S..ction 8.1 becomes Section 7.1, and shall read, "The following guidelines
are a co&pilation of policies stated in the adopted General Plan. They
are intended to be guidelines for the preparation of plans for construc-
tion in Hillside Residential areas." Paragraph 4 shall be amended to read
as follows: "As a general rule, it is the responaibility of individual
applicants to locate th~ir homes in a manner to protect their vi~Ms, re-
spect views of their neighbors, and to protect themselves and their neigh-

The City Attorney expressed his opinion that the Council may either eccept
the low bide, reject all bids, negotiate with the low bidder on contract.

24. Subrogation clailll submitted by California 3tate Automobile Associ-
ation for damages incurred in a vehicle collision.
Following the City Attorney's recommendation, it was moved by CO~lC. Meyers,
seconded by Counc. Rogers and passed unanimously that the Council reject
the subrogation claim as the lights are under the jurisdiction of the State
and are maintained by the State. Council directed the City Clerk to notify
the claimant of the rejection.
25. ¡:omination for the General Plan Advisory COIIIIIIittee to be appointeù
by IGC.
It was moved by Counc. Meyers, seconded by Counc. O'Keefe and passed
unanimously to nOlllinate Counc. Rogers for recommendation to serve on the
General Plan Advisory Committee as an IGC representative.
26. Report of Existing Capital Improvements in Boundary Study Area.
It was moved by Counc. Mayers. seconded by Counc. Rogers and passed unan-
imously to adopt staff recommendations for reilllburselllent for existing
capital illlprovements in the proposed boundary adjustment area and approve.

width of Saratoga-Sunnyvale Road. LAFCO is to be informed of this on

27. Proposed reorganization of Central Fire Dist~ict Commission.

unanimously to approve City representation by an elected City official
to a 5 lDember Board of Fire ('-ha1ønera,of .tha:CeDt~a1r1>b.œnt8C1IiOtI'Diatrict
(exclude Campbell) to replace present lay cOmßissioners appointed by the
Supervisors. Counc. Rogers was nominated to serve from Cupertino. Council
approved no limit in successive terms, wi~h the Board members serving staggered
terms. This is to be conveyed to the Board of Supervisors.

By consensus Council referred the Testriction of parking along Lazaneo
Drive to the Public Safety Commission for public hearing and recom-
mendation. Signs on Lazaneo will not be posted west of the school at
this time.
STAFF REPORTS
32. Report on traffic safety suggestions along Lazaneo Drive and their
implementation.
It was moveó by Counc. Rogers, seconded by Counc. O'Keefe and passed unan-
imously to direct staff to report back to Council regarding projected
~raffic figures for the Stevens Creek-De Anza intersection in light of
interconnect and the signalization.

Staff will report to Council regarding the design for a barrier at Lazaneo
and Vista; a request to move the barrier east of Randy Lane; the timing
of the left turn at Lazóneo and De Anza.
It was moved by Counc. O'Keefe and seconded by Counc. Rogers to adopt a
strategy that Lazaneo not act as a bypass for Stevens Creek Blvd. and
De Anza Blvd. The motion was defeated with Councilmembers O'Keefe and
Rogers votIng aye and Councilmeabers Meyers and Jackson dissenting.
Council approved appropriating $4,500 from the Master Storm Drain Fund to

Coordinating Council."
It was moved by Counc. O'Keefe, seconded by Counc. Meyers alid passed with
Counc. Rogers dissenting to approve staff recommendation to not participate
in the proposed Regional Criminal J~Rtice Consortium and tr notify the
County of their desire to be included in the County mini-grant program.
Resolution No. 4798 was not adopted.
34. Impact of stop signs on Blaney Avenue traffic.
It was moved by Counc. Meyers, seconded 1:>y Counc. Rogers and passed unan-
imously for the staff to prepare a report anå return with that report
at the October 16, 1978, meeting.
35. Oral reports by staff members and submission of written reports.
It was moved by ~unc. Rogers, seconded by Counc. O'Keefe and passed
unaninously to termina.:e the agreement with De Leuw, Cather and Co. for
the Vallco Park Traffi<: Reduction Program and staff to prepare a report
on RIDES ard a possiblE budget for Vallco Park EIR funds.
It was moved by Counc. Rogers, seconded by Counc. Meyers, and passel! unan-
imously to get more information regarding the Pioneer Day Parade and, if
it has backing, bring it back to Council.
By consensus. Council approved the concepts presented in the Policy Guide-
lines for Individual Expense Accounts for City Council with the addition
of the words "by the Treasurer" in the next-to-last line after "submitted
to the City Coun.:i}".
Couocil agreed by consensus to direct staff to respond to HCD with a
plan that answers their C<Jncer..1S regarding the pass-through program.
It was moved by Ccunc. Meyers, seconded by Cotmc. Rogers and passed unan-
imously to cr~tinue the Aquatics Program as long as it is self-sustaining.
By consensus, Council agreed to request an article be put in the Cupertino
Scene regarding the status, proble~s, and pending demonstration project
for the residential resurfacing program.
It was moved by Counc. Meyers, second~d by Counc. Rogers and passed unan-
imously to authorize staff to engage Sedgwich. Deterl, Moran and Arnold
to represent the City's interest in a Workers Compensation case.
