Proiect Description: Sign exception to allow a ground sign on a property with less than
one hundred feet of street frontage.
RECOMMENDATION:
Staff recommends approval of EXC-2005-09, based on the model resolution.
BACKGROUND:
Northwest Signs, on behalf of Byer Properties, requests a sign exception for the De
Anza Professional Building at 10680 S. De Anza Boulevard to replace an existing non-
conforming ground sign.
DISCUSSION:
The Sign ordinance permits one ground sign if the site has a minimum of one hundred
feet of frontage with a combination of street frontage and building setback of one
hundred and fifty feet. (CMC Section 17.24.100A) The property at 10680 S. De Anza
Boulevard has less than one hundred feet of frontage but the combination of street
frontage and building setback is more than one hundred and fifty feet. The property has
an existing non-conforming ground sign at the location where it is proposing the new
ground sign.
Staff supports granting the sign exception because
a. The building has no visibility from De Anza Blvd due to its 200-foot front setback
from the street
b. The fronting buildings on adjacent properties obscure most of the subject
building and any wall signage it has.

Findings for Exception
Per Section 17.44.040 of the Municipal Code, the Design Review Committee may grant
an exception based upon the following findings:
A Literal Enforcement of the Sign Regulations will result in restrictions inconsistent with the
spirit and intent of this title.
The intent of the Sign Ordinance is to "increase the convenience of the citizen:'
"identify and enhance businesses" and to maintain "the aesthetic appearance of the
City." The applicant requests exceptions to the literal enforcement of the prescriptive
sign regulations. The signage package is well designed and proportionally sized and
allows" for good visibility for the public and the needs of the business while providing
for the safety of the public by minimizing distraction to the motorist and pedestrian."
B. The granting of the exception will not result in a condition which is materially detrimental to
the public health, safety, or welfare.
The existing sign is closer to the sidewalk than the proposed sign. The proposed sign is
setback 8 feet from the rear of the sidewalk. This additional setback makes it easier for
pedestrians and drivers to see oncoming traffic and the sign does not create any health
or safety problems.
C. Least modification of the prescribed regulations and the minimum variance that will
accomplish the purpose.
The applicant requests a monument sign which is one foot smaller in width than the
existing sign. Thus, the visual impact of the sign will be reduced.

3. That the exception to be granted is one that will require the least modification of
the prescribed regulations and the minimum variance that will accomplish the
purpose.

That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. EXC-2005-09, is here by approved; and
That the subconclusions upon which the findings and conditions specified in this
Resolution are based and contained in the public hearing record concerning Application
EXC-2005-09 as set forth in the Minutes of the Design Review Committee Meeting of
May 5, 2005, and are incorporated by reference herein.
