Mr. Ellers stated that all landscaping would be fully sprinklered. 337-HC-68 Member Aguilar moved to recommend Application 337-HC-68 for approval, approved subject to the applicable conditions of the 12 Standard Conditions, with with the street tree installation in number and location left to the conditions discretion of the City staff, with the existing trees to be those as indicated in the oral presentation, with the specific stipulation that there shall be 15 gal. trees in 15 gal. containers. Member Fitch seconded and it was passed unanimously. 308-RC-68 B. 308-HC-68: Mike's Hero House, 20840 Stevens Creels Boulevard; legend requesting approval of the landscaping for that location. Mrs. Pauline Woodruff of P.O. Box 748, Cupertino, made the presentation present- stating that the landscaping plans had been submitted and prepared and ation would be installed and contracted out by the Cupertino Nursery. Mrs. Woodruff further stated that she was holding a receipt for $400 deposited in lieu of bond to guarantee the completion of the landscaping. 308-HC-68 Member Fitch moved to recommend Application 308-HC-68 for approval subject approved to the 12 Standard Conditions particularly conditions 11 and 12 of these conditions, with the print as submitted. Member Aguilar seconded and it was passed unanimously. 361-RC-68 C. 361-HC-68: Ditz-Crane, 2295 De Da Cruz Boulevard, Santa Clara; legend requesting approval to erect concrete block entrance signs for the Somerset Square development. Mr. Richard Potts, representing Ditz-Crane, made the presentation, present- explaining that these signs were temporary in nature and would remain ation at the sites only until all homes in the subdivision had been sold. There was some discussion on the possibility of installing permanent permanent signs. Mr. Potts pointed out that the developer would not be opposed signs to such permanency but that there was a maintenance problem and that the discussed signs would be removed upon complete sell-out of the subdivision unless some Homeowners' Association would agree to the continued maintenance of the signs. 361� Member Aguilar moved to recommend Application 361-HC-68 for approval per approved the plan submitted for the temporary signs, subject to the applicable with conditions of the 12 Standard Conditions, with the specific provision conditions that the developer shall maintain the signs sufficiently so that they will not deteriorate prior to the completion of the project. Member Aguilar seconded and it was passed unanimously. In the discussion following the denial, Member Fitch stated that he was clarifi- not denying the application as such but the sign as submitted and that cation it was his recommendation that the applicant submit a different sign for approval. Member .Aguilar cautioned that any additional action on this application caution would be inappropriate in view of the fact that a motion had been made, seconded and passed, and that such denial would necessitate a separate motion filing procedure and a new application number. Member Fitch withdrew withdrawn his motion, Member Aguilar withdrew his second, and the denial was rescinded. 364-RC-66 Member Aguilar moved to continue Application 364-HC-6S for further continued hearing if it is the desire of the applicant to be heard further. Member Fitch seconded and it was passed unanimously. recess Chairman Small called a recess at 9:20 p.m. The meeting reconvened at 9:30 p.m. 365-HC-6S G. 365-HC-6H: Mobil Oil Corporaticn, 1197 Ferry Street, Oakland; legend requesting approval to construct a Mobil Oil service station at the northwest corner of Bernardo Avenue and Homestead Road. Mr. Allen Hulme, the Real Estate representative for Mobil Oil Company, made the presentation, stating that the application had received a Use Permit from the Planning Commission.. Mr. Hulme emphasized that there was room for more than adequate landscaping and that provisions had present- been made for excess landscaping of the property. Further, that his ation company had insisted upon installing a sidewalk along the property line for the safety of the school children in the area thereby eliminating the danger of having children walk through and into the service station. later When asked about plans for signs and a detailed description of the proposed submission landscaping, Mr. Hulme stated that both plans would be submitted at a later time. In answer to questions by the Chairman how best to eliminate excessive sign displays and initially preventing their installation, Mr. Hulme stated that it was his company's desire to cooperate in this matter to company's the fullest extent; in fact, conditions had been written into the lease cooperation agreement for service stations barring the installation of advertising stressed signs other than the usual national identification signs. Mr. Hulme also stated that service stations planned during the last two years is had been designed in such a fashion as to place all tire racks, old tire storage areas and any other equipment within the building confines.
