II THE MINUTES OF THE PREVIOUS MEETING 8/20/56 were read and
approved.
III PETITIONS AND COMMUNICATIONS
A. Written
1. A letter from the City of San Jose stated that the Council
of that City favored that the name of W. San Carlos Street
and Stevens Creek Road be ch~nged to San Carlos Boulevard
providing that this change would be satisfactory to the
City of Cupertino, the City of Santee' C12ra and the County
Board of Supervisors. The letter requested that Cupertino
consider this proposed renaming and advise San Jose
whether or not it meets with approval.
A brief discussion indicated that the proposed new
name would not be agreeable to the City of Cupertino.

IV UNFINISHED BUSINESS
A. Ordinances for Adoption
A Civil Defense Ordinance is pending.
B. City Seal Engravure
The City Seal was procured from the Cupertino Fire Station
during recess for examination by the City Council.
C. Gas and Electric Franchise Hearing
Councilman Lindenmeyer moved that the Gas and Electric Fran-
chises be tabled for consideration after the street lightinge
topic; seconded by Councilman Nathanson and voted down 3 _ 2.
Elliot H. Ginnochio reiterated that the City is now operating
under the old County franchise. The new franchise based on
a 1937 Act allows greater revenue to the City of Cupertino _
estimated at $1400.00. Current revenue from the gas franchise
returns about $200.00 to the City, There is no revenue from
the electric franchise under the present contract. City
Attorney Anderson commented in passing that the retroactive
agreement would compensate in part for the extraordinary road
usor of P.G.&E. No official protests were made at the hea~
Upon first reading of the Electric Franchise Ordinance,
Councilman Lindenmeyer moved that reading of the Gas Franchiæ
be waived on unanimous motion by the Council; seconded by
Councilman Saich and carried 5 - 0, thus accounting for a
first reading of the Gas Franchise Ordinance.
D. Street Lighting
Resolution #28 was read, declaring the intention of the
Council of the City of Cupertino to create Cupe~tino Lighting
District #1 within the boundaries of said City .nd covering
the same area therein as previously covered by the Cupertino
Lighting Maintenance District of Santa Clara County.
Resolution #29, appointing time and place of hearing of
protests and directing notice of hearing to be given in the
matter of formation of Cupertino Lighting District #1 within
the City of Cupertino to replace and substitute for the
Cupertino Lighting Maintenance District of Santa Clara County

was also re"\d. It was moved by CouncilmrlD Lindenme~er;
seconded by Councilman Meyerholz, that Resolutions 28
and #29 be adopted - carried S - o.
Before reading of the Resolutions, City Attorney
Anderson explained that the City would advance six months
of payments to the Street Lighting District sinoe the
re-formation would not permit tax collection before the
money was due.
E. Civil Defense
Mr. Williams st2ted that salvage equipment is available to
the City, the only charge being a 15% fee for handling, of
whioh 7% is refunded. This equipment is presently stored in
Oakland, and it was mentioned that one of the Cupertino
trucking companies might be willing to haul the equipment in
when an empty truck was in that vicinity. Mr. Williams
offered the name of Howard E. Mallette as Assistant Coor-
dinator of Civil Defense. Councilman Lindenmeyer moved that
Shelley Williams and Howard E. Mallette be appointed as
Coordinator and Assistant Coordinator, respectively, of
Civil Defense within the City of Cupertino; seconded by
Councilman Saich and carried unanimously.
Mayor Wilson proclaimed the présent week, September ioth
to 16th, as Civil Defense Week.
F. Notice to Contractors re Street Improvement Project
Upon hearing the notice to contraotors, the Council requested
that an additional sentence be inserted, namely that "Super-
vision of all work is vested in the Road Commissioner of the
City of Cupertino.". It was then moved bY Councilman Saich
that notice be published and that bids be opened on Monday,
the 24th day of September, i956; seconded by Councilman
Lindenmeyer and oarried S - O.

A. Attorney's Report

B. Report of Finanoe Chairman ,
Councilman Meyerholz reported a bank balance of $14,290.00.
C. Report of Roads and Maintenance Commissioner
Councilman Saich described the status of the road repair
project whereupon Councilman Lindenmeyer moved th3t the City
of Cupertino pay the Company of McCr:rthy & Spiesman monthly,
at the discretion of the Road Commissioner, and upon receipt
of evidence that said Company (McCarthy & Spiesman) has paid
the cost of materials and labor; seconded by Councilman
Saich and carried S - O.
D. Report of Police and Fire Chief
Councilman Nathanson requested that the County Traffio
Engineer, L. T. Smeltzer, be asked again to re-evaluate the
speed limits on various City streets with special reference
to County extensions of City streets.
Councilman Meverholz moved that the Chief of Police be
authorized to purchase an appropriate badge; seconded by
Councilman Lindenmeyer and carried 4 - O.
E. Report of Building & Health Inspeotor
No report
F. Miscelloneous
1. Mayor Wilson observed that he can acquire an estimate on
a City letterhead.
2. The Mayor requested that a count be t2ken O¡, Ghe gas 'lndj
or electric meters relative to the popu.:.c,ti, , question.
3. The Mayor also proposed that the Council gi' e serious
consideration to the formation of a committee designed to
investigate industrial possibilities for the City of
Cupertino, with the aim of attracting same.
