Landscaping at 1601 and 1633 Saratoga -Sunnyvale Road
1. The property owner shall immediately install a construction fence on
the north, south, and east property lines of the subject property.
2. The property owner shall submit a detailed landscaping plan to the
City Council, to be reviewed with the Architectural and Site Approval
Committee on February 5, 1981. The landscaping shall illustrate the
plant materials and irrigation system for a maximum 15 foot strip
along the westerly property line. Said plan shall include trees of a
minimum of 15 ft. in height including 24 inch box, and trees of
specimen variety to provide screening of the former motel site. The
property owner shall be required to install 33 trees,(five of which
are to be 15 to 20 ft. in height). No Silver Dollar Eucalyptus .or
Olive trees are to be used. The property owner shall be fully
responsible for irrigation and maintenance of this area.
3. An irrevocable letter of credit in the sum of Eight Thousand Dollars
($8,000.00) shall be posted with the City to cover the cost of
replacement of trees on the subject property. The owner shall have
one year from the date of this agreement to present a development plan
including a landscaping exhibit illus.trating:r.eplacement.o.f the
subject trees. The City agrees to extend the above deadline by 180
days upon written request of the property owner. The letters of
credit shall be returned to the property owner upon the installation
and inspection of the landscaping improvements.

4. The irrevocable letter f credit shall be received by the City no
later than February, 1981 and the landscaping along the western
property line installed by March 2, 1981; provided, however, that
the Planning Department may grant extensions as necessary not to
extend beyond May 2, 1981. Developer agrees to use due diligence
in expediting the planting.

of Credit No. 5-1313 in your favor for an amount not exceeding US$ 8,000.00
(US DOLLARS EIGHT THOUSAND AND NO/100) expiring at the counters of Bank of
the West, International Department, 180 Montgomery Street, San Francisco
California 94104 at the close of business on August 12, 1982.
Funds under this credit are available to you by your sight draft(s) drawn
on us, accompanied by your statement, signed and dated, reading as follows"
"We certify that Pollack and Pollack has failed to
complete the replacement of trees on property located
at 1601-1633 Saratoga Sunnyvale Road, Cupertino,
California".
All drafts drawn under this credit must bear the clause, "Drawn under Bank
of the West Letter of Credit No. 5-1313, dated February 23, 1981".
We hereby agree with you that drafts drawn under and in compliance with
the terms of this credit will be duly honored upon presentation to us,
together with the original of this Letter of Credit.
This credit is subject to the Uniform Customs and Practice for Documentary
Credits (1974 Revision), the International Chamber of Commerce Publication
No. 290.
