A. The Secretary was instructed to read the Minutes of
the previous meeting. The following correcti~ns
were noted: (1). Item IV-B-3, line 6, insert the
word "flat" after "Company Binder"; (2). ItemV-L-l,
line 5, insert "The approval of the Board of Super-
visors is necess~ry before entering into a contract-
ual agreement. (Corrections (1) ~nd (2) were noted
by Councilman N~thanson.) (3). A correction was
noted by Mayor Lindenmeyer in Item V-G-l, line 1,
insert the wore: "Clerk" after City.

A. Ordinances for Adoption; None stated.
B. Miscellaneous
1. Mayor Lindenmeyer reported informational material
had been requested from the County Civil Defense
Gepartment.
2. Finance Chairman !1eyerholz reported office equip-
ment had been delivered to the Firehouse.

Attorney's Re~ort
1. City Attorney Sam J. AnQerson reported he is
drawing up a Resolution and an Ordinance as
required for the annexa:ion of Homestead l-C
and Homestead 2-C.
2. Folice and Fire Chief Nathanson presented County
Fire Ordinance 687 to the Council for stUQY. ~he
Secretary was instructed to compose a letter for
the Mayor's signature to Chief Lingua advisinG th
continuance of present fire control facilities.
3. .\ Palo <>lto Ordinance controlling highway adver-
tisements was presented to City ~ttorney and the
Planning Commission for study.
E. Report of Fin~nce Chairman
1. Chairman Meyerholz reported Mr. Walter Fields,
Mr. Earl Foster and City rlttorney had conferreè
with him regarŒing a Business Licensing OrdinaLC~
Mr. Fields and Mr. Foster had recommended a flat
fee basis for each business establishment plus a
one-cent sales tax. rlfter considerable discussi~
of a regul~tory and sales tax ordinance, Council-
man ·,iilson declared he was o,?posed to a sales tax

for Cupertino. If a County sales tax is adopted,
th? City will receive only 5010 of the amount
collected. Noved by Councilman \V11son. seconded
by Council~pn Saich the Council procéed with the
investig~tion and study of the proposed sales tax
and report at the eQrliest possible âate.
2. Chairm'nl Heyerholz stated the City must e,ssume the
responsibility of the Lighting District; the
County will continue with the assessment duties.
Roçd Commission0r Jaich will inouire from the
issessor's office the bound'o>ry description of the
Lighting ~istrict.
J. Urgency Orlihances were recommended by the Council
for collecting the revenues from the franchises
of the ~ater Service Company and racific Gas 2nd
Electric Company; collectable fees from the
Building Ins;ector were to be included in this
Ordin"nce. Before the County Tax "ssessor and
Collector C211 be named as officials of the Citv
of Cupertino, permission is necessary from the<
County Eo~rd of 3upervisors.
4. The City _.ttorney was instructed to investigate
the iacific Tele¿hone and Telegra0h Company
fr8nchise.
5. lIoved by Councilm'm S:Üch, the Finance Chairman
be instructed to pay '311 accrued bills as of
J211UQry 1, 195ó with the exception of the tele-
phone inst2ll9tion charge of ,10.00 and Kennedy
Business i'I:,chines to be paiC1 ,,100.00 on account.

C. Report of Roads and Mqintensnce Commissioner
Councilman ~3ich reported a meeting is scheduled with
County Executive Frank Thill for ',;ednesday 1/11/56
regarding street lights and sales tax.
D. ~eport of Police ~nd Fire Chief
1. Chief Nathanson reported he had interviewed the
former £olice Chief of Sunnyvale, Mr. .enfold.

6. The patrols are havin6 difficulties with speeders
due to the insufficiency of speed limit signs
within the City limits. Mr. Smeltzer has agreed
to put a count on Stevens CreeK Boad to determine
the prevailing speeds.

heport of Planning Commission
1. Planning Commission forms a~proved by the Council
1/2/56 have been adopted for a 30 day period.

been submitted by Mr. Charles 3aer 2nd Mr, John
TIodrigues have been approved by the ilanning
Com,nission.
3. 'I'hree public he3rings have been scheduled for
January 25, 1956, for an eight acre block located
on the south side of Stevens Craek Road. Mr.
John Stone r¡;quested comm¡;rcial zoning for .';
300' frontage on 3tevens Creek Road and ligh+;
inQustrial for two parcels at the rear of the
commercially zoned recuest. Mr. Darile Camp
requested M-2-H zoning for the fourth parcel for
the purpose of a cement batching plant. The third
hearing is for a use permit for a iarochial
school on property loc3ted on Highway ir9 be1..onging
to the Cupertino St. Joseyh's Church.

1. "Council meeti'1g with Sunnyvale has been
scheduled for 7:00 r,H., Tuesday, January 24,
1956 at the Copper Skillet.
2. Discussion: Southward Expansion
a. n volunteer commi tt~,e WJS requested by Mayor
Lindenmeyer to assist the Council in canvassin
the 2rea south of McClellan Road and ~est of
Highwe.y .r9 on annexation desires of the
residents. Mr, James ",veni and I1r. Dan
Hutlinger volunteered and were accepted by
the Council as volunteers. Moved by Council-
ffi2n ',Jilson and seconded by Councilman 11eyer-
holz the Council act as a nucleus with a
volunteer committee to canvass the area south
of McCleœlan Rosd and west of Highway lf9 fo~
opinions and desires of the residents reg?rã~¡
annexation by Cupertino; all interested
residents invited to a~pear at a public meetir
to be held at 8:00 F.M., Tuesday, Janu;ry 17,
at the Cupertino Union School. Carried 5 - 0

of the volunteer citizen IS committee. 'rhe
CouilCil concluded a citizen's committee would
not be 8 policy setting body.
