RECOMMENDATION: Staff recommends denial of EXC-2002-12, based on the model resolution. BACKGROUND: The Cupertino City Center area encompasses a variety of uses such as residential, hotel, office, restaurant and retail. In 2002, Cupertino City Center modified its sign program to include all the existing signage on the Cupertino City Center site. Many of these signs have received sign exceptions, for example the wall signs on the Cupertino City Center towers and the Cypress Hotel, monument signs for the City Center Apartments, Symantec and Montebello and banner signs. DISCUSSION: Chapter 17.24.050 of the Cupertino Municipal Code states that each business with exterior frontage is allowed one wall sign. The applicant is requesting a sign exception to allow two wall signs for Le Boulanger. The location of the two signs is shown on sheet ELEV of the enclosed plan set. Both wall signs will face west onto Cali Mill Plaza and DeAnza Boulevard. Staff believes it is necessary due to the building being setback from the street and its location behind Cali Mill Plaza. LIGHTING INTENSITY After the installation of all signage, if the light intensity levels associated with signage are deemed to be too intense by the Director of Community Development, the applicant shall lower the intensity of the light to an acceptable level. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. The neighborhood is a collection of properties varying in size and dimension, with a predominant pattern of small/ narrow lots. The subject site is located in a P(Res) zoning district with the intent that developments in the district will be consistent with the R1 Ordinance. Any exceptions from the R1 Ordinance shall be considered in the form of a Use Permit. The proposed project conforms to all aspects of the R1 Ordinance with the exception of the first story side yard setbacks. DISCUSSION: According to the R1 Ordinance, the combination of the two side yard setbacks should be fifteen feet with no side yard being less than five feet. For lots in the Rl-5 district, where the lots are predominantly less than six thousand square feet and are predominantly less than sixty feet in width, the side yards can be five feet in width on both sides. The intent of having this provision is so that smaller and narrower lots can have some' flexibility in design and can avoid being penalized for having smaller/narrower lots. The project parcel is 5668 square feet and 50 feet wide. The applicant is proposing side yard setbacks of 5.36 feet and 5 feet on the right and left sides, respectively. Staff supports the proposed side yard setbacks because it is consistent with the intent of the Ordinance. De Anza Boulevard Date:May 19, 2005 Project Description: Director's minor modification of an existing use permit (U-2003-03, Wolf Camera) for a landscaping plan for an approved mixed-use retail/residential project. RECOMMENDATION: Staff recommends approval of DIR-2005-03, based on the model resolution. BACKGROUND: On May 5, 2005, the Committee considered the project and directed staff to do the following: · Clarify City Arborist's tree numbering system · Provide additional discussion on the City Arborist's recommendation to remove the Ash and Redwood trees · Provide discussion on the equity tree replacement of the project DISCUSSION: (Please note that the numbering system used in this staff report reflects the City Arborist's system) Numbering System A new landscaping plan with a tree numbering system that is consistent with the City Arborist's report has been included with the staff report. Tree Removal There are 24 existing trees on the project site. The applicant proposes to remove nine trees (#1, 2, 8, 10, 17, 18, 19, 20, 21). Tree number 19 is an Ash tree that staff originally recommended for its preservation and that the sidewalk meanders around it. After additional discussion with the City Arborist, staff concurs with the applicant's request to remove this tree due to the predictable long-term root damage from its close proximity to one of the condominium entry stoop. In addition to the trees requested for removal by the applicant, the City Arborist also suggests an additional nine trees (#3,4,5,6,7,11,12,13,14) be removed from the project site. Trees numbers 3 - 7 are Ash trees. According to the City Arborist, these trees should be removed and replaced for the following reasons: . The roots of this specie is very destructive to the pavement and the root cutting necessary to install the approved infrastructure would cause the trees to be unstable. . The existing canopies extend so far over the property that they would create maintenance issues over the approved patio area for the new condominium owners. The City Arborist recommends that these Ash trees be replaced with a more upright specie that would provide better screening between the project property and the adjacent nursery activities such as Brisbane Box (Tristania Conferta) or Elegant Swamp Myrtle (Tristania Laurina). In addition, City Arborist recommends that redwood trees numbers 11 -14 be removed because they are not transplantable. The City Arborist recommends the following replacement strategies: 1) Replace the five ash trees (along the northerly property line): eight new 24-inch box brisbane box be planted. 2) Replace the four redwood trees (along the westerly property line): eight new 24- inch box elegant swamp myrtle be planted. Both the brisbane box and elegant swamp myrtle provide good screening and will not create maintenance issues for the future property owners. The reason that new redwood trees are not recommended to replace the removed redwoods along the westerly property line is because there is already an existing row of redwood trees along the neighboring property that generates a tremendous amount of shade to this area. The swamp myrtle is a shade tolerant specie. Tree Replacement According to the tree valuation table provided by the City Arborist (attached). The total number of trees removed equates to a monetary value of $9,378. The total value of the trees being planted are calculated as follows: 8 - 24 inch box - Brisbane Box = $2,800 8 - 24 inch box - Swamp Myrtle = $2,800 6 - 24 inch box - Birch = $2,100 6 - 24 inch box - Crape Myrtle = $2,100 4 - 24 inch box - London Plane = $1Æ2Q Total Value = $11,200 This confirms that the proposed tree replacement strategy is equitable and that the value of the proposed replacement trees exceeds the value of the trees being removed by $1,822. A revised landscaping plan must be submitted for review and approval by 2 the Planning Department (prior to final building inspection) reflecting the recommendations of the City Arborist. It should be noted that only the draft version of the supplemental arborist report/ discussion was available at the time of this report. SECTION III. CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on a plan set entitled: "Wild Flower Village Condominiums, 1375 S. De Anza Blvd., Cupertino, CA 95014", dated March 17, 2005 except as may be amended by conditions in this resolution. 2. TREES REMOVAL AND PRESERVATION: · Per the recommendation of the City Arborist, the four existing redwood trees (#11- 14) are not good candidates for transplanting. These trees should be removed and be replaced with eight new 24-inch box swamp myrtles. · The City Arborist recommends the removal of the five existing Ash Trees (#3-7) located along the northerly property line. These trees are in poor structural condition and many are diseased. These trees shall be replaced with eight new 24- inch box brisbane box. · The existing Ash Tree (#19) shall be removed as part of this approval. · Revised landscaping plan and sidewalk plan shall be submitted for review and approved by the Planning Department prior to final building inspection. The plan shall indicate the species and locations of the replacement trees to the satisfaction of the Director of Community Development and to the City Arborist. · The specific tree protection measured specified by the City Arborist shall be adhere to as a condition of this project. 3. LANDSCAPE MAINTENANCE DISTRICT The applicant shall sign a written agreement agreeing to join an open space maintenance district when such a district is formed per the Conceptual Zoning Plan for South Saratoga Sunnyvale Road Planning Area. Until suck a district is formed, the applicant shall be responsible for maintaining the new parkway and landscaping improvements within the public right-of-way, in a manner acceptable to the City. As a condition, the Planning Commission directed that the applicant return to Design Review Committee for review and approval of the final landscaping plan. DISCUSSION: ì, ~ Currently there are ;l existing trees on the project site. The applicant proposes to remove nine trees and relocate four trees. In addition, the applicant proposes to plant 13 new trees as replacements. Staff is supportive of the landscaping plan with the exception of the following recommended changes: 1) Per the recommendation of the City Arborist, the four existing redwood trees (#2,17-20) are not good candidates for transplanting. Coate Consulting ArOOrist March 14, 2005 Job #03-05-039 I~ EIV"'n MAR 3 0 2005 BY' AN EVALUATION OF THE TREES AT. JUNKER PROPERTY, 1375 S. DE ANZA BLVD., CUPERTIN, Assignment Mr. Chao asked me to prepare a tree report to include identification of all existing trees on the property, and an analysis of their health and size with recommendations for protection during construction. We are to include the value of the trees removed with recommendations for replacement trees. The map used as reference in preparation of this report is a plot plan by Reed Associates, Landscape Architects, my copy dated 3-10-05. No scale is noted but I am assuming 1"=10'. Summary The property in which new buildings will be constructed begins approximately 200 feet west of Stevens Creek Road and is bounded on the south by Wild Flower Way, on the west by Wild Flower Court and on the north by Yamagomi's Nursery storage yard. The space is currently a parking lot for Wolf Camera. The inventory in that portion of the property is composed of eleven evergreen ash trees (Fraxinus uhdei), three purple plum (Prunus cerasiftra blireiana) and six 'Soquel' redwood trees (Sequoia sempervirens 'Soquel'). If built and landscaped according to these plans the following trees would be removed or badly damaged: Purple plum #8, and 21 Coast redwood # I 0 Evergreen ash #3-7, and 19 With adaptations of the hardscape ash # 19 and redwood # 10 could be preserved however. None of the purple plums on site are worthy of preservation. Ash trees #3-5 and 7 would not tolerate root cutting closer than 5 feet from the trunk. Tree #8 would not tolerate root cutting closer than 9 feet fTom the trunk without becoming candidates for windfall. Value of trees #8, 10,3-7, 19 and 21 total $7,433. This is approximately equivalent to three 36 inch boxed trees installed and guaranteed. Observations Eight of these evergreen ash appear to be from the original planting at this site while three others appear to be from subsequent plantings. All five of the evergreen ash adjacent to the north side of the property are currently within 18 inches of an existing curb adjacent to the existing parking lot. One of the evergreen ash (#15) is a street tree adjacent to the southwest comer of the property. This latter tree is the largest of the evergreen ash on the property. PREPARED BY: BARRIE D. COATE. CONSULTING ARIIQRIST MARCH 14. 2005 AN EVALUATION OF THE TREES A r. .uNKER PROPERTY, 1375 S. DE ANZA BlVD., CUPERTlN\ 2 Typical of this species of ash tree many of them have included-bark sites and basically very poor structure. Tree #4 is an extreme example of this structural defect which is common to this species. Some of the individual evergreen ash have been heavily damaged by ash anthracnose (Discula fraxinea), a seasonal, non-fatal disease. The most vigorous of the evergreen ash on the north side of the project area such as tree #3 and #6 have damaged the adjacent curb and pavement. Note that a high power line runs above the north side of these canopies and a low power lines runs more or less through the middIe of the canopies. As a result of line clearing pruning there is virtually no canopy on the north side of the trees but most of the canopy is on the south side over the existing parking lot. Construction/free Conflicts I. Any excavation which is done closer than 6 feet of the trunks of ash trees #3-5, and #7 along the north side would make them potentially unstable. Any excavation closer than 9 feet of the trunk of tree #6 could make it unstable. All of these ash will require significant pruning on the south side to prevent limb drop over the new structures and to raise the canopies. There is a real conflict between these tree canopies and proposed structures. If these trees were pruned heavily enough to clear new buildings comfortably, little would be left of trees #4,6 and 7. 2. Tree #15 the largest evergreen ash is really a street tree. This tree is currently raising the sidewalk and has produced a 4-inch diameter root that is visible on the surface to 20 feet north of the tree trunk. Several other smaller, surface roots may be seen north of the existing sidewalk as well. If this tree is to be preserved it will be necessary to pull up the existing sidewalk and to reinstall either a rubber sidewalk or a new concrete sidewalk with rebar imbedded in it over these shallow roots to prevent the roots from breaking a newly installed sidewalk system but to avoid cutting them within 12 feet of the trunk. This tree is also breaking the curb on the south side and either this tree or the ash across the street are breaking the street pavement as well. When the existing sidewalk is removed, it must be done in such a way that these roots are not damaged. If it may be necessary to repave this portion of the street in order to stop that root damage. It will be necessary when that is done to avoid cutting roots larger than 4 inch diameter if these two trees are to remain healthy and stable. PREPARED BY: BARRIE D. COATE. DE ANZA BLVD., CUPERTlNt 3 It will necessary to be very cautious about landscape activity which involves rototilling or ripping in the area north of tree #15 because of the obvious extent oflarge roots north of the existing sidewalk. It would wise to use an Air-Spade() to excavate in an area 12 inches wide and 20 feet long parallel to the north edge of the existing sidewalk in order to determine where large roots are, how deep they are and which ones can be cut without endangering the tree. 3. It does not appear that the construction activity would harm the existing trees on the north, south or east of the existing building. Recommendations 1. Considering the very poor structure of ash trees #4 and 7 and the propensity of this species to damage adjacent pavement, the project may be better off removing trees #3- 7 and replacing them with a tall, screening tree which does not break pavement, such as Tristania conferta, Brisbane box. If these trees must be retained, the location and elevation of the adjacent walkway will have to be adjusted to avoid root cutting which makes these trees unstable. 2. None of the purple plums on the property are healthy, well formed specimens. It is doubtful they will improve with new care. 3. Trench locations for any purpose including irrigation must be shown on plans and must be outside the drip-lines of all retained trees. 4. Trees added to the S. De Anza Blvd., landscape should be large enough to provide appropriate scale for the broad face of the building. There is room for three 36 inch box 'Yarwood' sycamore (Platanus acerifolia 'Yarwood') (very fast) or scarlet oak (Quercus coccinea) (moderate growth rate) or four smaller trees such as Brisbane box (Tristania cOliferta) which is evergreen and reaches 30 feet tall very quickly. De Anza Boulevard SECTION II: FINDINGS WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Design Review Committee has held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirements: 1. The proposal, at the proposed location, will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public health, safety, general welfare, or convenience; 2. Resolution No. 212 Page 2 DIR-2005-03 May 20, 2005 NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the design review application is hereby approved subject to the conditions which are enumerated in this Resolution beginning on page 2 thereof; and That the subconclusions upon which the findings and conditions specified in this resolution are based and contained in the public hearing record concerning Application DIR-2005-03 set forth in the Minutes of the Design Review Committee meeting of, May 20, 2005, and are incorporated by reference as though fully set forth herein. SECTION III. CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT. 1. APPROVED EXHIBITS Approval is based on a plan set entitled: "Wild Flower Village Condominiums, 1375 S. De Anza Blvd., Cupertino, CA 95014", dated March 17,2005 except as may be amended by conditions in this resolution. 2. TREES REMOVAL AND PRESERVATION: · Per the recommendation of the City Arborist, the four existing redwood trees (#11- 14) are not good candidates for transplanting. These trees should be removed and be replaced with eight new 24-inch box swamp myrtles. · The City Arborist recommends the removal of the five existing Ash Trees (#3-7) located along the northerly property line. These trees are in poor structural condition and many are diseased. These trees shall be replaced with eight new 24- inch box brisbane box. · The existing Ash Tree (#19) shall be removed as part of this approval. · Revised landscaping plan and sidewalk plan shall be submitted for review and approved by the Planning Department prior to final building inspection. The plan shall indicate the species and locations of the replacement trees to the satisfaction of the Director of Community Development and to the City Arborist. · The specific tree protection measured specified by the City Arborist shall be adhere to as a condition of this project. · A tree bond in the amount of $10,000 shall be submitted to the Planning Department to ensure the preservation of Tree #15 (Ash Tree) prior to issuance of building permits. In addition, prior to issuance of building final occupancy, the applicant shall obtain a letter from the City Arborist confirming that the tree is in good health. In the event that the tree must be removed, a field grown replacement tree shall be planted at the discretion of the Community Development Director and the City Arborist. LANDSCAPE MAINTENANCE DISTRICT The applicant shall sign a written agreement agreeing to join an open space maintenance district when such a district is formed per the Conceptual Zoning Plan for South Saratoga Sunnyvale Road Planning Area. Until such a district is formed, the applicant shall be responsible for maintaining the new parkway and landscaping improvements within the public right-of-way, in a manner acceptable to the City. 4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90- day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions.
