the City Engineer. City Attorney stated that Planning Commission should be advised that ordinance provides that action of the Planning Commission should be shown on the fact of all tentative l1I ips, He suggested that the City acquire a stamp for this purpose. City Engineer stated that engineering department preparing tentative maps can make provision on face of map for the purpose of record- ing Planning Commission action. Councilman Wilson withdrew motion. City Engineer again stated that consideration should be given to matter of pedestrian walkways. Mr. R. J. Wilson, applicant, stated that they have been working with the schools but if it is the feeling of the Planning Commission or the Council that a sidewalk be provided, the applicants will do so. Motion by Councilman Wilson that tentative map for Tract 2527 for R-l development be approved. Seconded by Pelosi. REPORTS OF OFFICERS AND COMMISSIONERS A. Report of Road Commissioner _ No report B. Report of Police and Fire Chief _ No report C. Report of Recreation Commissioner Councilman Pelosi stated that he had priced portable bleachers and a price of $250.00 for five rows had been determined. After discussion with Mr. Benevich it was decided that portable bleachers would give the City greater service since they could be moved within the City for various activities. He stated that two sections of bleachers are contemphted at the Collins School but be wishes to invite other bids. Councilman Pelosi reported that there will be another meeting with the School District to determine if other summer progr.ms are possible. He stated that he had been approached by officials of the Community Center and they requested that the City take over the Center as a major part of its recreation program. Councilman Pelosi will make a report to the City Council on this matter at the next meeting. D. Report of City Treasurer Councilman Pelosi reported statement from State Board of Equalization, statement of local tax distributions for period 11/7/59 to 2/5/60, Cupertino's share, $6,907.31; report from Office of the Controller, fines collected during month of February, Cupertino's share $787.00; letter from Bank of America Trust Department; City of Cupertino Cash balances 2)29/60; State- ment of Expenditures 1/1/60 _ 3/1/60; Statement of Receipts. E. Report of City ~~nager City Manager reported on suggestion of attaching fee to tracts being deveioped in Cupertino for use as parks. This would not be possible under present City policy on business licenses, but he has written to League of California Cities requesting information in regard to using acreage adjacent to school sites and will make report when information is received. City Hamager report- ed traffic survey conducted by County Sheriff's Dept. at Blaney Avenue and Stevens Creek. City Engineer stated that he requested power company to move poles on Blaney which obstruct traffic but company will not move just one pole since this will make a jog in line. Councilman Pelosi stated that at time Burger Pit addit~on was made, applicants pleaded hardship but stated that when improvements were installed they would make their improvements. City Attorney stated that he and City Engineer suggested a compromise arrange- ment in this particular case but that approval for addition to Burger Pit was granted by Planning Commiseion without commitments. City Attorney stated that improvements could be required when opposite side of street is improved and he feels that Burger Pit would not be advErse to improvements or an assessment district. City Manager suggested that all plans submitted to the Planning Commission having to do with off-site improvements be refer- red to the Council since it constitutes a policy matter. City Engineer stated that he had experienced no problems in this regard and in the case of gas stations, the applicant's engineers submit improvement plans which his department checks prior to the issuance of a building permit. Mayor instructed City Engineer to talk with owners of the Burger Pit to see if they will ?ut in improvements on Stevens Creek. Councilman Pelosi stated that if owner of a separate parcel obtains a building permit, construction can be started and City has no assurance of improvements. City Engineer stated that Building Ins~ector will not sign building permit until Engineer has granted site approval and until bonds have been posted by applicant. City Manager reported that he, hr. Smeltzer and an engineer from a traffic signal company have laid out tentative plans for the signalization at Ydller and Stevens Creek and a report and estimate will be surnbitted at next meet- ing. City Manager reported request made by Chamber of Commerce for donation of $1,500 for year 1960-61. After checking City finances City ~~nager stated that City could assist Chamber of Commerce for the balance of fiscal year in the amount of $500.00 ¥~. John Rodrigues, President, stated that the Chamber is attempting to establish a local office with steady part-time help. Mr. Rodrigues stated that $500 would carry them through to the 1st of July. Motion by Councilman Lazaneo that $500.00 be appropriated to the Chamber of Commerce for the period ending June 30, 1960. Seconded by Wilson. Mr, Rodrigues stated that he would be happy to furnish this. City Manager reported that a Mr. Frank Moreno has requested a business lic- ense to operate a tow truck service in Cupertino. The operation is AAA and in time, the operator hopes to mvve into Cupertino. He is presently working and living in Sunnyvale. Councilman Lazaneo asked City Attorney if there 45 w~s ~ny objection to issuing ~ business license. City Attorney st~ted th~t if oper~tor w~nts to est~blish pl~ce of business in the City this would require insurance, etc. If he is an outside businessman coming into the City a business lincense would do but he should be ~w~re of all requirements if he locates in the City. Motion by Councilman Lazaneo that City ¥~nager be authorized to check with Mr. Moreno and issue a business license subject to conditions prev~iling for tww truck service. Seconded by Pelosi. City Manager stated that an ordinance should cover tow trucks in the same manner as those which provide regulations for taxi- cabs. Councilman Pelosi asked if policy of other èities in issuing gar- b~ge contracts is to issue franchise for period of five years with a five year option. City Attorney stated that he would recommend a five year con- tract but not a five year option. City Manager stated that contractor has requested incre~se in rates which he considers reasonable. however, contract_ or would be required to collect additional small amounts of garbage and trash without additional charge. M¡¡¡or asked if contractors had been informed of this condition. City Manager ~n~wered that he had not contacted contract- ors until action w~s taken by Council. City Manager w~s ~uthorized to dis_ cuss new contr~ct with contractors to determine if they ~gree with condi- tions of renewing contr~ct. F. Report of City Attorney City Attorney stated that ewinent domain suit is now oeing prepared and he is ~w~iting ~n appraisal. He recommended that the services of Mr. Dougherty be obtained, but in the event that t~is is not possible, he requested auth- orization from the Council to obtain an apprais~l from ~n inoependent app- r~iBer. Nath~nson Nays: None Absent: None Motion Carried: 5~0. City Attorney reported letter received from Assembly Interim Committee requesting appeRrance before their Committee regarding annexa,tion. City Attorney recommended that City not make submission because of expense in- volved and also because City has no particular bill which it is endorsing. Motion by Councilman Saich that City Attorney be instructed to answer letter from Mr. Curtin, Assembly Interim Comæittee, advising him that City of Cuper- tino has no position to take at present time. Motion by Councilman Wilson that City Clerk be authorized to execute docu- ments withdrawing property within the Alves W~ter Line and the Monta Vista Water Works from the County tax rolls. Report of City Engineer City Engineer posted plan of proposed commercial development on Rodrigues Avenue and said that the question to be determined is what type of improve- ments should be requested since Highway 9 is not widened and there is now an existing service road. Mr. John Rodrigues, applicant , stated that development plans were started while under County jurisdiction and County required the service road. If curb is installed now it .~ll be in the center of the service road and he 46 ¡... ~ ~ - = feels that the job could be done at the same time street is widened. Mr. Rodrigues stated that he will put curbs and gutters in on Rodrigues and that sidewalks would also be put in if required. Councilman Pelosi cited cases in other commercial developments where curbs were required and stated that the requirement should apply to all developments. City Attorney stated that in a pre-existing ar(,~, improvements can be acquired by an assessment dis- trict but the question of a building on a recorded lot is whether this con- sititues a new subdivision. City Attorney stated that it would be doubtful tha,t curbs and gutters could be a requirement for existing structures, such as Town and Country, but this would be possible on a new building. Councilman Sa,ich felt that the curb line could be set on Highway 9 and re- mainder of service road could be dediceted back to property owners when the time is right. Mr. Rodrigues agreed with this. Councilman Lazaneo asked Mr, Roòrigues if he intended to put sidewalks in on Rodrigues. Mr. Rodrigues answered that he did. Mr. Rodrigues inquired about paving on service road. City Engin~~r said that improvement plans would have to be submitted for checking. Mr, Rodrigues asked if there is a Fossibility that they will have to improve Rodri,gues Ave. He stated that they are willing to install curbs, gutters and sidewalks but feels that it is un_ reasonable to require improvement of service road and requested City Engineer to check grades to determine extent of paving necessary. Councilman Pelosi asked if parking space requirements had been met. City Manager answered that City Planner had approved plans. City Engineer stated that he had received telephone call from San Jose stating their position on cooperetive project on Blaney Avenue. San Jose is not willing to enter into joint pro- ject with Cupertino, but upon completion of work by Cupertino, San Jose will do work in San Jose. They will not install curbs and gutters. City Engin_ eer said City could drop project entirely, let City portion of job out to bid at an approximate cost of $3.500 or wait for an assessment district in this area. Councilman Wilson suggested paving street and eliminating curbs and gutters. City Engineer said a temporary grading job could be done at an approximate cost of $1.000. City Engineer reported that bids for the storm drain on Stevens Creek Blvd. and Highway 9 had been opened earlier in the afternoon and bid had been awarded to Bilardi Construction Inc. for $5,555.55. City Engineer read Resolution 280 authorizing work to be done on the City of Cupertino Saratoga-Sunnyvale rtoad Storm Drain No. 1 and ex- ecution of contracts therefor. Motion by Councilman Lazaneo th2t Resolution 280 be approved. Seconded by Saich. Ayes: Lazaneo, Pelosi, Saich, Wilson, Nathanson Nays: None Absent: None Motion Carried: 5-0 City Engine,er reported that he has received request for acceptance of im- provements for Tract 2346 Westacres Subdivision. and that he recommends acceptance subject to a one ye..: tond period, Councilmn Pelosi asked about street cleaning. Motion by Councilman Saich that improvements for Tract 2346, Westacres Subdivision. be accepted subject to street cleaning deposit of $25.00 per lot on remain:ng lots. Seconded by Pelosi. Mr. Rodrigues stated that there are ten or twelve houses remaining but that they have a bond covering them. His development is 50% complete and asked if $25.00 is to be deposited per lot to assure that people do not dirty up street. Councilman Saich stated that developers are sometimes carelðss and leave dirt ,and debris in sub- divisions and the City should not have to clean it up. City Engineer stated that his original request for clean up deposit was for another subdivision but that they have not experienced difficulty in Westacres regarding street cleaning and for that reason, he did not require street clean up deposit. Councilman Wilson auggested leaving off requirement of deposit. City Attorney raised the question of applying rule to one subdivision and not to another. Councilman Pelosi stated that deposit would be refunded after completion of subdivision. City Manager stated that Council had already set policy and should follow it thDough. Motion by Councilman Saich that improvements for Tract 2)46, Westacree.. be accepted with provision for a deposit of $25.00 per lot for each lot. this amount to be refunded to the developer after completion if streets are left in satisfacÐory condition. 4~1 Ayes: Laz.neo, Pelosi, Saicp. Nathanson Nays: Wilson Absent: None Motion Carried: 4-1 Mr. Rodrigues asked when money would be refunded. City Engineer said it would be refunded after completion of the last house in the tract. Mr. Rodrigues asked if deposit could be requisted upon application for a build- ing permit since many lots are sold to individual builders. Councilman Pelosi felt deposit should be made when builder subdivides. City Attorney stated that by this method the money would be tied up for a year or more until final completion, City Manager suggested that deposit for clean up could be on an administrative level in that City Engineer còuld recommend to Council that refunds be granted on particular lots if Engineer ascertains that streets will be left in satisfactory condition. City Engineer reported request for extension of time on Homestead Drain. Motion Qy Councilman Lazaneo that a 60 day extension be granted on Homestead Drain. Seconded Qy Pelosi. City Engineer stated that at time Stevens Creek is improved, a dividing strip could be set up at Wolfe Road or that Richwood Drive could be extended to the east to intersect Wolfe, and East Estates Drive would eventually be closed and used as an access street for the shopping center. Wolfe Road could also be aligned and come into Stevens Creek at not too sharp a curve.
