RESOLUTION NO. 2981
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO ALLOW AN Or r iCE USE WITHIN
AN EXISTING 2,400 SQ. FT. BUILDING.
SECUON I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the helth,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby approved, subject to the conditions which are enumerated in this
Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public HPring record
concerning Application 32-U-86 as set forth in the Minutes of the Planning
Commission Meetings of November 10, and December 8, 1986, and are
incorporated by reference as though fully set forth herein.

SECTION III: CONDITIONS OF APPROVAL TO BE ADMINISTERED BY PUBLIC WORKS
DEPARTMENT
1. Underground Utilities
The applicant shall be responsible for complying with the requirements
of the Underground Utility Ordinance No. 331 and other related
ordinancPq and regulations of the City of Cupertino, and shall make
the necessary arrangements with the utility companies involved for the
installation of said facilities. The applicant shall submit a
detailed plan showing utility underground provisions (This plan must
have prior approval of the utility companies and the City Engineer.)
2. Storm Drainage
Drainage shall be to the satisfaction of the City Engineer.
Surface flow ac:Luss public sidewalks may be allowed in R1-R2, and R3
zoning unless storm drain facilities are deemed necessary by the City
Engineer.
All developments other than R1, P2, and P3 zoning shall be served by
on-site storm drainage facilities connected to the City storm drainage
system. If City storm drains are not available, drainage facilities
shall be installed to the satisfaction of the City Engineer.
SECTION IV: CONDITIONS OF APPROVAL TO BE ADMINISTERED BY THE PLANNING
DEPARTMENT
3. Approved Exhibits
The approval is based on the staff exhibit, except as may be amended
by special conditions contained herein.
4. Approved Use
The subject building is approved for office use. The hours of
operation are not restricted. This approval pertains only to JCP
Engineers and Geologists, Inc. (the current tenant) . Any change of
tenant is subject to use permit review per Ordinance No. 1337
(Application 27-Z-85) .

5. Building Permit
The applicant shall obtain a building permit for all interior
improvements and comply with the inspection requirements of the
Building Department.
6. Architectural and Site Approval Committee
The applicant shall submit a landscape and site plan to the
Architectural and Site Approval Committee for review and approval
prior to issuance of a building permit. The plan shall incorporate
the following elements:
- Replant the barren area covered by adobe bricks which adjoins
the existing landscaping.
- Restripe the parking lot to provide a handicap parking space
and an eight foot wide planter area adjoining the sidewalk in
the parking lot's southwest corner. Install plants which have
a vertical growth habit and will screen parked vehicles.
Replant the existing landscape area in the northwest corner of
the property to accomplish these same objectives.
- Install automatic irrigation in all landscaped areas.
- Provide a plan for external lighting, fencing and window
treatment.
7. Shed
Remove the shed located in the southeast corner of the property prior
to issuance of a building permit.
8. Completion Date
All improvements shall be completed and installed prior to March 8,
1987.
