VI. PLANNING COMV:ISSION ACTIONS REQUIRING COUNCIL ACTION
1. Ward Crump tentative map. Mayor asked if anyone in audience wished to
speak on proposed map.
Mr. James Nudelman, 10574 N. Blaney Ave., stcted that his property is
immediately north of property under consideration. He ob2ects to approval

of tentative map until a general neighborhood plan is worked out in
order to prepare proper street plan with Crump development. Mr. Nudelman
presented a petition signed by six property owners to the north request-
ing that approval be delayed until such time as neighborhood to the
north is considereå. City Clerk read petition,

City Engineer stated that since property in area is chopped up and because
it cannot be determined if all of property will be developed at the same
time, perhaps a study should be made, Mr, Ward Crump, 10601 S, nighway 9.
developer, stated that map originally summitted blocked out property of
Wigner and Kishimoto and that only a small private road was left to
serve properties. The Planning Commission requested that he get to-
gether with the property owners to see if something could be worked
out to properly develop the property, The map which he subm,~ted meets
with the approval of the two property owners but does not meet with the
recommendations of the Engineering Department. ~œ, Crump said that he
submitted another map which would allow for improvement of Blaney Ave.
He has made a study of the area to indicate the possible future develop-
ment of the properties to the north. Mr. Crump feels that subdivision
map submitted leaves property owners to the north in a better position
than they were with the neighborhood plan, which has not yet been adopted.
Mr. Lazaneo asked applicant if he would make improvements if map submitted
were approved. Mr. Crump stated that he plans to improve streets up
to the center of Blaney Ave, He does not intend to leave the City with
half streets, Mr, Kishimoto's attorney has indicated that they would
like to have him improve their portion of the propery, and he has discussed
with Mr. Wigner the possibility of improving land fronting on their
property.

Mr, Don McKay, McKay and Somps, stated that in order to allow the property
to develop, the map had to be drawn up as it was, He stated that as far
as slivers of land are concerned, it is a simple matter to exchange
undeveloped property and also pointed out that there is no drainage or
sewer problem. The map was drawn to accomodate property owners and not
only to get more lots. Mr, Nudelman was in aRreement with Mr. Crump
that property owners should be considered and this is reason for objection--
they had not been consulted.
Motion by Councilman Saich that Tentative Map, Ward Crump, be returned
to the Planning Commission and City Engineer for further study. Seconded
by Benetti.

VIII, PROTESTS AND WRITTEN COMMUNICATIONS
1. Boundary Commission of Santa Clara County, June 3, 1960 regarding
five annexations to Sunnyvale.

is deadline for right of way acquisition if State is to widen Highway
9.
City Attorney reported that there is an association of property owners
along Highway 9 and also that no action has been taken by the County
on the City's resolution regarding the widening of Highway 9, The
State has made a t~ntative commitment that they will put a certain
sum of money into this particular improvement and the County will
also place a certain amount of money into the project, After conferrfung
with Mr, Harrismn in San Francisco, it is his recommendation to use
the 1903 street opening act to acquire rights of way for delivery to
the State. It would then be necessary to use the 1915 bond act which
would permit the issuance of bonds to protect property owners. If the
City sees fit to raise money to put into the widening, the City could
put an additional item into the budget, adding to the tax rate, This
would reach into the pockets of potential users of Highway 9. By
using 1903 and 1915 acts, the assessment against each property owner
would be a credit against his bond and would lighten the burden on
theowner. City Attorney stated, however, that property owners have
taken position that the State should pay half and the County should
pay half and that the State should pay for the entire cost of improve-
ment. Ci ty Attorney felt Uat it .muld be impossible for City to
raise funds to buy rights of way from Homestead to Bollinger and that
since, legally, the property owners will benefit, by increased land
value, a substantial part of the cost should be given by the property
owners but that a tax increase should also be made, At present there
is nothing the City can do but wait to see if the State will be willing
to delay action.

IX. ORAL COY~UNICATIONS
Mr, A. T. Cook, Wilson and Cook developers, reviewed that the question
has been raised, in regard to map submitted to the Cmuncil for approval,
as to the improvements which would be required along Mountain View-
Stevens Creek Road. Mr, Cook stated that the County takes the point
of view that dedication is sufficient for improvements, and though
he feels that Mountain View_Stevens Creek should be widened, he feels
that they should be required to dedicate land necessary tc widen it to
90'. Mr, Cook requested an answer of policy on this matter sincá they
are preparing plans for their second unit and this is the property
that frortt Mountain View_Stevßn8 Creek Road. Mayor asked what provisions
were made for pedestrian traffic. Mr. Cook stated that there"will not
be much pedestrian traffic but that provision could be made if Council

Dr. J. Brown, 10365 N. Highway 9 stated that he would like to see the
City take a more active part in the County hearings regarding the widen-
ing of Highway 9 and reported that the next meeting is scheduled for
June 14th at 2:00 p.m., Board of Supervisors Chambers, Mayor instructed
City Manager to attend meeting on Highway 9, June 14. 1960. Mr. Brown
stated that some figures on possible acquisition costs would be helpful
to property owners who will be present at meeting. City Manager stated
that it would not be advisable to estimate the value of this proDerty
at this time, however, he did agree that the information is needed.
X. REPORTS OF OFFICERS AND COMMISSIONE~S
A. Councilman Saich reported that he will attend Trafficways Committee
meeting June 8, 1960.
B. No report.
C. City Clerk was instructed to write to Secretary of Sanitary Dist-
rict requesting notice of meetings and also requesting copy of Agenda.
D. Councilman Benetti reported that at meeting May 17. Mr. Dunfield
was elected Chairman and Mrs. Ravizza elected Secretary of the Recrea-
tion Commission. The Cow~ission requested authorization to join the
California Recreation Society, membership fee, $10.00 The first steps
to build a ball Lark at the Collins School were completed and Mr. Atkin-
son will appear at the June 8th meeting to act as liaison officer
between the School Board and the City. Councilman Benetti reported
on the discussion held in Berkeley regaring recreation program in Fresno
and suggested that a similar program could be worked out in Cupertino
whereby school parks could be used for City recreation programs.
Motion by Councilman Saich that $10.00 membership fee be appropriated
for the Recreation Commission to jóin the California Recreation Society.

for right of use of Alves Line easement for the installation of a sani_
tary sewer by the Cupertino Sanitary District of Santa Clara County be

City Manager reported receipt of Agreement from Association of Bay
Area Goverr.ments and By_laws. He stated that San Francisco has declined
to join Association, and it would appear that Association could not
survive without membership of San Franicsco.
City Manager reported that everything was in order to grant permission
to Permanente to relocate their pump on City property at Stevens
Creek. He suggested that approval be granted subject to a review of
an agreement by the City Attorney that would be prepared by Fermente.

G. City Attorney reported that he has prepared an Ordinance revising
procedures for variances and rezonings. He suggested that Ordinance
C02(a) (Revised) be de~ivered ~o the City Manager for direction to the
Planning Commission with the request that the Planning Commis~ion set
it for public hearing. Upon recommendation of the Planning Commission
the Ordinance would then be referred to the Council and the final
hearing could be held. City Attorney reported a meeting with the
City Manager and Planning Consultant regarding Planning Comm~ssion
problems and in order to facilitiate mechanics, he has prepared standard
resolution forms for referring Planning Commission matters to the Council.
After Planning Commission has studied and approved resolution forms,
they will be referred to the Council for approval.
Motion by Councilman Saich that Ordinance 002(a) (Revised) be referred
to the City Manafer for distribution to the Planning Co'mission.

City Attorney reported the matter of an overpasS in the City of
Mountain View presented to the last meeting of the PUC. The City
of Mountain View raised the question of the effect that adjoining
cities would have on the overpass and felt that adjoining cities should
pay for part of the overpass. Since the PUC has power to designate
which cities shall bear expense, City Attorney suggested that City
go on record to the PUC protesting inclusion in construction of over-
pass. City Attorney read Resolution 328 protesting the inclusion of
the City in application No. 41467 before the Public Utilities Commission
in the matter of the "San Antonio Avenue Overpass".
Motion by Councilman Saich that Resolution 328 be adopted and forwarded
to all parties concerned. Seconded by Benetti.

H. Mr. Joþn Rodrigues, Jr., reviewed the questions involved in the
construction of his commercial building, Rodrigues Ave. and Highway 9.
Mr. Rodrigues stated that he has received a bid of $20,000 to $25,000
for improvements he will make and requested that the City pay engineer-
ing fees of $2,500 for street improvements. The question of the storm
sewer was also raised, he stated, and it was his feelin~ that with another
commercial building and possibly another subdivision being built behind
the commercial development, that the storm sewer should be put in before
the street improvements. Councilman Saich stated that the City could
, not construct a storm sewer at this time. Councilman Lazaneo felt that
the City's contribution would be the dedication back to Pæ, Rodrigues
of 25'. Mr. Rodrigues stated that he would not gain additional parking
with the 25' and that he would have to resurface the 25' which would
be an additional expense. Councilman Benetti asked for City Manger's
comments. City fíanager stated that he would like to see this area
improved and also improved up to the Wilson property~ He stated that

he would like to see the Council talk with the applicant about contin_
uning on to the Hardware store. Mr, Rodrigues stated that he is not
prepared to move the building, Councilman Lazaneo was opposed to the
City paying engineering costs. Mayor stated that other areas on
Highway 9 have dedicated property to the City and they could then
request like treatment. Mr. Rodrigues stated that he will be spend_
ing +20,000 to improve property that is not his but that is City property.
Councilman Benetti suggested a study session Saturday morning. Mr.
Rodrigues stated that he would like an answer since the building has
already been leased and lessees are concerned about OCcupancy. Mayor
advised Mr. Rodrigues to go along with mis original plan to improve street
in front of bUilding along Rodrigues Ave. and Highway 9,
City Attorney brought up matter of quitclaim deed for property on Home_
stead Road and Highway 9, stating that the wording of the Deed was
in error and that the title company requested that it be redone. He
stated that it was in order for the Mayor and the City Clerk be
execute the deed.
Motion by Councilman Lazaneo that City accept the standard form of
dedication, Homestead Road and Highway 9. Seconded by Saich.

City Engineer reported that he will send sketches to members of the
Felton Park Homeo,rners Association in. relation to an assessment
district, The State has notified his office that they want an
indication from Sunnyvale regarding Mary Avenue and also from the County
regarding Wolfe Road. City Engineer recommended that the CO\Ìncil
review the importance of the Mary Avenue grade separation and authorize
the City Manager to take whatever steps are necessary to proceed to the
Highway Commission.
Motion by Councilman Saich that City Manager be authorized to hold
meetings with the State and any official bodies with regard to Mary
Avenue. Seconded by Lazaneo.

City £ngineer requested that he be present at meeting relative to
budget of funds for public expenditures.
XI. UNFINISHED BUSINESS
Councilman Lazaneo asked about weeds on property next to Mandellas.
City Hanager reported that property owners have been notified and this
is all that can be done at thepresent time but he will talk to the
property owners to see about correcting situation. Councilman Saich
asked about street signs. City Manager stated that a recommendation
regarding street signs has been included in the Budget, Mayor asked
about street naming. City Manager was to notify Planning Commission
of policy on street naming. Councilman Benetti requested that maps
showing area involved be attached to ordinances.
Mayor asked about garbage collection by Mr. Alarcon. City Manager
stated that he will send another reco~~endation to the Council, ~~yor
read appeal of Sam Fox in matter of Gas Station, KiFwin and Highway 9.
Motion by Councimman Benetti that Communication be received and filed.
Seconded by Lazaneo.
