Norton I ROLL CALL Councilmen Present: Councilmen Absent: Wilson, Nathanson, Saich Lindenmeyer, Meyerholz II READING MINUTES OF PREVIOUS MEETING The Clerk was instructed to read the minutes. The following corrections were noted: Item III-A-5 insert "Motor Vehicle Fee Fund" after 1955, Item IV-E-2 change "Stevens-Carlos" to nCarlos- Stevens·, Item V-D line 1 insert "of the County Sheriff's Office" after Captain Perusina. III PETITIONS AND COMMUNICATIONS A. Written - none were read B. Oral - none IV UNFINISHED BUSINESS A. Ordinances for adoption It was decided to hold these until all Council Members were present. B. County Contracts The Clerk was instructed to make arrangements for a meeting between County Executive Frank Thill and the Cupertino Council. After a short discussion by the three Councilmen present, the meeting was recessed until the following Monday. THE RECESSED MEETING OF MAY 28TH CONVENED ON JUNE 4 WITH ALL MEMBERS PRESENT. IV B. It was noted that all the County contracts have appeared except the one for roads. By this time the meeting with Frank Thill had been scheduled for June 6th. The time and place was acceptable to the City Council. C. Budget Estimate Copies of a preliminary budget prepared by Councilman Meyer- holz were distributed, Mr. Meyerholz gave a brief rundown on the budget and explained the method by which he had arrived at the various figures. Mr. Meyerholz mentioned the possi- bility of granting the Planning Commission money for a master plan and/or a planning consultapt. He also added that the City appeared to be financially stable and that the figures presented could fluctuate with the budget remaining the same but the departmental allocations differing. In connection with the franchise revenue, Councilman Lindenmeyer renewed the suggestion that the City Attorney negotiate with F.G. & E, concerning gas and electric fran- chises. Councilman Nathanson moved that the Council adopt the figures as a preliminary budget; seconded by Councilman Saic~ and Q§.,ried 5-=..Jl, D. Busine8s Lic~nses ~he city Clerk reported that he had ordered 200 decals fro~ Arne'Signs. These serve to implement enforcenen; of OrdinF..;z-', 15. E. Miscellaneous 1. Hospital District - Councilman Nathanson stated that committees formed for the purpose of conducting studies or surveys habitually propose bond elections before reporting back to the people whom they represent. He suggested that - 2 - some public spirited citizens raise the $100,000.00 needed for a hospital. Councilman Meyerholz said that the hospital, if suoh is needed, should be financed on a per oapita basis, rather than on the basis of property. He felt that in this way people who use the hospital would be the ones to pay for it. He also felt that the people demanding a hospital would not pay an equitable share if the hospital was financed on the basis of property assessments., V NEW BUSINESS A. Attorney's ReÐort Attorney Anderson said that be had filed a dismissal without prejudice in the oase of Sunnyvale versus Cupertino. He also said that the writ of Certiorari must be stricken in the case involving the farmers in Agrioulture Unit 1 and the Lawrenoe Station Sewer. The reason for this seems to be that upon completion of an annexation a ~ warranmwill lie, oertiorar~ will not. Final reading on Ordinanoes 16 and 17 for the City Clerk and City Treasurer, respectively, was held. Moved by Counoil- mAn Nathanson that Ordinance 16 be adopted; seconded by Councilman Saich and carried 5 - O. Moved by Councilman Saich that Ordinance 17 be adopted; seconded by Counoilman Nathanson and carried 5 - O. B. Report of Finance Chairman Councilman Meyerholz reported several outstanding bills and recommended that warrants be authorized for the payment there- of. Moved bY Councilman Saich that the warrants be authorize~ seconded by Councilman Lindenmeyer and carried unanimo~slY. C. Report o~ Roads and Maintenance Commission~r Councilman Saich expected a meeting with the County Engineer on the fo],lowing Wednesday. Councilman Nathanson observed that the Merchants at the four corners were experiencing trouble due to the road con- struction work by L. C. Smith. D. Report of Polioe and Fire Chief City Attorney Anderson read a section from the Streets and Highways Code regulating the speed limits that can be set 1n a given area. Councilman Nathanson thereupon suggested that the speed limit be reduced from ;; mph to 4; mph on Stevens Creek Road from Highway 9 to the Loree District. Mayor Wi180n suggested that the committee formed a few weeks earlier make a report on this subject at the next meeting. E. Report of Buildln~ and Health Inspeotor Councilman L1ndenmeyer referred to a letter from the County Health Officer reporting the County as a rabies endemic area.
