JUNE 23, 1960 TO JULY I, 1960 Meeting was called to order at 8:00 p.m., July I, 1960 RCLL CALL: Councilman Present: Councilmen Absent: Benetti, Saich, Pelosi Lazaneo, Nathanson Mayor asked Council if they had reviewed the revised Budget. Councilman Benetti said that he had received his late that afternoon and had not had an opportunity to go over it carefully. The hayor stated that he had also received his this afternoon but that he had looked at it and had one comment. The $300.00 additional salary per year for the City Engineer. He asked why this had not been included. City Manager stated that this amount was to be given to the City Engineer if he concurred with the City Council in that he would attend both the Council meetings and the Planning Commission meetings. The Mayor said that he had talked to Nr. Fleming and the Nr. Fleming was a¡creeable. The Budget for the City Engineer's retainer was increased $600.00 a year, which changed the total budget request for all departments from $230,338 to $230,938. Mayor asked about the drainage fund as sho"~ on the estimated revenues. City Manager stated that this fund is shown as a revenue but it is entirely separate from any general fund expenditures__it is used only when theCity Council draws expenditures from it. The City Manager then brought up the matter of the League of Californa Cities convention in Los Angeles to be held October 23, to 26. The Council apTE,ed that they should attend this meeting. Councilman Benetti moved that the City Manager should make reservations for the convention. Seconded by Pelosi, carried by voice vote. The Mayor brought up the matter of subcontractors and their obtaining business licenses. He mentioned that a contractor, who is building in Westacres, had complained about the fact that he could not et final inspection on his homes, because a couple of his subcontractors had not taken out City business lieenses. The contractor agreed that the Ordinance should be followed and that he was not aware of the fact that business licenses had not been obtained by these frrms. The contractor stated that it would be impossible for him, at thi.s late date, to obtain the licenses. The Hayor stated that the contractor was a reliable, conscientious businessman and that he "ould no doubt follow closely the conditions of the ordinance. Inasmuch as it "JOuld be difficult for the contractor to obtain these licenses, he thought that the relief should be given and that final inspection of homes should be made. Councilman Seich moved that the City ì'lanager be instructed to notify the Chief Building Inspector that final inspections be made of the homes. Seconded by Benetti and carried. The Mayor made a further comment on Ordinance 10, which is the business license ordinance, stating that the Building Department will have a stamp that will show on the plans and other documents relating to tract or home building, that Ordinance 10 has been adhered to and that all of the subcontractors and firms having business with the contractor have taken out business licenses. Mayor made a brief comment on the Agenda for July 5th. to know if they could discuss some of the ma.tters now. no objection but he thought that inasmuch as the Agenda should be discussed at that time. Councilman Benetti wanted The Mayor said there was was for the 5th, that matters Councilman Saich then brought up the matter of the high fill that had been placed where a service station is being constructed on the corner Stelling and Stevens Creek. He said that this Ligh grade will effect adjacent property and that a careful chck should be æade of perticularly service stations ,rr10 do have a.habit of wanting their imDrove"ents set UT: high and not seem to be too concerned about adjacent property owners. Councilman Saich asked that the grade be checked at tLis station. Mayor Pelosi commented on the matter of use permits and their final determination by the Plannin¡' Commission without the Council havin~ some say in the matter of use permits. He mentioned particularly the service station thót is to be located at StevensCreek and East Estates Drive. He mentioned that the'people in Idlewild were very much oppòsed to this service station and if the service stction has been given a use permit and the final say and authority is vested only in the Planning Commission, then the Council, wLo represent the people, cnnot assist the people who "ill be affected by the conditions of a use permit. It was the ¡'layor's thinking that ",hen there is justified opposition relating· to use permits that the City Council should have an opportunity to review them with 111 the particular idea that residents who do object can make an appeal to the Council. he recorc,mended tha t the ordinance on use permits be ammended in order that the Council may have an opportunity to check them. Councilman Benetti asked if the Urich service station that is being constructec;! on the corner of Blaney and Stevens Creek waS following the plans as submitted and approved. He asked that this be checked. The Mayor then commented on H control and wanted to know if the Council had any comments to make regarding it. It was the Mayor's feeling that in addition to the tentative map. a rendering of the proposed development should be sub- mitted at the same time so that both the Planning Commission and the Council would have some ioea of what the developer was planning to construct. The Mayor commented on the matter of Lot houses being developed in the Cuper- tino area. Be stated that this had bee;! a matter of some concern to him and he felt now is the time to place this type of activity under a rigid control. He suggested that an ordinance be prepared that would control hot house develop- ments. He defined hot houses as the places where chrysanthemums are grown under a frame that is covered with a plastic material. He feels that these stuck up in residential, oradjacent to residential areas are unsightly and should have the Planning Commission and the Council's strict attention. The Mayor then commented on a discussion that was had at the recent Mayor's and Councilmen's meeting in Berkeley relative to the construction of apart- ment housing where they would have 50 or 100 units and not prepare adequate parking for the tenants. This situation in other areas Las created the use of public streets for parking making a very difficult situation for both the City and people who are looking for a parking Dlace. It was stated that in any municipal development in Cupertino the parking requirements should be con- sidered very carefully. Councilman Saich stated that Redwood City had a very good ordinance on this tpe of parking. Councilman Benetti stated that he thought a check should be made to determine just what percentage of the City should be multiple dwelling. He requested that an investigation be made on this matter. Mayor stated that he has received complaints regarding the park- ing in front of the bank and the stores on the east side of Highway 9 and immediately soutL of Stevens Creek Road. The parking is diagonal and has caused many near accidents and if some correction is not made soon, a bad accident is going to take place. Councilman Saich stated that the bank is going to remove the Hing¡.;alls that they had placed in front of the bank and eliminate diagonal parking and go into parallel parking. The ~~yor also mentioned that the bank was clearing a lot next door to the bank which is to be used for parking. This may tend to eliminate the parking in front of the bank. Councilman Benetti then mentioned about City recreation, particularly recreation that was needed in new tract developments. He stated that he had talked with Cook & Wilson Hho are now developing property in the Monta Vista area, about having some recreation facilities included in their plans. he said that Mr. Cook seemed willing and wanted to know what Councilman Benetti had in mind. Mr. Cook waS asked to attend the recreation commission meeting of July 6, but was out of town and could not be ,·.resent. Councilman Benetti also stated that a letter should be sent to developers re¡arding plans for recreation in their tracts. Meeting adjourned 9:45 p.m., Friday, July 1, 1960. i~L ,,( ut~
