Subject: ELGIBILITY FOR TRANSPORTATION DEVELOPMENT ACT FUNDS
This communication will serve as the requisite opinion of counsel in connection
with the application of the City of Cupertino for an allocation of Transportation
Development Act (TDA) funds.
1. The City of Cupertino is authorized to provide and assist public transportation
by acquisition, construction and operation of existing or additional transit
facilities. This assistance may be provided directly or by contractual arrange-
ments with other parties.
2. The City of Cupertino is an eligible claimant for Transportation Development
Act (TDA) funds pursuant to PUC Section 99275.
3. I have reviewed the pertinent State and local laws, and I am of the opinion
that there is no legal impediment to the City of Cupertino making applications
for TDA funds. Furthermore, as a result of my examinations, I find that there
is no pending or threatened litigation which might in any way adversely affect
the proposed projects, or the ability of the City of Cupertino to carry out
such projects.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AUTHORIZING THE FILING OF A CLAIM 14ITH THE METROPOLITAN
TRANSPORTATION COMMISSION FOR ALLOCATION OF TRANSPORTATION
DEVELOPMENT ACT FUNDS FOR FISCAL YEAR 1981-82
WHEREAS, the Transportation Development Act (TDA), as amended
(Public Utilities Code Section 99200 et seq.), provides for the disburse-
ment of funds from the Local Transportation Fund of the County of Santa
Clara for use by eligible claimants for the purpose of a subsidized
Taxi Program; and
WHEREAS, pursuant to the provisions of the TDA, as amended, and
pursuant to the applicable rules and regulations thereunder (21 Cal.
Admin. Code Sections 6600 et seq.) a prospective claimant wishing to
receive an allocation from the Local Transportation Fund shall file its
claim with the Metropolitan Transportation Commission; and
WHEREAS, TDA funds in the amount of $27,777 from the Local Transportation
Fund will be required by claimant in Fiscal Year 1981-82 for the subsidized
Taxi Program; now, therefore, be it
RESOLVED, that the City Manager or his designee is authorized to execute
and file an appropriate claim pursuant to the terms of the Transportation
Development Act, as ameded, and pursuant to applicable rules and regulations
promulgated thereunder, together with all necessary supporting documents,
with the Metropolitan Transportation Commission for an allocation of TDA
funds in Fiscal Year 1981-82;•and be it further
RESOLVED, that a copy of this resolution be transmitted to the Metropolitan
Transportation Commission in conjunction with the .filing of the claim; and
the Metropolitan Transportation Commission be requested to grant the allocations
of funds as specified herein.
