Statement read by Mayor Scharf and Councilmember Willey before closed sessionSAMPLE REHABILIATION STATEMENT (When recusal not necessary) Before going into this closed session, I would like to respond to questions that have been raised about my participation in Council decisions about litigation involving challenges to the City's approvals and decisions related to a proposed development at the Vallco Shopping Mall site. ,C , ey -Z At the outset, I want to state without reservation that u'n e erstand that as a City As to the concerns that have been raised, these concerns relate to any past involvement with Better Cupertino and related organizations and about my expressed views, particularly those made during my campaign, about the type of development I would prefer to see at the Vallco site. Councilmernbers, and candidates for the Council, are expected to have views about matters that will significantly influence the future of Cupertino. I am no exception. I have collaborated fully with a review of conflict laws conducted by the City's attorneys and am following legal advice and recorninendations on these important issues. I owe no fiduciary duty to Better Cupertino, to organizations affiliated with Better Cupertino, or to any other group or person that would interfere with my ability to make the best decisions possible for the City and its residents. So to summarize, I want to emphasize that in participating in Council decisions regarding Vallco litigation and related matters, my sole goal will be to act in what I believe is in the best interest of the City.
