Reso 2977 • APPLICATION 34-U-86 CITY OF CUPERTINO 10300 TORRE AVENUE CUPERTINO, CALIFORNIA 95014 RESOLUTION NO. 2977 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A USE PERMIT TO OPERATE A TEMPORARY PUBLIC LIBRARY EQUALLING APPROXIMATELY 3,400 SQ. FT. AT EATON SCHOOL SEcriON I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described on Page 2 of this Resolution; and WHEREAS, the applicant(s) has meet the burden of proof required to support said application; and WHEREAS, the Planning Commission finds that the application meets the following requirements: a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not detrimental to existing uses or to aces specifically permitted in the zone in which the proposed use is to be located. b) That the property involved is adequate in size and shape to accommodate the proposed use. c) That the proposed use will not generate a level of traffic over and beyond that of the capacity of the existing street system. d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of such proposed use, nor injurious to property and improvements in the neighborhood. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Use Permit is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and BE IT FURTHER RESOLVED: That the subconclusions upon which the findings and conditions specified in this Resolution are based are contained in the Public Hearing record concerning Application 34-U-86, as set forth in the Minutes of the Planning Commission Meeting of December 8, 1986, and are incorporated by reference as though fully set forth herein. RESOLUTION NO. 2977 (34-U-86) November 24, 1986 Page 2 SEci'iON II: APPLICATION DESCRIPTION Application No(s) 34-U-86 and 33-EA-86 Applicant: Cupertino Library - Santa Clara County Libraries Property Owner: Cupertino Union School District Location: Eaton School, southeast corner of Suisun Drive and Farallone Drive 1. APPROVED EXHIBITS The recommendation of approval is based on Exhibits A and B of Application 34-U-86 except as may be amended by special conditions enumerated herein. 2. APPROVED USES A public library equaling approximately 3,400 sq. ft. may be operated in the multi-purpose room at Eaton School. The Library is approved as a temporary use for a 1 year period. This approval may be extended subject to review by the Planning Commission. The Planning Commission's review shall focus on problems attributable to the library, such as an increase in traffic levels. Residents within 300 ft. of the school's property line shall be notified of said review. 3. HOURS OF OPERATION The Library's hours of operation shall be limited to the following: Day Hours Monday-Friday 10:00 a.m. - 9:00 p.m. Saturday and Sunday 10:00 a.m. - 6:00 p.m. The Library shall close at sunset if on-site parking lot lighting is not provided for existing or future parking areas. 4. PARKING The applicant shall provide 45 parking spaces on the subject property through a combination of restriping existing spaces and, striping the curved driveway off Suisun Drive. Parking lot lights are not required for either the new or existing parking lots provided the library closes before sunset as outlined above. If patrons park on the residential sides of adjacent public streets permit parking may be instituted for the duration of the library use at the discretion of the City Council. RESOLUTION NO. 2977 (34-U-86) November 24, 1986 Page 3 At any time, the Planning Commission may require provision of an additional on-site temporary parking spaces as deemed necessary as illustrated on Exhibit A-1 of Application 34-U-86. The materials for the new parking lot may be of a temporary nature, including gravel, subject to the approval of the Public Works Department. 5. LEASE RESTRICTIONS The remaining 5,000 sq. ft. of vacant space at Eaton School may not be leased until such time as the school district demonstrates that the existing and proposed uses do not generate traffic levels beyond that permitted by Condition 15 of Planning Commission Resolution No. 2784. Activities replacing the existing 5 C's pre-school and Montessori School are permitted, subject to the conditions in Planning Commission Resolution No. 2784. 6. LIMITED APPLICATION This resolution and the conditions herein apply solely to the temorary library. Resolution No. 2784 and the conditions therein shall continue to regulate all other activities at Eaton School.
