The meeting was called to order at 8:00 p.m. by Chairman Small who
gubsequently led the assemblage in the flag salute.
Committee members present: You mans$ McLarenv Small. -Absent: Member
Aguilar. Also present: Chief Building Inspector Benevich; Recording
secretary Lucie M. Matzley.
Chairman Small advised his fellow .Committee membar6 that he was in
receipt of a letter from Member Aguilar in which he resigned his member
ship on this Committee. The I ' etter stated that Member Aguilar had move
out of the Cupertino.City limits and, expressed Member Aguilar's regret
in having to submit the resignation as well as his be.st wishes for con-
tinued success for the rdmaining Committee members.
Chairman Small directed that a personal letter be writtento.Member
Aguilar expressing the gratitude of the Chairman and of the entire
Committee to Mr. Aguilar for his long tenure of effective and '.consci-
enu tios service to the City,of Cup I ertino,, as well as thanking him for
having been such a fine member of this Committee, one who will be sorel.
missed, and further expressing this body's best wishes for continued
good.1fortune in his new home.
Chairman Small further directed that inquiries be made of the Offices
of the City Clerk in an attempt to ascertain the status of the plaques
Which are to be forwarded to citizens who served on a Committee, Board
Or Commission.
There were no verbal communications.

mously to approve the minutes of the October 23, 1968 meeting of this.

Alto; requesting approval of the landscaping for the Cupertino
Gardens, located.at 21230 Homestead Road.
Mr. Bob Fiddaman of L.B. Nelson Associates presented the application
and explLained that the submission of the landscaping plans to this
Committee.had been overlooked by a former employee, that the project
was completed from a construction standpoint and that .landscaping had

Mr. Fiddaman stated that the landscaping was extensive and would include
all of the following: mature European olive trees, eucalyptus trees, pine
trees, dodoneas, junipers, texan sprivot and bamboo. `The olive, eucalyptus
and pine trees shall be mature, 15 gal. sage trees.
Some discussion ensued on the narrow planter along the fence dividing the
property from the high school site. The applicant was asked if he was aware
of the necessity of having to provide for a 6" berm along the entire 1000'
strip to protect his landscaping. The applicant stated that lore gr.uivd
cover, such as ivy, was planned for this strip, that sprinkler heads were
in existence all along the strip but that this was a private driveway.
Mr. Fiddaman felt that a request for a 6" berm along the entire length or
the strip would be unreasonable and that, should the requirement be enforced,
he would disregaid plans for the landscaping of the strip and gravel the
full length of tue driveway.
The Chief Building Inspector directed the Committee members, attention to
the fact that this driveway is private property and that a gardener would
be employed to maintain the landscaping, including this strip, at all times.
Member Youmans moved to recommend Application 323- HC-68 for approval subject
to the following conditions: that the applicant adhere to the 12 Standard
Conditions; that in addition to the landscaping as depicted on the sub-
mitted drawings ivy shall be planted along the western property line between
this site and the high school property. Further, that it is the recommendation
of this Committee to the City Council that the Council permit an asphalt berm
jor redwood header board along the driveway adjoining the western property
line. Member McLaren seconded.
Chairman Small stated that the landscaping was well done and that this
Committee is encountering a literal translation of the intent of the 12
Standard Conditions especially in view of the -fact that this driveway is
located on private property.
Chairman Small voted "aye" to let the motion pass unanimously, but directed
the record to show that he was opposed to that portion of the motion which
requires a berm along the western property line.
As a matter of record, Member Youmans xtated that his request for a berm
was based upon the following considerations; 1) that there is a difference
in the elevation of this property to the property immediately adjoining;
2) that there are exposed sprinkler heads inexistence.
B. 380- HC-68: William F. Copley, 10257 Oasis Court, Cupertino; requesting
approval to construct two additional units to the existing triplex,
located at 10257 Oasis Court.
Mr. William Copley presented the application and explained that the two
additional units would be constructed above the existing garages, that
the materials used for the additions would be similar to those on the tri-
plexes with the addition of Dutch windows, and that the roof would be con-
structed of medium shake.

Member McLaren moved to recommend Application. 380- HC-68 for approval per
the plot-- and elevation plans as submitted which include this buildings q
subject to the l2 Standard Conditions and subject to the Planning - Dd_
partment checklist.
C. 383-HC=684 Scofield Associates, 10235 South Saratoga -Sunnyvale `
Road, Cupertino; requesting approval to remodel existing resi-
dence Located at 20556 Scofield Drive to a commercial b uild'L ng
Prior .to commencement of.discussions, Chairman Small advised his fellow
Committee members that the Use Permit for this application had :been
passed by the Planning Commissionwith a 4 m l vote.
Mr. Cane Lacey presented the application and explained the location,, the
proposed landscaping and the plans for remodeling of the existiniz rear
dense to a commercial, building. According to Mr. Lacey, provisions for
sufficient parking spaces have been made„ the entrance to the building
for clients and employees will be from they rear of the building, and
the parking area is self-contained and concealed by a fence.
Considerable discussion ensued relative to the existing narrow alley
adjoining the site which is utilized by, trucks making deliveries to the
businesses next to this property. Mr. Lacey stated that the fence might
have to be removed and replaced with a brick wall to protect his Oark ng
area or off-street parking might have to be considered if the inherent
hazards would force such a method. According to Mr. Lacey, there wild,
be no signs other than those permitted by the Ordinance and.no lights
other than those needed for security purposes.
Chairman Small asked for audience comments. Mrs. Frank Garrett of
20668 Scofield Driven Cupertino, addressed the Committee members and
relayed that she had submitted a letter bearing thirteen'n signatures ob-
tained from homeowners living on Scofield Drive who arcs opposed to this
application, Mrs® Garrett quoted an excerpt from the Cupertiano. Courier
Editorial of bate and stated that she was aware of the fact that this
City had Minnhnerited"I certain zonings from the County without any re-
course bust ghat, inn her opinions this residence should remain as a
dwelling andBnot be used commercially, regardless of the fact that it
was located in a commercial zone.

Unfinished Business
The Committee members, led by Member Youmans, stressed the complete lack
of cooperation in adhering to numerous previous requests for completion
of applications by the applicants for Straw Hat Pizza, Mike's Hero Sand-
wiches and the Montgomery Place Beauty Salon.
After some discussion on the subject, Chief Building Inspector Benevich
was directed to personally contact each of the violators demanding completion
of the application. Should it be ascertained at the next meeting of this
body that the violations are still in existence, this Committee shall
recommend to the City Council that legal action by commenced forcing the
cessation of Ordinance violations.
New Business
Several ppnding matters were discussed by the Committee members, one of
which was to postpone consideration of the third draft of Ordinance 220 ( )
as submitted by the Planning Department.
Member Youmans moved to postpone discussions of the draft for Ordinance 220 ( )
to the next regular meeting. Member McLaren seconded and it was passed unani-
mously.
!Several new violations of Ordinances existing within the City of Cupertino
were brought to the attention of the Committee members. The Chief Building
;Inspector was instructed to follow up on each of them.
Member McLaren moved, Member Youmans seconded and it was passed unanimously
that the meeting be adjourned.
The meeting adjourned at 9:55 p.m.
