City Council Members,
Following on the heels of the mayor's imprudent and insensitive comments about building a wall around Cupertino, the
City Council's selection of Kitty Moore as a Planning Commission member only adds to the city's woes.
Ms. Moore has clearly been opposed to housing development at Vallco—the largest potential site for new housing in the
city. There's nothing wrong with that in and of itself. However, she is also one of the plaintiffs in a lawsuit challenging
the City's approval of the Vallco redevelopment plan. On the basis of this alone Ms. Moore must recuse herself from all
Vallco related matters coming before the Planning Commission. Hence, the commission will be 4 strong at best for the
biggest and most important planning challenges the city faces.
Furthermore Ms. Moore has gone so far as to posit on a Nextdoor posting that building apartments at Vallco would
enable or even foster, legalized prostitution and endanger female students at Cupertino High School. Such statements
are worse than.offensive. In fact they are disqualifying. Under the federal Fair Housing Act, it is illegal to discriminate in
housing on the grounds of sex:_ Furthermore, under the FEHA, it is illegal to discriminate on grounds of sex, gender, or
marital status in matters of housing.. These public statements by Commissioner Moore are clearly prejudicial against
of sex, gender, and marital status under California housing
single males. i.e., they are discriminatory on the basis
law. Empaneling a planning commissioner who has a history of making remarks prejudicial on the basis of protected
class goes against both state and federal housing law.
Bottom line, the City Council needs to step back and rescind the commission selection of Ms. Moore to avoid further
damage to the city's reputation and to enable the planning commission to operate at full strength when considering
Vallco decisions.

Subject: planning commission appointees
Dear City Officials:
What has happened to Cupertino? We have a mayor who proposes building a
wall around this city where I have lived for 48 years. We have been a
tolerate city in the past. I live in the Eichlers which were the first
to allow people of color especially Asians to buy here. Our school have
been noted for their scholastic achievement.
Now we find that three members of the Council who are part of Better
Cupertino are appointing three members to the Planning Commission who
are also participants and vocal about building in Cupertino. I am
appalled at the lack of discretion in this matter. While I may have
voted in the past to stop Sand Hill from their first plan at Vallco I
have becometorealize that something needs to be built there that
certainly must have low income housing. I sincerely hope that these new
council and planning commission members will be open to ideas which will
help those who need to work here and are not high end earners to be able
to live here. For instance teachers.
Being a citizen with knowledge of good government, I really wonder what
is happening to my city with all of conflict of interest happening.
