a restaurant and a retail/office building, located: at Stevens

Mr. Reynold Watson presented the application and, for the benefit of
the new Committee members as' well as Member Aguilar who had been
absent at the last meeting,''explained the proposed project by saying
that the restaurant would be part of a chain of General Foods sub=
sidiaries, that this would be neither a drive-in nor a.take-out
restaurant, and that it would be located 129° off Stevens Creek,
Boulevard to afford:,s a better coordinated continuation. of design with

Mr. Watson further stated that during the last meeting exception
had been taken to the lighted diamond insignia facie, and that the
revised plans.,as submitted, showed the elimination of this lighted
facia and had been substituted by illuminated diamond signs on the
walls of the restaurant, leaving the eaves completely free of all
advertising.

Upon being questioned, Mr. Benevici concurred that meetings had taken

place during which the parties concerned had agreed to remove the diamond

from the eaves and that they be put on the sides of the building, thus
keeping them in conformance with applicable City Ordinances.
Considerable discussion ensued during which the members asked questions
relative to the proposed parking lot lighting. The applicant stated that
it was his desire to stay away from.the standard lighting used in
statements
parking lots but that no discussions had been held with General Foods on
the subject. It was stated, however, that the lighting would be maintained
for the retail/office building as planned and that no high intensity
lighting was scheduled for the parking lot to compensate for the change
in design.
Chief Building Inspector Benevich cautioned the members of the Committee
as well as the applicant that the Planning Department had insisted upon

The applicant asked if one of the requirements, specifically, the con-

for the property's use had been made. Member Fitch felt that a request

of this nature would have to be directed to the City Council as this body
does not have any jurisdiction over matters of this type.

Member Aguilar moved, Member Fitch seconded and it was passed unanimously
approved
to recommend application 337-HC-68 for approval with the location of the
diamond design on the building walls as presented on the renderings sub-
mitted.
Member Aguilar amended his motion to state that with respect to the
amendment
requirement for the masonry wall separating the subject property from
the adjoining property this body r�-commend to the City Council that this
requirement be suspended for one year. Member Fitch seconded the amendment
and it was passed unanimously.

Member Aguilar moved with reference: to the fence surrounding the
subject property to recommend to t1te Planning Commission applicant's
request for a reduction to four feet from the beginning of the
building down to the sidewalk. Member Fitch seconded.

The motion was denied 3 - 2.
Member Fitch asked that the City be given some sort of authority to
discuss the matter of maintaining a level of cleanliness around this
particular area as it adjoins a very fine development. Chairman Small
indicated that he would approach the City Council with this request.
D. Application 341-HC-68: Kjartan 0. Armann, 208 Belmont Avenue,
Los Gatos; requesting approval to construct an addition to Paul
Swanson Ford, 20235 Stevens Creek Boulevard.

Considerable discussion ensued almosd immediately relative to the
necessity for street improvements, installation of concrete car stops
and a beautification of an entirely black -topped area. It was as-
certained that, when the original Use Permit was granted, certain
conditions had been attached to this Use Permit. When requested to do
so, Chief Building Inspector Benevich stated that these same conditions
would apply to the extension and any other additions as long as no
change in operation occurs and that there is no time limit on the
permit. In further looking at the submitted plans, the members noticed
that no parking spaces had been provided for although the Planning
Department's H Control check list indicates the necessity for seven
such spaces.
Mr. Benevich reported to the Commi.tee that the City would prefer to
have the entire street improved but that the street along the proposed
addition would certainly have to be improved. He also stated that
the sign currently on the premises would have to be moved farther back
on the lot as it is in violation to the Ordinance.
Member Youmans said that, in his opinion, the plans as presented were
very limited and spartan in their approach and that he, personally,
would prefer to see something more detailed and explicit with the
inclusion of such items as the concrete wall, the parking spaces
and the landscaping.
Member Aguilar moved to continue application 341-HC-68 to the next regular
mePti_ng with the request that the applicant return with a more specific
rendering which is to include landscaping, the outline of street im-
provements, concrete berms installed on the existing parking spaces and
with an indication as to the proposed new location for the existing sign,
all to be in conformance with the Sign Ordinance. Member Youmans seconded
and it was passed unanimously.

E. Application 342-HC-68: Cupertino Plumbing, 20432 Silverado
Avenue; requesting approval to erect a 2° X 7" sign at that
location.
The.apjA icant stated that the proposed sign would show three basic
colors-9 a white background with "Cupertino Plumb ing"in red letters
and "Sales and Service" in black lettering.
There was some discussion among the members relative to the entire
sign area on.this site and. Chief Building Inspector Benevich stated
that the property owner was out of the country and, further, that
the proposed sign would probably be the most attractive one on the
site in addition to being in conformance to the Sign Ordinance.
Member Aguilar. moved to recommend application 342-SIC-68 for approval
with the sketch and plans as presented. Member Fitch seconded and
it was passed unanimously.

Chairman Small stated that the American Oil station at Highway 9 and �
.Stevens Creek Boulevard wasobviously in violation of --the Sign Ordinance
as he had personally observed some fifty different sign on the premises,
including advertisements for Bankamericard, Blue Chip stamps; etc. J.violation
Further,, that these signs were affixed to pokes., gas pumps, walls of the
building., etc Mr. Small asked that this Committee receive,a report back
and that, if the station is found to be in violation of the Ordinance,
an order to cease and desist be issued.
Mr. Small also inquired as to the legality of temporary signs such
as political and subdivisons advertisements which can be viewed at.
most profound places. It was his opinion that if the City Ordinance
permits such displays, it should be amended to afford a better prom
tection for the City.
Member Fitch moved to recommend to the City Council that they review
the Sign Ordinance with reference to the 4 x 8 signs, specifically
Section 6.14 which relates to subdivision directional signs, and
Section 6.08 relating to political signs. Member Aguilar seconded
and it was passed unanimously.
Member Small also mentioned that advertising signs had been placed on
poles and wondered if this was within legal limits. Mr.. Benevich
assured him that.it was not and that he would. -check out the examples
as cited by Mr. Small.
Chief Building Inspector Benevich asked that the members of the.
Committee consider changing the existing ten Standard Conditions for
H Control to include two additional items,, i.e. Item 11 and Item 1.2 9
and recommending same to the City Council for approval., to wit.

Member Fitch moved that Item 11 and Item 12 as recommended by the Chief
Building Inspector be included and added existing to the Lsting ten Standard
Conditions, to be reviewed by the Ic-ity Council at their May 23, 1968
meeting. Member Aguilar seconded,
Member Youmans amended the motion to state on Item 11. " a minimum
6" berm". Member Aguilar concurredg and the motion passed unanimously.
Mr. Benevich reported to the members 4Chait he had contacted the operator
of the 7-11 store on Bubb Road opposite Prezidio Drive. He said that
the operator was most anxious to c,�operate wi"Ith the City but had stated
that Kennedy School has an open campus and that, its students, after
having visited his store, throw delari-s and ice cream containers about
indiscriminately. The owner had also said that he had been threatened
by young thugs with motorcycles who had succeeded in running through
the landscaped area and breaking two of 41-1he plants which subsequently
died.
Chairman Small asked that Mr. Benevich re. -port his findings to Mr. Smith,
the gentlemari who had placed the original complaint during the last
meeting, and that M".,. Smith be advised of the action taken in writing.
Member McLaren wondered if a bicyc""� rack could be installed by the
school and if t':tie City could request this. Mr. Benevich indicated
that he would contact the school ult-h a request- for a bicycle rack as
well as a request for more cleanliness on the part of the students.
Chief Building Inspector Benevich apologized to the new members that
their name plates had not arr-L'.red, but that they would be in appearance
at the next meeting as they were on order.
Member Aguilar moved,. Member Fitcb seconded and it was passed unanimously
that the meeting be adjourned.
