II. Moved by Councilman Pelosi that the Mayor and City Clerk be authorized
to sign the Agreement by and between the State Dep~rtment of Finance
and the City of Cupertino(form CIE2); second by Councilm~n Saich,
c~rried 3-0.
III. APPLICATJON OF JOHN RODRJGUES JR., ET AL: Also concerning signaliz~,tion
~nd ch~nnelization of the intersection of Homestead Road and Highway 9.
Mr. Rodrigues presented the papers, which he s~id were now in order,
furnishing the City with the necessary dedications, easements, and
supporting documents.
The City Engineer and City Attorney ~dvised that the papers are
in order and recommended their execution and acceptance.
Discussion developed and the City Engineer ~nd City Attorney briefed
the Council on the details of the agreement with respect to previous
considerations.
Moved by Councilman Saich that Resolution 281 be adopted, a re-
solution of the City Council of the City of Cupertino Authorizing the
Execution of an Agreement by the Mayor and the City Clerk. Second by
Councilman Pelosi, carried 3-0.
Thereupon the Right Of Way and Construction Agreement so authorized
by Resolution 281 was signed, sealed, and executed by the }~yor and City
Clerk.
Moved by Councilman Saich that Resolution 282 be adopted being a
Resolution of The City Council of the City of Cupertino Accepting
Dedication of Real Property from W. H. Field III, Earl T. Fischer,
M. P. Kiper, and John Rodrigues Jr.; second by Councilman Pelosi, carried
3-0.
Discussion developed relative to adoption of Ordinance 113 an
Ordinance of the City of Cupertino Amending Section 1 of Ordinance No.
2 by Reclassifying A Certain Portion of the City of Cupertino From an
A-2:B.4 to ~ C.l.H District. The discussion concerned the conditions
adopted by the Planning Commission in recommending the applic~tion of
John Rodrigues Jr., et al for rezoning of property located ~t or near
the northwest corner of the intersection of Homestead Road and State
Sign Route 9. Discussion ~lso concerned the diagram submitted with the
application, depicting a bowling alley, restaurant and cocktail lounge,
tennis courts, pool, and allied uses. No tentative map was submitted
with the application and the question which arose is whether or not
the Council will limit the use of such com~ercial property to the uses
contemplated and shown by the applicants at the time of public hearings.
Recess was declared.
The meeting reconvened. The Mayor tabled the consider~tion of
Ordinance 113 so that a tentative map can be pl~ced before the City of
Cupertino Planning Commission at its next regular meeting, March 28;
then have the same matter before the City Council at its next regular
meeting, April 4.
IV. Ordinance No. 005B, an Ordinance of the City of Cupertino Amending
Ordinance No. 005 as Amended by Ordinance OOSA Relating To Establish.
ment of City Planning Commission Members, was introduced and given first
reading.
The amendment provides that "each member (of the Planning Commission)
shall be a qualified elector in and resident of the City of Cupertino."
V. Councilman Pelosi referred to the headline and story in the March 22
issue of the Santa Clara Journal and stated that further clarification
of this matter should be forthcoming at the next regular meetini, to
the effect that the City is not bankrupt.
