THIS AGREEMENT, made and entered into this 5th day of July ,
1967 by and between the COUNTY OF SANTA CLARA, a political subdivision of
the State of California, acting by and through its Board of Supervisors,
hereinafter designated County, and the CITY OF CUPE RTI NO , a
municipal corporation of the State of California;
W I T N E S S E T H
WHEREAS, County has heretofore designated the County Executive as County
Director of Civil Defense and Disaster, pursuant to the provisions of Section
3.1.11-5 of the Santa Clara County Ordinance Code; and
WHEREAS, County has a presently existing and well-established Civil
Defense and Disaster Plan and a presently existing and cell -established Civil
Defense and Disaster Organization functioning under the County Director of
Civil Defense; and
WHEREAS, it would be mutually advantageous to the parties hereto to have
the County Civil Defense Office perform certain civil defense administrative
functions for the City of Cupertino ;
NOW THEREFORE, in consideration of the covenants and agreements herein
contained, it is mutually agreed, in accordance with the terms and provisions
of the California Disaster Act (Chapter 1 of Division 7 of the Military and
Veterans Code), and the Joint Exercise of Powers Act (Title 1, Division 7,
Chapter 5 of the Government Code), as follows:
I
County shall cause the County Executive of the County of Santa Clara as
County Director of Civil Defense and Disaster, and other county officers and
employees subject to his direction and control, to perform, during the term
of this agreement the following civil defense and disaster administrative
functions for the City of Cupertino
A. The County will aid, assist and advise the city in the preparation
and development of a disaster plan for that city.
B. The County will aid, assist and advise the city with the
training of public employees for the disaster organization.
C. The County will aid, assist and advise the city in the preparation
of an annual program paper, which will provide a balanced prepared-
ness program within the capability of that city.
D. The County will provide technical assistance in obtaining any
federal or state funds which may become available to the city
for civil defense purposes.
E. The County will provide assistance in the acquisition by the city
of military surplus property for civil defense purposes.
F. The County will provide a Countywide civil defense program in each
of the following areas:
(1) Community Shelter Planning
(2) Emergency Public Information
(3) Emergency Medical and Health
(4) Emergency Welfare
(5) Disaster Planning for Schools
(6) Training and Education for Civil Defense
(7) Radiological Defense
(8) Industrial Civil Defense Planning
G. The County will prepare and develop a Countywide civil defense plan
which shall provide for the needs of the contracting cities and of
the unincorporated areas of the County and which, in addition, will
take into account and be coordinated with the needs of the cities
in the event of a major natural disaster.

The City of Cupertino shall pay to the County once each
quarter the sum of $300.00 for each full month of service during the term
hereof, or a total of $1200.00 for each full Fiscal
Year, or pro -rated by months if the services are for a lesser period.
III
The term of this agreement shall commence on the first day of ulau-5 t
and shall continue from month to month subject to termination by either party
upon expiration of a period of thirty (30) days after notice of termination
is given in writing by either party to the other party;
IN WITNESS WHEREOF, the COUNTY OF SANTA CLARA, acting by and through
its Board of Supervisors, and the CITY OF CUPE RTINO , acting
by and through its Council, have caused this agreement to be executed as of
the date first above written.
