Subject: Appointments to city commissions and disqualification of candidates Honorable Mayor Scharf and council members , Though you voted to rescind the Code of Conduct and Ethics on January 15, the concepts are still binding on you as a city council: "The Cupertino City Council adopts this Code of Ethics and Conduct as guidelines for elected and appointed officials to exercise their office and conduct themselves in a manner that instills public confidence and trust in the fair operation and integrity of Cupertino's city government." The citizens and businesses of Cupertino and the general public are entitled to have fair, ethical , and accountable local government. To this end, the public should have full confidence that their elected and appointed officials: • Comply with both the letter and spirit of the law and policies affecting the operations of government and their respective roles and responsibilities ; and • Are independent, impartial, and fair in their judgment and actions; and • Use their public office for the public good and not for personal gain; and • Conduct their deliberations and make their decisions in an atmosphere of respect and civility, and during public meetings in accordance with Open Meeting laws , except for confidential proceedings allowed by law." (Page 3) Even more specifically on page 12: "Appointment and re-appointment to a Commission should be based on such criteria as expertise, ability to work with staff and the public, and commitment to fulfilling official duties. A Commission appointment should not be used as a political "reward." These are similar to the guidelines you are already required to follow: • Familiarity with the subject • Decision-making ability • Commitment to the position for which they have applied Based on these criteria, please disqualify the following applicants from consideration due to their legal entanglements with the city which violates "trust in the fair operation and integrity of Cupertino's city government." * Catherine "Kitty" Moore, applicant for Parks and Rec and Planning, is a plaintiff in Friends of Better Cupertino, et al. v. City of Cupertino, et al . (Case No. 18CV330190) Unknown legal fees . * Xiangchen "Minna" Xu, applicant for Parks and Rec and Planning, is the officer of the Better Cupertino PAC and a plaintiff in Committee Supporting Cupertino Citizens' Sensible Growth Initiative, et al v. Schmidt, et al. -Case No. 16CV296322 which has already cost the city over $225,000 in legal fees. * R Wang M, applicant for Planning Commission, was removed from Nextdoor due to use of Cupertino city image to convey official status . I am very concerned about how appointing this individual will appear to other residents and to our neighbors . I r ecall many unkind comments she has made about other residents on the Ne xtdoor app. I tried to find an example, and it took very littl e time. Are these underage high school _fefllil@s the "youngjggies" who will go there to meet Apple professionals? As a m an, I find this set of comments deeply offensive. It seems to imply that all young men, and specifically young men working for , would be· a sexual threat to Cupertino High School students. This comment does nothing to create a sense of an inclusive city. This comment is far from alone on the same website. Please take care in making your appointments. Other residents, neighbors, journalists and the like see these comments. I am concerned that appointing Moore would send the message that this council condones comments and views like the ones above. Recently the city council has been dealing with conflicts of interest that m ay impair the functioning of the council. It would be seen as problematic if this council appointed commiss ion members who themsel ves appear to have conflicts of interest. Three Planning commission candidates look particularly problematic: Catherine "Kitty" Moore is a named person in a lawsuit against the city over its approval of the SB 35 Vallco project. Many of her comments on the Nextdoor local social media service demonstrate that she isn't fair and impartial to Sand Hill Properties ; if sh e can't be impartial tow ards SHP, that brings into question her neutrality towards other parties who have business with the Planning c01mnission . Q 2 Thanks Xiangchen "Minna" Xu is also named in a lawsuit against the city, hers over Measure C, which is a ballot measure that would have dramatically changed how the process by which Cupertino changes its General Plan. She is currently listed as an officer of a political action committee called "Cupertino Political Reforms PAC" which produced and mailed flyers and pamphlets during last year's election, yet she never disclosed payments received in apparent violation of FPPC rules . This council says it values transparency-making this appointment would send the wrong signal. Not only that, but her social media interactions on Nextdoor demonstrate a similar hostility to developers and development that raises the question of bias. Cupertino resident for 9+ years; two children currently in CUSD (Lincoln/Kennedy) Goals: • Resident centric, cohesive, inclusive and transparent planning process • Confidence inspiring review of new developments for impact on Schools , Traffic & Infra o Support a Traffic commission to go with the Bike/Ped commission • Comprehensive & unambiguous General Plan, Muni Code & Zoning guidelines o We owe a clear set of rules to a// developers o Prevent use of loop-holes which are against the spirit of the plan o Benchmark our policies against similar suburban cities • Mixed Use Developments: o Financial Viability Evaluation: Project plan have to be viable as a whole and any cross-subsidy (eg: office supporting retail) to be explicitly called out and accounted for. The availability of tax credits should not be taken for granted . o Non-Compliance Penalties: Project plans should have clearly defined financial penalty clauses to ensure what is approved gets built; the agreement should not leave financial incentives for the developer to ask for changes . o Green Space: Sufficient, fully accessible, and usable green areas • Overcrowded School: Cost of adding a new school campus is enormous ; the financial impact of new housing on schools should be evaluated fairly & planned for. This is picture of my 8th grader's school bag, along with the lunch-box and the basketball he takes for play during recess ; a foot-scale is attached to help judge the size . Kennedy does not have the space to provide lockers to students; so they have to carry everything between classes . And that includes travel to & from the portable classrooms detached from the main building without covered corridors to protect them from the elements.
