Mountain View_Stevens Creek Road:
The Mayor read the memo from Co~issione ·s Adamo, Bagar, and Snyder
of the Planning Commission on the subject of improvements to Mountain View-
Stevens Creek Road. The recommendations called for a cross section consist-
ing of four 12' traffic lanes, a 6' dividing strip, two 8' parking lanes
with curb and sidewalk construction; the 5' rlanting strip between the side-
walk and fence should be of the grape_stake type construction with brick
pillars every 25', lighting in accordance with City standards.
The conclusion of the three man cow"nittee is that the improvement
should be made by the developers of the property along the boulevard.
The í',ayor said a question exists over whether the property should face
the street or not. Councilman Benetti said that the subdivisions should have
a masonry fence and the houses should face the street thus avoidinf', any
problem which might occur from rubbish disposal.
Gordon Eustice, Attorney representing Mr. Galli, developer of
Pring1ewood, Tract 1946, stated that Mr. Ga.lli owns several other properties
~ithin the City and is concerned lest the City be too stringent in its regula-
tions. He ackno"rledged that theCity can exact conditions but submitted that
they must be related to the "articular area involved. He raised objection
to improving the road to such an extent that the Permanente truck traffic
would be the main beneficiary. He noted thót the subject subdivision contains
only 8 lots and that a heavy duty road would not normally be required. When
he made reference to se,rer recuirements, Councilman Lazaneo reminded Hr.
Eustice that the City of Cupertino had no direct jurisdiction over the sewers
this being the province of the Sanitary District.
Mr. Eustice contended that some of the proposed conditions are beyond
those which a court will support and stated that Mr. Galli now feels thpt
the potential conditions would vrice the lots out of the market. He suggested
that cities sould look to the gasoline tax or heavy road users such as truck
or quarry operators for such road improvements as contemplated here.
Mr. Eustice requested a few days within ,rl:ich to contact Mr. Anderson
and make known to him some case law or statutory authority for his own
position.
In that regard, the City Council postponed further discussion of Mountain
View_Stevens Cree,' Road until August l.
Kr. Cook who also has a subdivision planned along the road said that
he might prefer to face the houses to the street if they are obligated to
widen the Kountain View_Stevens Creek Road.
Anthony Legario stated th,t he is Depresenting the Archbishop of San
Francisco and the property of Helen Loughlin, potential annexees. He said
that shifting the cost of public improvements should be considered in light
of the County Ttafficways Bond Apportionment, assuming the issue passes
the ballot.
The hayor referred to the latest studies of tbe Trafficways
Committee and informed Mr. bagorio that the Council is aware of that phase
of the County Road program.
II.
Wolfe Road:
Councilman Lazaneo said he is not in favor of abandoning easements already
guaranteed for the construction of Wolfe Road in favor of realigning the street
pattern and necessitating the acquisition of a new easement probably at considerable
cost to the taxpayers. of the City.
The Mayor noted that it may be some time before the road in question actually
goes under construction.
The City Engineer, Mr. Fleminé;, in response to a question, reported that the
City of Sunnyvale does not vropose a divider strip on their 86' roads whereas the
Cupertino cross section and standard details include a 4' Divider strip on 90'
roads.
Dale Hornberger repr~senting George Oakes of Rousseau Organization presented
a large map depicting Wolfe Roao at the intersection with Stevens Creek Road. Minor
chan¡,es in the development incluced the elimination of six houses to accO!lmodate
a Church site adjacent to the commercial area. Illr. Hornberger explained that
the positioning is such that the commerccal parking lot can be used by Churchgoers.
TLe plan showed Rich,'Wod Drive cut throu[h to violfe from East Estates on a reverse
curve.

With reference to the service station, Mr. Hornberger stated that it is
the intention of Idlewild and Mobil Oil to construct a presentable service
station. He admitted no objection to paving a 90' street on Wolfe if the City
so requires. He explained that the cost of such a 90' road would have to be
defrayed by realizing a proportion" tely higrler return on the commercial
frontage as well as the residential property abutting. He also said that the
Rousseau Company expects to par'ticipate in the cost of signalizing the Wolfe_
Stevens Creek intersection.
Warner Wilson, 10630 Stelling Road, questioned the contour of Richwood
Drive in that it did not proceed straight across to Wolfe. He also referred
to ownership of surrounding properties. Nr. Hornberger explained that the curve
on Richw1ilod Drive is due to the necessity to avoid an occupied house and clear
that particular property line by a distance which would avoid any nuisa~ce
factor.
Walter Pitch, 105<'1 Davison, told the Council he is interested in the
traffic signal and "hat its effect will be on the traffic pattern immedidtely
inside and outside of the subdivision. He also said that some residents do
not want any sort of service station on the location in question.
Don Froelich siad that he personally prefers a reverse curve in Richwood
Drive since it will serve the purpose of both slowing and reducing traffic. He
stated that a divider strip will be constructed according to the Cupertino
Planning Commission in order to negate the double level of Stevens Creek Blvd.
at that point.
Councilman Saich mentioned that the location of the divider strip will
be controlled by the precise alignment of Wolfe Road.
The Mayor said that traffic counts and project costs will have to be
explored thoroughly prior to any decision to apDrove the subject intersection
in the manner presently being discussed. He noted that a double intersection
now result in need for synchronized signals, turning lanes, divider baffled,
stop si¡!ns, etc. He referred to the fact that Stevens Creek Road has been
given number one priority by the City of Cupertino for thepurpose of County
Trafficways apportionments. He favored further discussion to determine more
closely when Wolfe Roed will actually be ready for construction south of
Homestead and by the same token the signals Can be installed and in what way
the cost shall be allocated.
Councilman Lazaneo said that Rousseau has already made a co,¡:mittment to
assume half the cost of signalization, on which basis, he saià, the signals
will be a good investment for the City especially in view of the Stelling Road
signals and Miller Avenue signal. He said the cost should be comparable to
that of the Stelling intersection.
The Hayor named the location of the existing si¡mals both City and State
in and about the City and indicated that precaution shoula be taken as not to
acquire too many. He said that facts and figures are necessary concerning the
costs.
Councilman Saich said that he preferTed to set the signals as far apart
as necessary.
With reference to timing, Mr. Hornberger, said that their engineer will
need until October or November to make a,oplic"tion for a buiiLding permit.
Councilman Lazaneo reported the fact that a use permit Las apparently been
granted by the Planning Commission. The Mayor disagreed with this procedure.
The City Attorney stated that the right of appeal does exist and that the City
Council by motion may accept a veY'bal protest or appeal in lieu of the required
written appeal.
Noved by Councilman Saich that the written appeal requireement of the
Ordinance be waived in favor of recofnizinV at oral protest; second by Council_
man Benetti; carried 4-0.
The Mayor postponed the matter until August 1st.
