SYNOPSIS OF COUNCIL WORK SESSION

I The matter of dedicating and improving the frontage of
Parcel No. 2 owned by the Cupertino De Oro Club was dis-
cussed first.
Martin, Perkins and Benevich spoke to the points
within their acquaintance, the substance of their position
amounting to the fact that the City requires streets, curbs,
gutters and sidewalks as a condition to the issuance of a
building permit.
Mr. Meyerholz representing the De Oro Club, maintained
that Cupertino has no ordinance or resolution providing
authority to require dedication, paving, curbs, etc. on
Parcel No. 2 which is not being rezoned but is the proposed
site for the existing building (being moved from the corner,
Parcel No.. 1 to make way for a gas station). He refused to
comply unless the City produces an ordinance which states
specifically the above requirements.
The City Attorney finds that Ordinance 47 (Subdivision
Ordinance) covers the circumstances and enables the City
to apply the requirements for a subdivision (See Article 1,
Section 1, Sub-section 4),
Finally the Mayor referred Mr. Meyerholz to Article V,
Section 18, which permits an application for an exception.
In order for the property referred to in the petition to
come within the provisions of this Section, it shall be
necessary that the Planning Commission shall find the
following facts with respect thereto: That the granting of
the exception will not be detrimental to the public welfare
or injurious to other property in the territory in which
said property is situated, etc, etc.
The De Oro Club mayor may not apply for this
exception.
II Storm Drainage was the other matter discussed.
Mr. Oakes (Rousseau & Company) stated that his rights
on 3 or 4 properties within the City will expire in a few
weeks and he will have no further use for this land unless
a storm drain plan is devised quickly,
A general discu$sion took place revolving about amounts
and sources of money. Sources included the selle~ the
buyer and the City. Amounts are being explored.
The suggestion meeting with the best response is to·
concentrate on the Calabazas Creek itself and work the
arrangements for the drainage pipe or ditch to the west
taking it to the vicinity of Becker Lane and/or as far as
the cooperation and contributions of property owners will
permit.
