Soomil I ROLL CALL Councilmen Present: Councilmen Absent: Wilson, Meyerholz, Nathanson, Saich Lindenmeyer II READING MINUTES OF PREVIOUS MEETING The minutes were approved as read. III PETITIONS AND COMMUNICATIONS A. Written 1. A report to the C~ertino City Council on the special meeting of the Inter-City Council in San Jose Municipal Auditorium July 2; Councilman Lindenmeyer informed the Cupertino Council that the Inter-City Council decided to offer the County 5% of the sales tax collections, unear- marked, if the County will enact the uniform sales tax, 2. G. T. McCoy, State Highway Engineer, reported that the drainage problem in the vicinity of Cupertino is being given further study and that we may expect to hear from them within three weeks, B. Oral 1. The sample Ordinance presented by Doctor Turner was given a first reading and enacted thereupon as an urgency measure, Councilman Nathanson moved that the County Ordinance be adopted by reference with the addition of a posting clause; seconded by Councilman Meyerholz and carried 4 - O. Dr. Turner, Ðirector of Public Health, Santa Clara County, said that enforcement of the Ordinance would not require the City to furnish any additional funds; Cupertino would be treated the same as the unincorporated areas, with the dog license fees going to the County. 2. Dr. Joseph Brown requested that the Council reconsider the $100.00 fee required for a dog hospital business license. He listed the fees in neighboring and other Cities, After a short discussion the Mayor asked the City Attorney to amend the Ordinance to permit licensing of dog hospitals for $25.00. 3. The Clerk was asked to contact Assemblyman Bruce Allen and give him the names of the men whom Governor Knight is expected to appoint to the local Planning Advisory Board formed to administer the new law providing federal planning assistance to Cities with population under 25,000. IV UNFINISHED BUSIKESS A, Ordinances for Adoption Attorney Anderson reported that he had no fOj'mal offer as yet from P,G.&E. The contract for the street li¡hting will be in the form of a resolution, when executed, ';;hrre waf nothing to report on the gas and electric franchises. ß. Sales ~'ax R~9rt After hear-ing the message from Councilman LLlden;neyer (sel') IIl:-A-1. abO'\;e) Councilman Nathanson asked the Ch~rk tc\ invite Clark Bradley to explain the Bradley-Burns ((ni~~rm Sales Tax) law at the next meeting. C. Gas Tax Allocation - Project Statement for year ending June :30, 1957: It was moved by Councilman Meyerholz, seconded by Councilman Nathanson, and carried 4 - 0, that the project statement be signeè.. - 2 - D, Speed Limit Matter An Ordinance decreasing the 55 M,P,H. speed limit on Stevens Creek Road was read for the first time. The first reading carried 4 - O. The Ordinance as altered provided that a speeð limit of 45 M.P.H. be enforced along the length of Stevens Creek Road within the City limits of Cupertino. E. Miscellaneous 1. The Council decided that no refund was due Gregory Vistica on his business license. V NEW BUSINESS A, Planning Commission Report - Recommendation that Kompanica Property be rezoned C-1-H subject to the following conditions: Applicants to pay $750.00 to the Board of the Cupertino Sani- tary District to help with the eventual sewering of that general area, and, applicants to pave, at their expense, from their curb line to the present surfaces of Highway 9 and Homestead Road. The Council voted 4 - 0 to approve the use permitj the Mayor asked the City Attorney to draw a Rezoning Ordinance for the i/3 acre, Mr. Dunwoody, who is acquiring the property for the Texas Company, told the Council that the lease is of no use to Texaco without a rezoning. E. Attorney's Report Attorney Anderson noted that the City Ordinance governing Council Meetings provided that any Monday in the month be deemed a regular meeting, This would eliminate the confusion over which meetings are regular and which are special. C. Report of Finance Chairman The Quarterly Report of June 30, 1956, showed that $16337.26 had been received by the City, of which $6033.11 had been spent. It was moved by Councilman Saich that the Council approve the reportj seconded by Councilman Nathanson and carried 4 - 0, A few small readjustments brought the tenta- tive budget from $35300.00 to $36000.00. The City Clerk was asked to determine when and how the City Council must submit its tax rate to the County Controller, Councilman Meyerholz mentioned his intention to put four or five thousand dollars in a savings account. D. Report of Roads and Maintenance Commissioner The Council agreed that Councilman Saich should negotiate with Leonard McCarthy on road patching. E. Report of Police and Fire Chief Councilman Nathanson reported a consultation with members of the Sheriff's Office assigned to Cupertino. F.
