Nr. ayler stated that the Streets and Highways ode provide~
for a freeway agreement which includes provisions for closirg
city streets, for carrying city streets over or under or to
a connection with such freeway, for relocation of city st~e~t.
and for construction of frontage roads, The matter of graó~
crossings, interchanges, etc, is still to be determined and
the Division of Highways Jrefers the concurrence of the City
involved, he said, The Highway proposes to relocate Bernardo
to the east,
Council~ Saich questioned Mr. Hayler concerning easement
The freeway as now planned would separate some of the orchard
property within the city and would prevent convenient access
frpm one parcel to the other, He asked Mr, Hayler if the
Division of Highways would build additional roads in order to
give the orchardists a thoroughfare from one piece of propertJ
to another.
Mr, Hayler stated that the Highway Department ~ay provide
a road if the owner is obstructed.
Councilman Wilson told Mr, Hayler that the City has a
minimum of industrial tracts and asked why the freeway was n~
run closer to the railroad, putting it beyond the City limits
and avoiding disruption of potential industrial property. Hß
also suggested that SCR go under the cloverleaf,

Mr. Hayler himself has no power to change the freeway Ii,
nOr apparently do any of the engineering staff in District
IV, This right lies with the Highway Commission, At the
suggestion of Hayler the City Council asked that a place on
the August Agenda of the Highway Commission b~requested,
In response to a question, Mr. Hayler replied'that the
location of Junipero Serra Freeway did have a bearing on
Stevens Creek Freeway, He said that is difficult to get fun,
from the Highway Commission without a Freeway Agreement, Thl
Mayor told Mr. Hayler that Cupertino might sign the agreemeni
during the meeting if some satisfaction is granted with regal
to moving the freeway line closer to the railroad tri'cks. fIE
questioned the method of locating these freeways and also the
procedure in tþe hearings. Councilman Wilson pointed out
that the economic status of the City would be seVerly impaire
in the event the freeway proceeds along the line indloatêd.
Mr. Leonard of the Planning Commission explained to Mr.
Hayler that agents looking for industrial plots are seeking
forty to a hundred acres rather than smaller lots, He said
that industry likes to locate alongside industry, that is,
in an industrial park, It prefers ownership committed to a
common purpose. Consequently small parcels are inadequate
to accommodate this sort of use.
The City can ask by resolution for an additional crossi~;
to provide access to orchard property bisected in such way t
make impossible the proper use of farm machinery,
Mr. Leonard said that in case there is a meeting with
the Highway Commission, it might be well to consider the
street layout and especially the status of Lowe and Wolfe
B.oads. Mr. Hayler said that the widening of Lowe Avenue muE':'
be decided by the Highway Commission, The access roads can
be settled by the District Division of Highways.
In answer to a question, Mr, Hayler said that it would be
difficult to prove that the seven feet of property east of
Highway 9 belonging to Cali Bros~ is necessary for the high-
way. The City Attorney suggested that the parallel parking
signs be taken down inasmuch as they have not been enforced
and would not be enforced in the future. He requested a
letter from the State to the effect that the signs would be
removed and that the present situation did not constitute
interference with the State Highway. This would rid the Cit:'
of liability.
Street Deficiency Report
Mr, Fleming said that the Federal Government requires each
state to report on its street deficiencies. California has
asked each city to report on its own jurisdiction, In
preparing Cupertino's report the Mark Thomas Company has
conferred with neighboring cities. McClellan is listed as
an eventual 901 width, Homestead 90', Stevens Creek Road 120'

2. Mr, Anderson said he has explained to Rodrigues that Mc-
Carthy has been asked for an estimate On certain street
repairs in Town and Country. Rodrigues intends to do
likewise with another contractor. The estimate will be
compared and the matter will be discussed from that point

Heport of R03ds and Maintenance Commissioner
The Mayor asked the Road Commissioner to find out the cost
of a triangular island to be located at Highway 9 "and Home-
stead Road.

Councilman Wilson moved that the report be approved and the
City Attorney be authorized to draft an ordinance for rezon-
ing as indicated in Section 2A and Bi seconded by Councilman
Saich, carried 4 - o.
Recreation Report
The Council felt that the resolution enacted by the City of
Hayward relative to securing the New York Giants Baseball
Club was beyond their realm, and decidedaga1nst a reply.
Miscellaneous
1. Mr, Ellis, proponent of an annexation now being consld£"
ed along Blaney Avenue, reported that there are about
thirteen and one half acres in the proposal and that
fifty-one or more precent are currently in favor. Mr,
Anderson told him to clear his maps and legal descrip-
tions with the County Boundary Commission; then the Cit"'
will undertake the proceedings.
